Mayor Farley called the Closed Session to order at 9:05 p.m., in the conference room of the Senior
Center. A roll call was taken. Present were: Trustees Paul Hoefert, Richard Lohrstorfer, Dennis Prikkel,
Michaele Skowron and Irvana Wilks. Absent from the Closed Session was Trustee Timothy Corcoran.
Staff present included: Village Manager Michael Janonis. The purpose of the Closed Session was to
discuss Litigation.
Litigation
Village Manager Michael Janonis briefed Board members on his initial meeting with the U. S.
Department of Justice who indicated that they had decided to open a formal investigation of the Police
Department based on claims of racial profiling. Mr. Janonis indicated that the meeting lasted about an
hour and was cordial. Representatives from the Justice Department explained the procedural steps in the
investigation and indicated that the Village could expect a rather voluminous request for documentation in
the next couple of weeks.
Mr. Janonis indicated he was accompanied at the meeting by Village Attorney Buzz Hill, Police Chief
Ron Pavlock and Special Counsel Terry Ekl. During the discussion, Village representatives pledged their
total cooperation with the investigation and provided information regarding the extensive statistical
analysis already undertaken by the Village. The Justice Department was pleased with the steps that the
village had already undertaken including the statistical analysis and implementation of six previously
announced initiatives.
Mr. Janonis indicated to Village Board members that he did not know how long the investigation would
take. He was instructed by Village Board members to provide regular updates regarding the status of the
investigation.
Mr. Janonis also provided a brief update regarding the Romero Class Action Suit. At this time, there was
little new activity to report. The Village's attorneys have had a few conversations with the plaintiffs
attorneys regarding procedural matters, however, no Court appearances were currently scheduled nor
had substantive discovery begun.
Mr. Janonis also provided the Village Board with a brief update of a potential lawsuit against the Police
Pension Fund and the Village for denial of a disability pension application by a former Police Officer. As
of this time, there have been preliminary discussions with the retired Officer's attorney but nothing had
been filed nor had there been recent conversation or demands made against the Police Pension Fund.
Mr. Janonis was directed to keep the Village Board informed regarding all of these pending matters.
There being no further business, the Closed Session adjourned at 9:25 p.m. on a Motion by Trustee
Hoefert and Seconded by Trustee Wilks.
