Lowe Village of Mount Prospect 100 South Emerson Street Mount Prospect, Illinois 60056 U?l1D [1,[1, [M rn [1, rn&@rn IID&lrrn ~~ ~IO MINUTES CLOSED SESSION SEPTEMBER 16, 2003 The Closed Session was called to order at 8:52 p.m. by Mayor Farley, in the Central Community Center Conference Room. The purpose of the Closed Session was to discuss Personnel, Litigation and Personnel-Collective Bargaining. Present were: Trustees Timothy Corcoran, Paul Hoefert, Richard Lohrstorfer, Michaele Skowron, Irvana Wilks and Michael Zade!. Staff present included Village Manager Michael Janonis, Assistant Village Manager David Strahl and Village Attorney Everette Hill. Personnel Village Manager Janonis briefed the Board on the Workers' Compensation status of Police Officer Michael Patti. He stated he anticipates that Officer Patti will soon be going out on a duty-incurred disability. He also stated that Officer Joseph Favia is currently on Workers' Compensation and he may not recover fully and be required to apply for a duty-related pension. He stated that if he were to obtain a duty-related pension, he would possibly have free health insurance provided by the Village based on recent legislation and a Supreme Court decision. Officer Jim Czarnecki is also on Workers' Compensation and would likely apply for a duty-related pension assuming his back injury does not recover to the point where he can return to full duty. Litiaation Garcia Village Manager Janonis briefed the Village Board on Joe Garcia. He stated that the Case has currently been brought under Appeal for Summary Judgment by Mr. Garcia's attorney. He stated the Police Pension Board had rejected a settlement offer to dispose of the Case and not reverse pension claim to be covered as duty related. Eoeberqh He stated the trial is set for October 6, however, depending on the Judge's schedule, it mayor may not begin on time. Timothv CunninQham He stated that settlement demands have been tendered between the parties. He stated the Village is currently working with the Village insurance providers to determine if they would contribute to a possible settlement. He stated that if settlement were to be seriously undertaken, such settlement would require a resignation. Consensus of the Village Board is to get commitments from insurance providers to fund possible settlement with resignation as a component of any settlement to be considered. Personnel-Collective Baraainina Public Works Union Assistant Village Manager Strahl provided an update with the Public Works Union. No new negotiations are scheduled and the Public Works Union has filed an Unfair Labor Practice Charge which will be under investigation by the State Labor Relations Board. Police Union There have been several negotiation sessions and there may be picketing by Officers in the future, however, there is no specific date for such picketing efforts. Fire Union Negotiations have just been started and the Lieutenant promotional list which was recently published may be an issue according to the Union since the State law requiring negotiation of promotional procedures according to the Union and the current list is problematic.
