MINUTES
CLOSED SESSION
MAY 23, 1995
The Closed Session was called to order at 10:03 p.m., in the conference room of the
Senior Citizens' Center, 50 South Emerson Street, for the purpose of discussing
Personnel and Litigation. Present at the Closed Session were: Mayor Gerald Farley;
Trustees Timothy Corcoran, Richard Hendricks, Paul Hoefert and Irvana Wilks. Absent
from the Closed Session were Trustees George Clowes and Michaele Skowron. Also
present were: Village Manager Michael Janonis and Assistant Village Manager David
Strahl.
Personnel
The Village Manager provided an update to Board members regarding the ongoing Police
Union negotiations. Mr. Janonis indicated that there were only a few major outstanding
issues that dealt with wages and proposed changes to the health insurance plan.
However, there has been no movement in the last couple of bargaining sessions. A joint
request has been made for arbitration. Mr. Janonis indicated that while arbitration may
be an inevitable result, he was fairly confident that meaningful discussions would continue
and that an amicable settlement could be reached.
Board members concurred with the progress of negotiations and directed staff to proceed
as necessary.
Litigation

Mr. Janonis reviewed with Board members an ongoing lawsuit regarding damages
associated with flooding along Addison Court at the very southern end of the Village.
This property was once part of the Village's forced annexation of the South Busse Road
area. Subsequently, the property was disconnected from the Village. During the brief
period of annexation, the Village was joined in a 1982 lawsuit regarding the flooding and
alleged damage. The Village has been unable to convince the Judge that it should be
dismissed from the Suit.

In an effort to settle the case, the Village has offered to contribute monies toward a
resolution of the flooding problem with the condition that the Addison Court property
owners voluntarily annex into the Village. Mr. Janonis indicated that the property owners
were in the process of circulating a Petition for Voluntary Annexation and that as soon
as one is received, the Annexation process would begin. Upon completion of the
Annexation process, the underlying lawsuit would be settled.
Village Board members indicated approval of the strategy and directed staff to continue
with settlement talks.
There was no further discussion and the Closed Session adjourned at 10:23 p.m.
