MINUTES
EXECUTIVE SESSION
APRIL 21, 1992
The Executive Session was called to order at 9:14 p.m., in the second floor Conference
Room of the Senior Citizens Center, 50 South Emerson Street, for the purpose of
discussing litigation and personnel. Present at the Executive Session were: Mayor
Gerald Farley; Trustees Mark Busse, George Clowes, Timothy Corcoran, Leo Floros and
Paul Hoefert and Irvana Wilks. Also present was Village Manager John Dixon.
The first item under Litigation that was discussed was the Elk Grove Township Rural
Fire Protection District Court matter that was recently reviewed by the Appellate which
concurred with the lower Court on the grounds that the contract for the Village to
provide fire services to the District was not valid because of the clause leaving the cost
at the highest Tax Rate. The Village Board concurred that we should not proceed any
further with this matter.
The second matter under Litigation was the Suit that was brought by Home by Hemphill
against the Village indicating the developer felt he was due a sum of money for
unsuitable soils. The Village Board authorized defense of this Suit by Don Moran of
Pedersen and Houpt with assistance by Richard Cosby who has been involved with the
discussions for two years when this matter was first brought to our attention.
The third item discussed was Personnel. The Board excused the Village Manager from
the discussion.
The Executive Session was adjourned at 10:02 p.m.
