Village of Mount Prospect 100 South Emerson Street Mount Prospect, Illinois 60056 MINUTES CLOSED SESSION OCTOBER 1, 1996 Phone: 708 / 392-6000 Fax: 708 / 392-6022 TOO: 708 / 392-6064 NEW AREA CODE 847 The Closed Session was called to order at 11 :01 p.m., in the conference room of the Senior Citizens' Center, 50 South Emerson Street, for the purpose of discussing Litigation. Present at the Closed Session were: Mayor Gerald L. Farley; Trustees George Clowes, Timothy Corcoran, Richard Hendricks, Paul Hoefert, Michaele Skowron and Irvana Wilks. Also present were: Village Manager Michael Janonis and Assistant Village Manager David Strahl. Litigation Village Manager Michael Janonis indicated that he wanted to bring the Village Board up to speed on a number of cases which were currently pending. Mr. Janonis indicated that the Fitzgibbons case which involved the death of a prisoner which in custody at Cook County Jail was being handled by Elizabeth Knight. Ms. Knight had sought and had been successful in moving the Case from the County Circuit Court to the Federal Court. She had indicated that she had much better experience in the Federal venue with these types of cases. At this point, Ms. Knight felt that the Village's position was strong. Mr. Janonis indicated that the Village had recently received notification that a Federal Court Claim for Discrimination had been filed by a former probationary Police Officer, Javier Martinez. Mr. Janonis indicated that this former employee had previously filed a claim with the State Equal Employment office which claim resulted in an inconclusive finding as to whether there was discrimination. Mr. Janonis indicated that Ms. Knight would also be handling this case and would be working with the Police Department to develop the particulars. Mr. Janonis briefed Board members on the ongoing case of Monti vs. Neubauer which ~ involved certain Addison Court properties. As part of this ongoing Suit, the Village had a made a settlement offer to participate in the construction of certain storm sewer Q. .tI t.. .~ improvements if the property owners agreed to annex to the Village. The Village Board stated its unanimous position that no settlement would be agreed to without annexation of these properties. o ~~ f::'i!J~ ~~ ~"J ,~" [~ c--: :-:::J d ~-:21 ~@ Mr. Janonis indicated that Discovery in the RJN Case was continuing. A number of Trustees had already been deposed and others were currently in the process of being scheduled. No further information was available on this case. There was no other business discussed in Closed Session and on a Motion by Trustee Hendricks and Seconded by Trustee Hoefert with a unanimous roll call vote, the Closed Session was adjourned at 11: 18 p. m.; thereupon the Village Board immediately reconvened the Village Board meeting.
