Judiciary Committee reports they have been unable To find Baughman's report on Brickman proposals and requests Baughman's report item be removed from matters pending in Judiciary Committee. Approval granted. Judiciary Committee reports that Citizens Utility Rate Increase is presently being handled by the Village At- Citizens Utility torney and requests that the item be removed from matters Rate increase pendin~ in the Judiciary Con, mi:tee. Judiciary Committee mecommends re Zoning Case 65-19 heard July 30, 1965 relative to rezoning from R-1 to R-~ Lot 17 at 55-19 re Lot 17 Southeas~ corner of Wes:gate Road and Meadow Lane to concur SE cot. Wes:gate Rd with Zoning Board of Appeals and grant rezoning providing peri- :toner complies with conditions,outlined in report bY Committee as follows: 1. Fur~ish the Village with a letter from a registered engineer stating and affirming that there is sufficient capacity regarding water supply and sewage facilities available from the Mt. Prospect Plaza connections for the petitioner's proposed 112 unit apartment development and any other proposed uses in the vacant property south of the subject Lot ~17 and the existing buildings of the Plaza Shopping Con:em. September 14, 1965 . The petitioner agrees that he will use Mt. Prospect sewers and water and that no building permits will be issued until he has tied into said facilities. Conditions re Lot 17 SE cot. 3. The legal right to make connections as outlined in No. 1 Westga~e Rd. above. ~. Paving with approved construction (by Village Engineer), including curbs and gutters~ along the Meadow Lane and West- gate Road sides of the subject property. It is recommended further that the petitioner place in escrow a sufficient amount of funds to guarantee the acceptable ~mprove~en= of these two abutting streets. S. Written approval from the Mt. Prospect Fire Department as to the adequacy of egress and ingress to the interior apart- ment buildings and the adequacy of egress and ingress to the proposed development from Central Road via Westgate Road, the only existin$ entry and exit to the subject property. 6. Westgate Road from subject property to Central Road: The Zoning BOard feels that the entire case hinges on what happens to Westgate Road. Further, we feel that the future success or failure of the proposed apartment development depends on a completely adequate improvement of Westgate ROad from Meadow Lane to Central Road. Therefore, our recom- mendation will be based upon the following conditions concern- ing Westgate Road:~ a. A complete and unconditional dedication of all lands involved in the ~0-foot right-of-way from Meadow Lane south to Central Road, by all owners involved in this roadway (i. e. the Petitioner, National Shopping Centers, Serafine, et al.) b. Improvement of Westgate Road from Meadow Lane to Central Road with curbs and gutters with con- struction in'accordance with Village standards, approved by the Village Engineer. Cost of the improvement to be' resolved by the various owners, the Village, the County or Township and the Vil- lage Engineer, .by contributions'from the owners, or by specia~ assessment or by some means accept- able to the ,Village of Mt. Prospect and 'the others involved. c. All monies needed for the acceptable improvement of Westgate Road, as stated above in (b), to be placed in escrow with the Village to guarantee the complete and'acceptable improvement of Westgate Road.- - Trustee Bex~en moved ~o grant rezoning subject to six conditions so stated,and to adviseattorneyto prepare an ordinance for annexation and rezoning and notify petitioner of said action. Articlesof Agreement follow: ARTICLES 0F AGREEMENT ARTICLES OF AGREEMENT made and entered into this Art. of Agree. llth day of September, A. D. 1965 by and between THE MOUNT PROSPECT RURAL FIRE PROTECTION DISTRICT, a municipal corpora- tion, Wheeling Township, Cook County, Illinois (hereinafter referred to as the "Firs~ Party") and the Village of Mount Prospect, a municipal corporation, Wheelings Township, Cook County, Illinois (hereinafter-referred to as "Second Party")~ WHEREAS the First Pa~ty and the Second Party are municipal corporations organized under the respective statutes in such case made and provided; and WHEREAS the First Party is desirous of obtaining a contract from the Second Party for' the purposes of providing fire protection and