Trustee Teichert, seconded by Trustee Bergen, moved minutes for approval of the minutes of May ~ as corrected. Trustee Collar, seconded by Trustee Ekren, moved that Mr. Wayne Kruse he granted s variation tobuild a masonry and Bldg. brick addition, approximately 38 x 16 ft., to the present struc- ture at 100 E. Prospect Ave., provided his building plans mee~ all other ordinances and specifications of the Village, includ- ing a fire exit. TrusTee Colfer, seconded by Trustee Bergen, moved that Bldg. the Village Attorney be requested to present a selection of ordi- nances revising the present building and zoning ordinances to in- clude an amortization clause for non-conforming buildings, in order to help achieve an orderly and constructive rejuvenation of the downtown area; proposed ordinances to be submitted to the Building Committee. Trustee Bruhl demurred, giving The opinion That There is too little open space left without buildings on itt and that this k' area can be used for recreation, school, etc.; and as lng That the clause "at this time" be added, thus not entirely closing The door on The question. Zoning Case Trustee Bergen reported from The Judiciary Committee re: 6g-19 Wilie Lurer Co., Zoning Case 6~-19, heard June 26, Request To rezone from I-1 To B-3; Three lots, #10, 11 and 12, fronting on Northwest Highway, east of Pine STreet. May 11, 1965 May 11, 1965 oning Board of Appeals Recommendation: Zoning Case 1) A variation of the existing zoning on Lots 10 and 64-19 11 was recommended by a vote of 5-0, subject To Wille Lumber The following conditions: a) that no materials be stored in the display garages on property. b) that all I-1 restrictions be complied with (this includes fencing for outside storage of materials). 2) Allow rezoning to P-l, off-street parking~ of Lot 12. Judiciary Committee Comments and Recommendationst The history of This Zoning Case dates back to The spring of 1963, at which time the Village Board of T~usteas granted The petitioner a temporary'variation To erect display garages. The.garages were to be Torn down in December of 1963. The garages were not torn down and when the petitioner was requested ~o do so, The rezoning petition was initiated. The Zoning Board of Appeals explained t~ the petitioner that the B-3 request would not accomplish his aims and as a result, the petitioner was agreeable to any suggest£ons offered by the Zoning Board. This is The reason for the Zoning Board's recommendations not being in accord with the petitioner's quest~ The petitioner was advised by letter of the Zoning Board's recommendations on July 6, 196q. To date the petitioner has not complied with the I-1 restrictions aa called for in the Village's zoning ordinance. The Committee unanimously recommends ghat The Board of Trustees does not concur with the recommendations of the Zoning Board and That The Village take the necessary steps to require the petitioner to comply with The I-1 zoning requirements. In addition, the pet£tioner is to be again advised that the Temporary variation has expired and that the garages are to be removed from The I-1 zoned property. Trustee Bergen, seconded by TruSTee Teiche~, moved that The Board not concur with the recommendations of The Zoning Board and that the Building Superintendent contact Wille Lumber Company and quire that firm to remove all illegal buildings now on the property by May 31st. MaV 11, 1965 ewspaper of Record Trustee Bergen asked that Res. 38-63, which equalizes funds spent on.legal notices in two newspapers, be repealed. Trustee Bruhl, seconded by Trustee Ekren, moved that this mat- ter be tabled; this matter was deferred to the next regular Board meeting. Trustee Bergen, seconded by Trustee Teichert, moved that any notice from the Village required by law to be pub- lished in a newspaper be published in the Mount Prospect Herald. May 11, 1965 Gentlemen: The plan Commission recommends that the accompanying plat of Sunset West Subdivision be approved by the Village Board. County Zoning Trustee Bergen referred %o notice received from the Cook County Zoning Board, Docket 892, asking for rezoning from R-~ single family to R-6 for efficiency apartments on property along Algonquin Road just east of Wilke Road. Trustee Bergen, seconded by TrUstee Bruhl, moved to direct the Village Attorney to appear at this hearing in the Mount Prospect Village Hall on May 28 at 5:00 P.M. in order to object, provided this property is within 1-1/2 miles of the Village limits. Bldg. - Trustee Bergen reported that the Village Attorney had Di Mucci filed complaint against Di Nucci Builders that morningfor an injunction to prevent f~rther workuntil Village ordinances re- quiring proper bonds have been complied with. Plan Commission Trustee Telchert, seconded by Trustee Bergen, moved to Chairman-.Norris concur with the appointment of Pres. Upon roll call: Ayes: C01fer Grittani