Trustee Reiter, seconded by Trustee Sodenr~n, moved the minutes be approved as corrected. Under discussion~ Trustee Aher~ stated on pg. 2~ he passed his vote regarding Fairview Gardens. Trustee Reiter, seconded by Trustee L~oderman~ moved to ~mend the previous motion to include the correctic~ 'c~ pg. 2. Resolution COF~4UNI C~ATIONS, PETITIONS 3~-69 A resolution was presented seeking permission from the State of Illinois to perform work on State rights-of-way within the Village for the calendar year 1950. Trustee Furst~ seconded by Trustee Norris, moved for passage and approval of Resolution No. 3~-69. COF~IT~'~ C~AIR~EN ~PORTS BUILDING COMMI'I'I'~E Trustee Soderman requested "Liquor license application - Wayne Ashej" be removed from his charge sheet and correctly placed under Finance Conm~ittee~ JUDICIARY CCMMI'I'I'~ Century Tile Century Tile - Case 69-19P - ~zone from R-1 to B-3 property Case 69-19P on Rand, Thayer and Louis Streets. Trustee Soderman read the repor~ of the Judiciary Committee which reviewed this matter on November 13, 1969. It was the recormuendation of the Judiciary Cor~kittee that the petitioner's reques~ for rezoning be granted. Trustee Soderman, seconded by Trustee Ahem, moved to concur in the recommendation of the Judiciary Coramittee to rezone the subject property from R-1 to 5-3. December 2, 1969 Several objectors appeared before the Board and were given anCentury Tile opportunity to be heard. Attorney Kendall Crooks represented Case 69-19P some of the residents in the area. Mr. Louis Velasco, 202 N. Lo~is, reed a prepared statement in opposition to the proposed rezoning. Others who were present to object to the proposed rezoning were Nr. James Darby, 206 N. Louis, Mr. Wa~ter Jeske, 10? N. Louis, Mr. Wesa, 109 N. L~uis, Mr. Marvin Metge, attorney, appeared to represent his client, Mr. Frank Parks, petition for rezoning of Century Tile. Mr, Parks assured the Board tb~t he would put up a performance ~ond to guarantee the conditions requested. Mr. Norris stated zoning along Rand Road should be reviewed by the Plan Con--~ission. President Teichert called for the vote. Upon roll call: Ayes: Ahem Furst Kilroy Sode~n Nays: Norris Reiter Written objections were filed by contiguous property owners, and the Village Attorney determined they were the proper p~rties, and more than 20% di~ object. The Zoning Ordinance of Mo~t Prospect, in Sec. 33, Sub Sec. I - Protest - provide~ for a favorable vote of 2/3 of all the members of the President aud Board of Trustees (which would require 5) for passage of an amendment. The Board recessed at 10:00 P. M. anM reconvened at 10:10 PM Roll Call: Present: Ahem Furst Kilroy Norris Reiter Soderman Upc~ reconvening the President stated he wo~tld consider the vote taken to be incomplete and cast his vote as nay, defeating the f'- vote for rezoning. (State statutes require a 2/3 vote of the i Trustees and the Chair ruled that the Village ordinance, being _ stricter than the State statutes, and pres~mably valid, control. There was no objection on the part of the Trustees as to the ruling of the Chair.) He called for recon~i~eratic~ of the motion for another vote but none was made. PUBLIC HEALTH AND F~i'f CO~i'i'r~g Trustee Furst reported his con~nittee considered the striping Striping of Will~ of Wille Street and because of the complexity of the problem Street it was decided to await the completion of the traffic survey. PUBLIC WORES Trustee Norris gave second reading to Ordinance #2205: Ordinance #2205 AN ORDINANCE ESTABLISHING ARTICLE XV OF CHAP]~R 5 OF THE MUNICIPAL COEE (Establishing Drainage and Clean Strea~ Co,~,.~ssion) Trustee Norris, seconded by Trustee Ah~rn, moved for passage and approval of Ordinance 2205. Trustee Ahem read the report of tm Public Works Committee '£alo's request regardi~ the review of Mrs. Carol Buffalo's request for side- walk replacement. It was the reccmmmmdatic~ of the Co~.~ttee to demy the request and the Board concreted. The Village Manmger was dfrected to advise M~s. Buffalo of the inaction of the Board. Trustee Norris requested the Village Manager or the I~ltc Works Director to inspect an alley onto West.Pro~ect between Wille and Pine because of its apparently unfinished cc~Elltion and to report on their ftndir~.
