Lowe MINUTES CLOSED SESSION JANUARY 11, 2000 ..,;; ~OJJ[1[b ~~~~&@[g .IID&'IT~ .~-~-aoI.O The Closed Session was convened to discuss Litigation and Personnel at 8:38 p.m. Present were: Mayor Gerald Farley, Trustees Paul Hoefert, Richard Lohrstorfer, Michaele Skowron and Irvana Wilks. Trustee Corcoran arrived at 9:04 p.m. Staff present included: Village Manager Michael Janonis and Assistant Village Manager David Strahl. Litigation Village Manager Janonis stated that the Village Board will likely see an article in the Daily Herald on January 12 regarding the Martinez Case. He also provided a copy of an article from the Chicago Tribune dated January 11 regarding the Martinez Case. He stated the first day of the trial was not that good because all the evidence has been included even though objections have been made in each instance. The fact that all the irrelevant information has been included has significantly strengthened the Case at the Appeal level. The Judge has more or less ignored the rules of evidence in this case. The second day of the trial, January 11, was better and Martinez's testimony was rather poor. Another witness for the Plaintiff, Jose Garcia, basically stated that any information he provided during the deposition is incorrect. Village Manager Janonis wanted to advise the Board of the status of the trial to date and stated that he will regularly inform the Board of any significant events relating to the trial during the trial process. Mr. Janonis briefed the Board regarding the latest activities of Richard Hendricks. He provided a draft letter from the Village Attorney putting Mr. Hendricks on notice about impersonating a public official. Consensus of the Village Board was to send the letter from the Village Attorney with a revision citing him if necessary by pointing to the violation of impersonating a public official. ~~ ~~ &ill~ &5 ",) c::!J~ c::!J[? 2)~ ~@) Personnel Village Manager Janonis provided copies of newspaper articles regarding former Trustee Nocchi's resignation. A copy of a Resolution acknowledging his service is also included for consideration. General comments from the Village Board members included the following items: There was some concern regarding the timing of the articles in the newspapers and a concern that the papers seemed to have known when the report was to be released. Apparently, a broadcast e-mail was sent to the area newspapers announcing the Police Report availability. Consensus of the Village Board was to consider a Resolution acknowledging Mr. Nocci's service to the Village at a later time once the pending Court proceedings are completed. Mayor Farley stated that his consideration and review of a possible replacement for Mr. Nocchi are down to two individuals and he has yet to decide which one should be appointed. He expects to continue to ponder this the rest of the week and hopefully will advise the Board members of his choice in the near future. Motion was made to adjourn the Closed Session by Trustee Corcoran and Seconded by Trustee Skowron. The vote was unanimous.
