The Closed Session was called to order at 7:45 p.m. by Mayor Farley, in the Boardroom of the
Central Community Center, 1000 West Central Road. The purpose of the Closed Session was to
discuss Litigation and Personnel. Present were: Trustees Paul Hoefert, Richard Lohrstorfer,
Michaele Skowron, Irvana Wilks and Michael Zadel. Absent from the Closed Session was Trustee
Timothy Corcoran. Staff present included: Village Manager Michael Janonis, Assistant Village
Manager David Strahl and Village Attorney Everette Hill. Police Chief Richard Eddington arrived at
8:10p.m.
Litiaation
Cunninqham Case
Village Attorney Hill provided a summary of the Cunningham v. Mount Prospect Case. He stated
that he took the additional authority provided by the Village Board from the last discussion to the
Judge for Settlement discussions. However, Cunningham has rescinded any consideration of
settlement in combination to his resignation off the table. He fully intends to stay on the job at this
point. However, Cunningham's attorney Keith Hunt has offered that the Village could pay $90,000
and Cunningham would sign a confidentiality agreement whereby the Village could get the money
back through wage garnishment if disclosure of terms were made by Cunningham. He stated he is
not sure if this is conceivable. He also stated it is highly probably the insurance providers will likely
provide a letter to the Village that any potential verdict over the $90,000 offer would be the Village's
responsibility. He stated a Motion for Summary Judgment has been filed and a response to that
Motion should be received in early 2004. He stated there is a good chance that the Statute of
Limitations will apply in several claims, which will significantly limit any possible exposure of the
Village and insurance providers.
Consensus of the Village Board was to react to communication from insurance providers
once it is received regarding this Case.
At 8:10p.m., Attorney Hill left the meeting.
Personnel
Police Department Discussion
Chief Eddington arrived at 8:11 p.m.
Chief Eddington stated that he is in the process of making changes to the overall shift assignments
for the Patrol personnel. He stated these reassignments are based on management rights
contained within the Labor Agreement with the Union and the Village management team has also
suggested discussions with the Union regarding this change. However, the Union has refused to
discuss these potential changes. Therefore, the Chief is suggesting that the shift assignments move
forward and he wanted to advise the Board in case there are grievances that arise from these
reassignments. He stated many reassignments are based on performance and operational needs of
the Department. The current labor agreement allows for reassignments based on consideration of
four criteria. .
Public Works Neqotiations
Assistant Village Manager David Strahl provided general information about the meeting that took
place earlier in the day whereby there was no additional progress in coming to agreement with the
Union.
There was no further business and the Closed Session adjourned at 8:38 p.m., moved into open
session and immediately adjourned at 8:39 p.m.
