Lowe Village of Mount Prospect 100 South Emerson Street Mount Prospect, Illinois 60056 MINUTES CLOSED SESSION September 18, 2001 The Closed Session was convened at 8:52 p.m. by Village Manager Janonis to discuss Litigation and Property Acquisition. Present were: Trustees Timothy Corcoran, Paul Hoefert, Richard Lohrstorfer, Michaele Skowron, Irvana Wilks and Michael Zade!. Absent from the Closed Session was Mayor Gerald Farley. Staff present included: Village Manager Michael Janonis, Assistant Village Manager David Strahl and Police Chief Richard Eddington. LitiQation Village Manager Janonis provided Village Board members with updates on both the Romero Class Action Lawsuit and the Department of Justice investigation. ..,~ Mr. Janonis related that the insurance companies were pushing for settlement and had set reservation letters that effectively limited their liability to what would be paid out under the pending Settlement Offer. If the case was litigated, and a larger award made, the Village would be responsible for the greater incremental amount. ~, ~ .... a. a........ Mr. Janonis and Chief Eddington reviewed the status of the Department of Justice investigation. Preliminary indications were that the Department of Justice was not finding the allegations made in Judge Castillo's letter to be founded. The Village's attorneys were engaging the Department of Justice in discussions regarding closing the investigation. Consensus of the Board was to continue pursuing the most favorable conclusion to both of these matters. Property Acquisition Manager Janonis stated that he is to meet with the people that own the medical building next to the Senior Center. He said the Village will offer about $600,000. The owners want approximately $700,00. The likely settlement is probably somewhere in between. Manager Janonis provided an update of the 3Com building purchase suggestion. He stated that in conversation with District 214, they have stated they are not interested in participating in utilizing any portion of the building at this time. Manager Janonis also stated the Bank One is not responding in a timely manner to numerous phone calls regarding what their status is but will to continue to follow up to see what is the direction. The Closed Session adjourned at 10:04 p.m. No action was taken.
