Janonis MINUTES CLOSED SESSION FEBRUARY 15, 2000 [PillJ[1,[1, OO~[1J~&@@ .lID&l?~ ..3 ..J....aJ> 10 The Closed Session was convened in the Senior Center Conference Room at 9:40 p.m. to discuss Litigation. Present were: Mayor Gerald L. Farley; Trustees Paul Hoefert, Richard Lohrstorfer, Dennis Prikkel, Michaele Skowron and Irvana Wilks. Absent from the Closed Session was Trustee Timothy Corcoran. Staff present included: Village Manager Michael Janonis and Village Attorney Everette Hill. Litigation Village Manager Michael Janonis provided Board members with an update on settlement discussions being conducted through the auspices of Judge Pallmeyer. Mr. Janonis indicated that there was little movement between the two parties. A considerable amount of time was spent educating the Judge about the intricacies of insurance coverage for all three of the pending cases. Village Attorney Everette Hill briefed Board members regarding discussions with the insurance company on the circumstances under which they would agree to extend coverage. The insurance company was trying to limit its overall exposure and, as such, was willing to make more money available for the settlement of all three pending cases than they would if the Village continued to pursue a full defense of same. Village Attorney Everette Hill reviewed with Board members the recent filing of the Class Action Lawsuit. He covered the mechanics of a Class Action and there was considerable discussion regarding how defense of the case would be conducted. Village Manager Janonis apprised the Board that it was the consensus of opinion among the team of lawyers that a full-blown independent investigation was not necessary at the present time. It was noted that depending the circumstances surrounding the Department of Justice inquiry and proceedings in the Class Action Suit, the Village Board might find it in the best interest of the Village to call for an independent investigation at a future time. Village Board members directed the Village Attorney and Manager to keep them closely apprised of any continuing developments in the proceedings.
