Lowe MINUTES CLOSED SESSION DECEMBER 3, 2002 rP(1D[b[1 [FJ~[1~&@~ IIDL%urn ~.q-ao(O The Closed Session was called to order at 8:28 p.m. by Mayor Farley, in the second floor Conference Room of Village Hall. The purpose of the Closed Session was to discuss Litigation and Personnel. Present were: Trustees Timothy Corcoran, Paul Hoefert, Richard Lohrstorfer, Michaele Skowron, Irvana Wilks and Michael Zadel. Staff present included: Village Manager Michael Janonis, Assistant Village Manager David Strahl, Fire Chief Michael Figolah, Village Attorney Buzz Hill and Labor Attorney Steven Rynecki. LitiClation Village Manager Janonis provided a general overview of the status of the case of Timothv Cunninaham vs. Village of Mount Prosoect. He provided background on the alleged claim and the promotional process. Steve Rynecki spoke. He is the Village's lead attorney in this case and advised the Board about the current status and recent ruling. He stated there was a recent decision from the Judge that did not exclude the individual plaintiffs at this time but the Village has the opportunity to appeal that decision and he is recommending consideration of the Board to authorize filing of an appeal for this purpose. He also provided an overview of what he felt were the potential exposures to the Village and the individual employees if the appeal was not successful and the probable next steps. Consensus of the Village Board was to file an appeal of the Judge's recent decision for Motion to Dismiss. Village Manager Janonis provided a summary of another case against the Village, Garcia v. Vil/aae of Mount Prospect and Police Pension Board. He stated this case is based on Garcia's claim that he was discriminated against by the Pension Board for not obtaining a Disability Pension due to his testimony in the Martinez Case. In this case, the Village was successful in its Motion to Dismiss and Garcia is in the process of appealing the decision. He stated that as part of the case, there is a mandatory mediation process that has been going on and he is obligated to advise the Board of this process and determine whether there is any interest in offering a settlement. Consensus of the Village Board was not to offer any settlement at this time. Village Attorney Buzz Hill and Fire Chief Mike Figolah left the meeting at 9:26 p.m. Personnel Village Manager Janonis provided an update regarding the most recent mediation discussions with the Public Works Union. He stated the most contentious issue is contribution for retiree health insurance. Assistant Village Manager Strahl provided a general summary of the negotiations and his assessment of the sticking points. He also stated the Village has a couple of options at this point including implementing the Village's final offer or just doing nothing at this point and letting the Union just sit. There was extensive discussion about what the various options were and their possible impact. Consensus of the Village Board was not to implement the final offer at this time. Village Manager Janonis also provided a summary of the Police Sergeant Union filing. He stated the issues that are known at this time include the 4/10 schedule, paid overtime and maintaining the separation between wages of Sergeants and Patrol Officers. He stated this information is for information only at this time and the staff is in the process of formulating a response which would likely include a request for a hearing to determine whether this is a valid unit. There was no further business and the Closed Session adjourned at 10:00 p.m. and immediately reconvened into open session.
