Trustee Hendricks moved for approval of the minutes of August 6, 1974 be accepted as amended. Seconded by Trustee Caylor. Motion secon- ded by Trustee Richardson. Upon roll call: Ayes: Anderson, Caylor, Gustus, Hendricks, Richardson, Scholten Motion carried. COMMUNICATIONS AND PETITIONS Donald J. Burton, 1103 S. Hunt Club Drive, Apt. 125 and Gerry Del Giudlc, 1330 Mallard Lane, spokesmen for the Huntington Commons Homeowner Assn. presented petitions requesting the Village to take over Huntington Commons Road and Hunt Club Drive by formal acceptance. Page 1 Aug. 20, 1974 After discussion which raised the question of setting a pre- cedent in the acceptance of the streets in a planned unit ~de- velopment, the request was turned over to the Public Works Com- mittee for study and recommendation. William Stein, 1103 Hemlock Lane, objected To the handling of a ticket issued To him by the Mount Prospect Police Department. He was instructed by the Board to conzacz the Village Manager regarding the complaint. MANAGER'S REPORT A motion was made by Trustee Gustus and seconded by Trustee Richardson ro authorize accepta.nce~ of the bid of the Ritschel's Inc. (Slurry Seal) bid for resurfacing approximately five miles of streets au a cost of S38,260.68, as recommended by the Village Manager. Upon roll call: Ayes: Anderson, Caylor, Gustus, Hendricks, Richardson, Scholten Motion carried. Trustee Scholten moved To authorize the Village Manager to ac- cept the bid of Northside International Inc. for two truck cabs and chassis as specified for the amount of $2f ,228. The motion was seconded by Trustee Caylor. Upon roll call: Ayes: Anderson, Caylor, Gustus, Hendricks, Richardson, Scholten Motion carried. The Village Manager reproted on other projects underway in the Village. MAYOR'S REPORT Trustee Scholten moved that the Village be authorized to enter into a sales contract for purchase of the Mount Prospect State Bank main building and Data Processing Center for a total of $813,000, which includes all personalty, payable d~der contract terms over a ten year period at interest rate not to exceed per cent. Motion seconded by Trustee Hendricks. Upon roll call: Ayes: Anderson, Caylor, Gustus, Hendricks, Richardson, Scholten, Teichert Motion carried. COMMITTEE CHAIRMAN REPORTS BUILDING COMMITTEE Trustee Caylor moved, seconded by Trustee Scholten, that in view of change since earlier approval of variations, the Board now approve ZBA-16-V-74 (Dr. Smoron, 411 W. Prospect) with var- iations for parking space for each 200 square foot of gross floor area, overturning recommendations of the Zoning Board of Appeals. Former objectors agreed to the new variation request. Dr. Paul Heck, owner of adjacent property located at 435 W. Pros- pect Avenue requested and received clarification of a term used in the proposed ordinance. The ordinance variations will indicate 9' x 20' parking spaces instead of 10' x 20' (Section i-C, page 2). Page 2, Aug. 20, 1974 The ordinance will also be changed to read "AN ORDINANCE GRANT- ING A VARIATION FOR PROPERTY LOCATED AT 415 WEST PROSPECT. MT. PR2SPECT" instead of "NORTH PRCSPECT" as indicated. Discussion followed re~arding limitation of building height. Upon roll call: Ayes: Caylor, Gustus, Hendrlcks, Richardson, Scholten. Trustee Caylor moved, seconded by Trustee Anderson, that the Village Board concur with the Building Committee's recommenda- tion to override the Zoning Board of Appea~s recommendation and grant a variation To Ramon Muscato, 1807 Maya Lane, ZBA-27-V-7-. Sam Mouryeh, 1809 Maya objected sTaTing the garage variation as proposed might cause his property value To decrease, be s fire hazard and not conform to the neighborhood. Discussion followed regarding encroachment on Mouryeh's property. Upon roll call: Ayes: Anderson, Caylor, Gustus, Richardson, Scholten Nays: Hendricks Trustee Caylor moved, seconded by Trustee Anderson, for passage of Ordinance 2522: AN OR£INANCE AMENDING MAP 22-N OF THE ZONING ORDINANCE ( Change R-X Single Family Residential District to R-1 Single Family Residential District in the new- ly annexed Prospect Meadows) Upon roil call: Ayes: Anderson, Caylor, Gustus, Hendricks, Richardson, Scholten Motion carried. Trustee Caylor moved, seconded by Trustee Scholten that the Village Board concur with the recommendations of the Building Committee To relocate the Civic Event Sign from its present location To an area near the water Tower. (Case ZBA-31-V-74) Upon roll call: Ayes: Anderson, Caylor, Gustus, Hendricks, Richardson, Scholten Motion carried. Trustee Caylor moved, seconded by Trustee Scholten, that the Village Board concur with the Building Committee and Zoning Board of Appeals recommendations to approve the R-4 PUD on Case ZBA-17-Z-74 and ZBA-17-A-SU-74 (Ferlette Real- tors). Bernard Scola, 1825 and Ed Rhea~ 1829 Palm Drive onened a discussion of School District 59's "dilemma" Upon roll call: Ayes: Anderson, Caylor, Gustus, Eendricks, Richardson, Scholten Motion carried. Trustee Caylor stated Ca~e ZBA-20-V-74 regamding property at 101 W. Prospect must have legal notice republi~hed~ according to Village Attorney John Zimmermann and will be placed on the September 3 Board of Trustee agenda. PUBLIC WORKS Page B? OTHER BUSINESS Hiriam Hansen, representing Grac~' Lutheran Church, stated no plat was available for ~resentation but that ~ccording ~o a letter from Civil Engineering Surveyors Earl Smith & Associates the plat would be available in two weeks due to a delay in their schedule. Trustee Scholten moved to authorize the Mayor and Clerk to sz~n and a~test the plat of survey for Grace Lutheran Church Sub Division subject ~o approval of the Planning Commission. Motion was seconded by Trustee Richardson. Upon roll call: Ayes: Anderson, Caylor, Gustus, Hendricks, Richardson, Scholten Motion carried. Mr. Hansen was instructed to inform Planning Commission Chairman Malcolm Young that he wpuld appear at the Commission meeting on August 21. Trustee Richardeon moved, seconded by Trustee Scholten, to authorize the Village t¢ retain outside counsel, Marlin Smith, to defend and answer our cause in the cases in Circuit Court of Cook County Misc. No. 72-01, 72-38 and 73-27 in re- gard To tax levy objections. Upon roll call: Ayes: Anderson, Caylor, Gustus, Hendricks, Richardson, Scholten Motion carried. The letter and proposal of M & E Alstot, March & GuillQu, Inc. regarding a feasibility report of Citizens Utility Co. was re- ferred to the Finance Committee. Mayor Teichert announced the establishment of an informal meeting of the CommitTee of the Whole with members of the staff relative to long ~erm planning. The first meeting will be held Tuesday, Augusz 27, 1974 at 7:30 P.M. and the ropic of the meeting will be "Budget". Meetings will be held on the fourth TUesday of each month. The Mayor mentioned ~ benefit being sponsored ~y the Dover Inn for the wounded and children in Cyp~B$ to be held on Monday, August 26% The Mayor referred To the Village Manager ~ letter from merchants in the 900 block on Northwest Highway regarding consistent vandalism.
