JANONIS VILLAGE CLERK CAROL A. fiELDS CS\1D[1[b mn:~@~ rID&lf@ t - " 1 ~z.t Village of Mount; Prospect; 100 South Emerson Street Mount Prospect, Illinois 60056 Phone: 708 / 392-6000 Fax: 708 / 392-6022 TOO: 708 / 392-6064 MINUTES EXECUTIVE SESSION AUGUST 24, 1993 The Executive Session was called to order at 10:10 p.m., in the Conference Room of the Senior Citizens Center, 50 South Emerson Street, for the purpose of discussing Property Disposition and Litigation. Present at the Executive Session were: Mayor Gerald Farley; Trustees George Clowes, Timothy Corcoran, Richard Hendricks, Paul Hoefert, and Michaele Skowron. Absent from the Executive Session was: Trustee Irvana Wilks. Also present were: Village Manager Michael Janonis and Assistant to the Village Dave Strahl:, Property Disposition 1. PinelWille Redevelopment. The Village Manager reported there had been no further substantive discussions with Broadacre regarding redevelopment potential for the PinelWille block. Inability to obtain financing remained the hurdle to moving forward with a Developer Agreement with Broadacre. As a result of the financing problem, Mr. Janonis indicated that staff had initiated contact with other local developers including Ray Franczak, a local condominium developer as well as Michael Ponterelli, another local developer. Both had expressed some interest after seeing the Site Plan and had indicated they would be interested in submitting proposals. The issue of cost of land to the developers was discussed preliminarily. Staff indicated that the Board would be willing to entertain the idea of a write down on land costs if the proposed development was in line with the Board's parameters for a redevelopment project. The Village Manager indicated he would keep Village Board members aware of any additional discussions with these developers. 2. School District 57. The Village Manager indicated he had no new information to report regarding District 57's interest in the Sunrise Park. District 57 was continuing to look at engineering issues relative to the site as well as continuing discussions with the Park District for an appropriate Lions Park site. Litiqation Mayor Farley asked the Board if it would consider joining Schaumburg in potential litigation against the State for recently enacted legislation pre-empting home rule municipalities from local regulation of pesticide use. Schaumburg's reason for litigating was based on a further erosion of home rule authority and the fact that this particular legislation exempted the City of Chicago from pre-emption. It was felt that this type of exemption set a dangerous precedent that allowed for the State legislature to more easily pre-empt home rule municipalities without having to deal with the political power of the City of Chicago. General discussion among Board members indicated an interest in exploring the feasibility of said litigation. Some concern was expressed regarding the cost of litigation and the likelihood of prevailing. Staff was directed to contact the Village of Schaumburg and obtain more details regarding the effort. There was no further business discussed. The Executive Session adjourned at 10:47 p.m. on a Motion by Trustee Skowron and Seconded by Trustee Hoefert. There was no official action taken.
