MINUTES
CLOSED SESSION
DECEMBER 10, 1996
The Closed Session was called to order at 10:08 p.m., in the conference room of the
Senior Citizens' Center, 50 South Emerson Street, for the purpose of discussing Litigation
and Personnel. Present at the Closed Session were: Mayor Gerald L. Farley; Trustees
George Clowes, Richard Hendricks, Paul Hoefert, Michaele Skowron and Irvana Wilks.
Absent from the Closed Session was Trustee Timothy Corcoran. Also present were:
Village Manager Michael Janonis and Assistant Village Manager David Strahl.
On a Motion by Trustee Hoefert and Seconded by Trustee Clowes, the Closed Session
Minutes of November 6, 1996 were approved by a unanimous roll call vote.
Litigation
Village Manager Michael Janonis reviewed with Board members the current status of a
Federal discrimination claim which had been filed by a former probationary Patrol Officer
of Hispanic descent. Mr. Janonis indicated that the process of Discovery was now under
way. The Village's attorney, who has done work for the Village before, was successful in
narrowing the focus of discoverable material. Mr. Janonis further indicated that he felt very
comfortable with the expertise of the Village's legal counsel.
Mr. Janonis informed the Board that the plaintiff had made a settlement demand that
included damages totaling $100,000, reinstatement on the Police force and the deletion
of any previous negative appraisals. Mr. Janonis indicated that he had rejected this
settlement offer. Mr. Janonis indicated that while such a settlement would include no
admission of guilt by the Village, it would likely appear to the general public that there was
some basis to the original claim. Also, bringing this person back on the Police force would
make it very difficult, if not impossible, to judge this person's future performance without
risk of further claims of discrimination.
After brief discussion among Board members, their consensus was to support Mr. Janonis'
rejection of the settlement demand and to purse a vigorous defense of the case.
Mr. Janonis asked Village Board members to avoid discussing issues or questions
regarding this case with any Police personnel due to the fact that there was a suspicion
that this former employee was trying to get additional Officers to join in the Suit.

There being no other business conducted in open session, the Committee of the Whole
meeting was adjourned at 10:45 p.m.
