Ord #2034 JUDICIARY COMM±'I'±'~ REPORT Ill Bell Trustee Rogers, seconded by Trustee Teichert, moved to waive the rules for Fmending two readings regarding a tentative ordinance with Illinois Bell Telephone Ord. 984 Co. The voice vote was unanimous with the exception of Trustee Colfer, who abstained because of a conflict of interest. Trustee Lewis, seconded by Trustee Teichert, moved for passage of Ordinance #2034 after reading AN OFOINANCE AMENDING ORDINANCE NUMBER 984 GRANTING TO THE ILLINOIS BMLL TELEPHONE COMPANY, ITS LESSEES, SUCCESSORS AND ASSIGNS, ~CEETAIN RIGHTS IN THE VILLAGE OF MOUNT PROSPECT, COOK cOUNTY, YLLINOIS Upon roll call: Ayes: Grittani Kilroy Lewis Rogers Teichert Abstained: Colfer Motion carried. 67-18P CASE 67-18P Mobil 0il Company request for approval of a proposed sub- Mobil 0il division of property located at the S.E, corner of RTe. 83 and Kensington Plat_ Road. (property commonly known as Gunnell's) The proposal is to purchase the property, subdivide it into 2 lots, raze Gtmmell's Restaurant and erect a filling station, and temporarily, at least, leave the bowling alley, now attached to the restaurant, intact. Plan Commission recommended approval of the petition. The Judiciary Committee found the proposed subdivision plat did not provide for a minin~zm 8' easement at the rear of the proposed lots, as called for under Article 2, Sec. 6 of the Village of Mount Prospect Village Plan Ordinance. Neither did the plat drawing show the minimum 20 ft. setbacks as also required by the same ordinance. Beuause of these discrepancies, it is the recommendation of the Judiciary Committee, by a vote of 3-0, that the Board order the case b~hW to the Plan Commission and that the case be dropped from the Committee charge. Trustee Lewis, seconded by Trustee Colfer, moved to concur with the Judiciary Conndttee and the matter be referred back to the Plan Cmmmission. Unsnimous o CASE 67-9A Petition of Alvin Spielman for special use variation (I-2 67-9~ property) to establish a drop-off and pick-up sub-station for dry cleaning Spie]~n and shirt laundering in the southeasterly portion of the Chicago and North western Railway Depot. The Railroad with the consent of the peitioners, inserted a 30-day cancellation clause in Mr. Spielman's lease. If the establishment of the dry-cleaning and shirt laundering sub-station operation does cause an increase in traffic congestion in the area surrounding the station, Mr. Spielman's lease would be cancelled upon a 30-day's notice. The only requirement for cancellation would be a recomuendation by the Chief of Police to the Village Board requesting the lease be terminated and the petitioner would con~oly. A letter from the railroad, consenting to this cancellation has been submitted to the Board. Trustee Grittani voiced the opinion that this would conm~rcialize the suburban railroad station. Trustee Lewis moved the Board concur with the recormmendation of the Board of Appeals and Judiciary Con~mittee and grant a variation to the petitioner, subject to the letter from the Chicago and North Western Railroad. Trustee Colfer seconded the motion. Trustee Teichert questioned whether it is good to have business in the railroad right-of-way or station and the selection of the business, as well as granting a special_ use for an individual coming into the community. The Public Works Conm~ittee recommended that Lundstrom's Nursery be awarded the contract for the purchase of 50 green ash at $34.00 each or a total of $1,700. 50 Norway Maples at $38.50 each or a total of $1,925.00, 50 pin oak at $38.00 each or a total of $1,900.00, or a grand total of $5,525.00, which figure does not exceed the budgeted amount. Trustee Rogers moved to concur witht the recommendation of the Public Works Con~nittee to award the contract to Lundstrom November 7, 1967 Nursery in the amount of $5,525.00. Salt Bids The Public Works Committee reviewed salt bids and based on the fact that five cor~panies bid the exact price of $12.80 per ton, numbers for each company were placed on a slip of paper and a drawing was conducted wherein Inter- national Salt Co. was drawn as the sucessful bidder. The Con~nittee recommends the contract for rock salt be awarded to International Salt Company at a price of $12.80 per ton, with an estimated usage of 550 tons, this being within the budgeted amuunt. Well #11 Bids%he Public Works Cmmmittee reviewed bids for Well #11, Improvements Division T~revement II, Pumping Equimpent: 'J. P. Miller Artesian Well Co. $41,195.00 Layne-Western Company 42,840.00 Wehling Well Works 43,795.00 Consoer, Townsent & Associates, the consulting engineer for this project, recommended that J. P. Miller be awarded the contract on Section A in the amoant of $41~195. and the Public Works cc~amittee concurred. Tpustee Rogers, seconded by Trustee Colfer, moved for awarding of the contract on Section A Section A to J. P. Miller Artesian Well Co. in the amount of $41,195~00. The estimate by Consoer, Townsend ~ Associates was considerably lower than the bid by $12,195.00. At this point in the meeting Trustee Kilroy left because of an emergency. The Public Works Cormnittee received information from the Public Works Well //3 Director that the bid prices submitted by Layne-Western for the repair of repair bids Well #3 would still be honored by Layne-Western at this time. The 1967-68 fiscal budget had set aside son~ $52,000 for extraordinary well repairs. To date, the repairs charged to this accoUnt have accumulated to the sum of $33,120.69. The Public Works Cor~ittee recon~nends that the contract be awarded to Leyne-Westem for the repair work &t Well #3, not to exceed a total sum of $18,000, based on Unit price as submitted. Radio Tower approximately 200 ft. in height. tower The Board denied the variation request by a 5 to 1 vote. The members 67-55A felt that the overlay into traffic arteries, the existance of power lines in the area (both contrary to BOCA) as well as the lack'of ground anchors on the guylines would be detremental to the public welfare, this matter, the decision of the Board of Appeals is final. For purposes of consideration, the sign on Village property was not considered a part of the petition.