fire prevention services to that certain territory outlined in red on Exhibit A attached hereto (which area so outlined Co~sti~utesthdentire and only area to be -- serviced by the Second Party for the First Party) and WHEREAs %he Second Party is willing to enter into a con~ract with the First Party to supply such services to said a~ea; NOW, THEREFORE, IT IS AGREED AND UNDERSTOOD BY AND BETWEEN THE FIRST PARTY AND THE SECOND PARTY AS FOLLOWS: ARTICLE 1: That for the period beginning January A.D. 1965 at 00:01 A.M. of said day, and expiring December 31, 1966 at 12:00 midnight of said day the Second Party shall fur- nish all fire fighting, fire protection, fire prevention and emergency services by such volunteer and/or paid on call or regular firemen avaiAable to the Second Party, as the Fire Chief of the Second Party shalldetermine, to the First Party for said area outlined *in red on Exhibit A attached hereto. ARTICLE II: That for the period of time durin~ which these Articles shall be in full force and effect First Party agrees ~o pay to, and the Second Party agrees to accept as full payment for said fire fighting, fire protection and fire preven- tion services and emergency services the sum of TEN THOUSAND FIVE HUNDRED and NO/100 ($10,500.00) DOLLARS, payment of such sum shall be made in the manner following, to-wit: A. The sum of one hundred dollars upon the execu=ion and delivex~y of the within Articles; and B. The sum of $1,500.00 upon or before February 1966; and C. The sum of $1,500.00 on or before May 1, 1956; and D=The sum of $3,700.00 on or before August 1, and September lq, 1965 24 3 E: The sum of $3,700.00 on or before November 1, 1966 the same being the final installment paymen~ due dereunder. Art of prescribe the manner and method of giving the alarm for fiz-e Agree. or other emergency in the terrzt ry to be serviced by the Second Party for the First Party; ARTICLE'IV: That the Fire Chief designated by said second pa~ty shall immediately upon arriving at thescene of any alaxtn or emergency (or such other officers as may be desig- nated by said Second Party) have the sold and exclusive author- ity and responsibility to direct and control any and all fire fighting, fire protection, fire prevention and emergency opera- tions carried on at such scene or scenes, and further, that any officers and/or firemen appointed by the First Party shall be subject to the order and direction of the Fire Chief designated by the Second Party. ARTICLE V: That all fire fighting, fire protection, fire prevention and emergency procedures conducted under the provisions of these Articles shall be under and in accordance with the regulations and ordinances, if any, of the Second Party. ARTICLE VI: THAT all expense of maintaining equipment, apparatus, salaries, insurance premiums, and any and all other items of expense connected with the several services to be sup- plied by the Second Party to the First Party shall be supplied at the sole expense of the Second Party and that the only ex- pense falling upon the First Party shall be the payments scheduled to be made he~einabove in Article II. IN WITNESS WHEREOF the Parties hereto have caused these Articles to be executed by their respective officers and affixed hereunto their respective corporate seals. These Articles have been executed on behalf of the Second Party pursuant to adoption thereof by a resolution of the executive body of said Second Party on the day of A.D. 19 Trustee Grittani moved to ratify Articles of Agreement setting amount of $10,500.00 for the year 1966, and instructing President to sign and Clerk to attest. Trustee Colfer moved for passage of Ordinance 1085: Ord. 1085 Penalties for PROVIDING PENALTIES FOR NON-PAYMENT OF WATER RATES non-pmt, of water rates directing Village President to sign and Clerk to attest, and ordi- nance be published as demanded by law. Trustee Grittani seconded the motion. Upon roll call: Ayes: Bergen Bruhl Colfer Ekren Grittani Teichert Motion carried. September 14, 1965 244 The matter of enforcement of Ord. 1085, above, Ord. 1085 contd, was ~eferred to the Public Works commiT%ee for study and recommendation. Trustee Colfer presented ano~dinance for a first reading, imposing a fee of $5 for the use of Village water $5 water use fee by conzracTors during construction. Village Clerk directed construction =o schedule for second ~eadiRg.
