Lowe Village of Mount Prospect 100 South Emerson Street Mount Prospect, Illinois 60056 MINUTES CLOSED SESSION APRIL 16, 2002 The Closed Session was called to order at 7:53 p.m. by Mayor Farley, in the second floor conference room of the Village Hall. The purpose of the Closed Session was to discuss Personnel and Land Acquisition. Present were: Trustees Timothy Corcoran, Paul Hoefert, Richard Lohrstorfer, Michaela Skowron, Irvana Wilks and Michael Zade!. Staff present included: Village Manager Michael Janonis, Assistant Village Manager David Strahl and Police Chief Richard Eddington. Motion made by Trustee Lohrstorfer to approve the Minutes of March 20, 2002 and Seconded by Trustee Skowron. Minutes were approved. Approval of Closed Session Minutes from of April 2, 2002. Motion made by Trustee Zadel and Seconded by Trustee Lohrstorfer to approve the Minutes. Minutes were approved. Personnel Police Officer Allen Wilcox Officer Wilcox has filed a grievance due to a reassignment from Investigations to Patrol and was not provided his preferred shift in the reassignment. The grievance has been submitted to the Village Manager which is the third step after rejection by the Police Chief. He stated the grievance would likely be rejected at the Village Manager level which would allow for the grievance to continue to arbitration if that is the desire of the Officer. Generally this is a management rights' question which allows for wide discretion as outlined in the contract and the employee would have the opportunity to bid on his preferred shift for next year's shift assignment, however, accommodating his shift this time would necessitate rearranging of several shifts that have already been assigned. Such juggling of shifts would surely necessitate additional grievances by those individuals who were reassigned. This was for informational purposes only and requires no action at this time. I? .\r @ 8 l!!!!I ~ ~ ~1 ~~ ~I? ~~ @;@ Firefiohter/Paramedic Tim Cunninoham This employee has filed an Unfair Labor Practice for not getting the necessary merit points to continue the Lieutenant's promotional process. He is claiming he was denied the necessary points due to his Union activities. It should be noted that the Fire Department has postponed the testing process until Tim had returned to duty after being off for eight months on a non-duty related injury, otherwise, the previous list would have expired prior to Tim's return. He had also not been involved in any Union business for over four years and the Fire Union has removed itself from this process and this is proceeding only under the employee's initiative. The Village has recently filed a response and is awaiting a ruling from the Illinois State Labor Relations Board on whether a Hearing will take place. Firefiohter/Paramedic Douo Lubash This employee has also filed a Grievance due to a management interpretation of vacation cash-in policy. Management had previously explained the interpretation of the policy during contract negotiations and the Union did not dispute the interpretation and confirmed that discussion during Step 2 of the Grievance procedure. Management has offered to utilize the option to meet the employee half way to dispose of the Grievance and accept the previous interpretation. The Union Attorney has proposed a different, more liberal option which has been rejected by the Village and discussions continue. The most recent response from the Union Attorney has indicated some willingness to accept the Village's original offer. Police Chief Eddington left the Closed Session at 9:17 p.m. Land ACQuisition Village Manager Janonis provided a general summary of the activities and discussions to date regarding the acquisition of the remote parking lot currently owned by Bank One. He stated that legal interpretation regarding this purchase is impacted by the possibility of providing the parking in the deck at a reduced or no cost and the possible tax implications of such an arrangement. 2 I!!!!J @!l) @j r=!J 0 I!:'!!J ...
