The Closed Session was called to order at 9:35 p.m. by Mayor Farley, in the Boardroom of the
Central Community Center, 1000 West Central Road. The purpose of the Closed Session was to
discuss Litigation and Personnel. Present were: Trustees Paul Hoefert, Richard Lohrstorfer,
Michaele Skowron, Irvana Wilks and Michael Zadel. Absent from the Closed Session was Trustee
Timothy Corcoran. Staff present included: Village Manager Michael Janonis, Assistant Village
Manager David Strahl and Fire Chief Michael Figolah and Village Attorney Everette Hill.

Cunningham Case
Village Manager Michael Janonis provided a summary of the Settlement options that are currently
available. He stated the Village has put $50,000 on the table in addition to insurance company
contribution. He stated that the Village could win the Case and expend a large amount of money. It
has spent $150,000-$200,000 defending itself and still have the employee employed.
Village Attorney Hill provided a summary of two potential offer scenarios; one based on remaining
employed and one if Cunningham resigns his position. He stated the Village has taken the position
that any settlement would require resignation. He stated the $290,000 figure is based on the
present value of Cunningham's pension in today's dollars. He stated Judge Brown has been
working hard on trying to bring the two sides closer together for a possible settlement and she has
taken the position that it should settle on the low $200,000 range. He stated the insurance coverage
commitment is limited due to the single incident retention levels and the fact the Village has changed
insurance providers regularly. He stated that it would be preferable to get a resignation attached to
any settlement in order to save litigation costs.
Village Manager Janonis asked for authorization of up to $105,000 total from the Village with the
remaining portion coming from insurance company commitments.
General discussion among Village Board members included the following items:
There was concern of the Village appearing if it settles cases regularly regardless of the merits of the
case.
Consensus of the Village Board was to authorize up to $105,000 in Village money for
settlement purposes.
Egeberah vs. Villaae of Mount Prospect
Village Manager Janonis stated that this Case has been decided by a Jury whereby all defendants
were found not guilty. The Plaintiff's attorney has filed a post-trial motion asking the Judge to set
aside the verdict. However, it is unlikely the Judge would set aside the verdict at this point. He
stated it is conceivable the Village could demand expenses of approximately $18,000 from the
Plaintiff as leverage to dispose of this Motion.
Personnel
Public Works Neaotiations Update
Assistant Village Manager David Strahl provided an update regarding the previous meetings with the
Public Works Union. He stated the Village team had offered an opportunity for funding for retiree
health insurance based on utilizing a portion of retroactive pay. The Union countered with a
significant enhancement to the proposal at which point the negotiations broke off. There is an
additional negotiation session scheduled for November 18 and staff will report back at that time.
There was no further business and the Closed Session adjourned at 10:18 p.m.