Ekren Bergen Teichert Bruhl Motion carried. Police Pension Board Trustee Teichert, seconded by Trustee Bruhl, moved W. Kirchhoff To concur with Pres. Congreve's appointment of Walter Kirchhoff to the Police Pension Board (2-year term). Upon roll call: Ayes: Colfer Grittani Ekren Bergen Teichert Bruhl Motion carried. Board of Health President Congreve stated that the terms of the members of the members Board of Health were for 1, 2, 3, 4 and 5 years each~ that terms had not been assigned to the members, and asked the Street and Public Safety Committee to meet with This body to recommend the number of years to be served by each member. President Congreve read memo from Village Manager Public Works Dept. Appleby as follows: May 7, 1955 Subject: Public Works Director Now that both the Street and Water Departments are physically located in one building, in order to make the best use of the manpower and equipment of the departments, I recom- mend that they be plaoed under the direction of one person. In addition to improving the oPeratioh this will reduce the number of people reporting directly to me. I recommend that the position of Superintendent of Public Works be established by an amendment to the municipal code. Further, that because there is yet no budgetary provi- sion for this Position, that authority be granted to include this position in the 1965-65 budget and'to hire a qualified can- didate as soon as possible. May 11, 1965 Referred to Water Committee: Estimate of cost for Well 10 cleaning and acidizing the well in the Bluett section (Well 10) and for overhauling the pump before the heavy wa~er-use season; to be reported May 25th. Trustee Bruhl, seconded by Trustee Bergen, moved that Trees the Village Manager be authorized to spend up to $3000 for tree replacement for parkway trees. President Congreve asked the Board to agree to use Water the meeting night of May 1Bth for a meeting of the Board as a whole, with the public invited, to meet with the members of the firm of Greeley ~ Hansen to discuss the current water situation. Trustee Bruhl, seconded by Trustee Bergen, moved to approve this request of the President, and the motion carried by acclamation. Trustee Teibhert referred to motion made on April 16th Sewage - asking the Village Attorney to investigate the possibility of Weller Creek an injunction against the Village of Arlington Heights regarding dumping of sewage into Weller Creek, and moved, seconded by Trustee Bergen, to withdraw this problem from the jurisdiction of the Attorney and place it in the Water Committee. This motion carried by acclamation. Trustee Grittani, again brought up the Klein property, Klein property and moved, seconded by Trustee Bergen, that this question be dropped from its position on the Finance Committee list, and that it be left as R-1 zoning for now. Attorney Siegel told the Board that he cannot represent the Village in the Klein case because of his previous connection with this firm as their representative. Upon roll call: Ayes: Grittani Teichert Colfer Ekren Bruhl Bergen Motion carried. Trustee Bruhl suggested asking the advice of one Robert Deucette, attorney and Mt. Prospect resident residing in the WeGo Park area, who is familiar with the Klein case, regaling the selection of an attorney fo~ the case. President Congreve promised he would speak to Mr. Doucette. Mr. Appleby reminded the Board that June first is the Weller Creek last day for introduction of bills to the State Senate, and asked if the Board desired to re-introduce the Weller Creek bill, which has been pushed by the Village for some time now. Trustee Bruhl stated that he would like to set every third Thursday as Water Committee meeting night, but though that perhaps Mr. Appleby could integrate the meeting times of the Com- mittees. May 11, 1965 idewalk Mr. George Reiter of 207 S, Weller Lane arose and read letter from Mr. and Mrs. A. G. Damko of 115 S. Weller' Sane, who complained ~ lack of corner sidewalk and muddy park- way at the corner, sending along a colored snapshot. Trustee Bruhl, seconded by'Trustee Grittani, moved to install parkway sidewalk at this site. Upon roll call: Ayes: Bruhl Bergen Ekren Grittani Colfer Teichert Motion carried. Golfhurst Mr. Wm. Rinehart, president of Golfhurst Civic Asso- ciation, asked that the Village inform him of any proposed zoning along Mount Prospect Road~ and suggested that Des Plaines and Mt.. Prospect exchange zoning agendas on those properties near each other's boundaries. Streets ' Referred to Street Committee: Parkways on ~est Lincoln and EastEvergreen, complaints of sunken turf. Complaints of Mrs. Celia Quinne!l of East Evergreen and Luther Joseph on West Lincoln. Mr. Joseph complained that promised resodding in front of his house had never been done; Engineer Hemmeter replied that arrangements had been made for completion of this by June 5 or 10.
