ROLL CALL Present upon roll call: Anders6n Gustus Hendricks Link Richardson Scholten Teichert APPROVAL 0~ MINUTES OF THE APRIL 16, 1974 Corrections: P. 4 of minutes, grammatrical error under Mayor's report correct "was" to "were" and on P. 6 remove roll call vote following Public Works report, and in the second para- graph on same page change the word "both" to"accumulative". Trus~tee Link, seconded by Trustee Richardson, moved the minutes of April 16, 1974 ~be approved as corrected. Upon roll call: Ayes: Anderson Gustus Hendricks Link Richardson Scholten Motion carried. APPROVAL OF MINUTES OF APRIL 23, 1974 - Special Trustee Scholt~n, seconded by Trustee Gustus, moved the minutes be approved as submitted. Trustee Richardson, seconded by Trustee Hendrlcks, moved to ratify the action taken at the special meeting held April 23, 1974. Trustee Scholten, seconded by Trustee Richardson, moved for passage of Resolution 15-74: A RESOLUTION MAKING CERTAIN APPROPRIATION TRANSFERS WITHIN THE ANNUAL BUDGET ADOPTED FOR FISCAL 1973-74 Upon roll call: Ayes: Anderson Gustus Hendrlcks Link Richardson Scholten Motion carried. COMMUNICATIONS AND PETITIONS In the matter of the petition to annex territory to the Village of Mount Prospect, Illinois Case No. 74zCo 412 Judge Harry G. Comerford signed a Court Order submitting that the question of annexation be presented to the cor- porate authority of the Village of Mount Prospect for its agenda, wlth notice to be sBnt to the fire district and library district. The area to be considered is now in unincorporated Prospect Meadows. The Torchbearer's Chapter of the City of Hope is conducting a fund-raising carnival in MT. Prospect to be held May 29, 1974 to June 2, 1974 in the parking lot of Courtesy Home Center on Rand Rd. They requested waiver of the $250.00 license fees as wei1 as two concessions which will be run by the City of Hope (a food concession and a dump tank). Trustee Hendricks~ secnnded by Trustee Link, moved for waiver of the fees as requested with the exception of fees for out of pocket disbursements by the Village. Upon roll call: Ayes: Anderson Gustus Hendricks Link Richardson Scholten Motion carried. Mr. Michael Minton, 1207 W. Lonnquist, had a copy of a pro- posed ordinance re 1Lcensing of real estate 4evelopers - but because this ordinance was now a matter of litigation he stated it would not be appropriate to bring to tke Board at this time. A Rob Roy request for modification of their petition regarding the Rob Roy Country Club development was referred to the May 14th special meeting. The Mount Prospect Jaycees are holding a carnival at the Mount ~rospect Shopping Plaza June 12 through June 16, 1974 and requested waiver of the fees excluding the out of pocket expense of the Village. Trustee Scholten, seconded by Trustee Anderson, moved to waive the fees of the Mount Prospect Jaycees as requested. Mr. Norman Rud, 216 Audrey Court, appeared before the Board to request permission to have a mobil~ome ~laced on his property next to his residence which had been destroyed by fire on May 2nd. Trustee Hendricks, seconded by Trustee Richardson, moved to allow the placement of the trailer on the property at 216 Audrey Court for a period of four months as a tempomary measure ~mtil his home could be repaired, subject to ~he health regulations of the Village of Mount Prospect. MAY 7~ 1974 It was to be noted that Mr. Rud presented a letter signed by his neighbors stating there were ~o obj'ectors to this tem- porary arrangement. MANAGER'S REPORT The Village Manager reported on a proposed study on cost and engineering at Oakton STreet, and an ordinance granting a permit to the Metropolitan Sanitary District of Greater Chicago to construct a sanitary sewer on Oakton St. was read for first reading. It will be presented for a second reading at the next regular Board meeting May 21st. The Manager reported on a staff study of parking problems in and on the periphery of the Central Business District on both sides of the railroad tracks. It was his recommendation that the Board approve of parking adjacent to the post office on Evergreen Avenue; post office employee all-day parking on the north side of Prospect Avenue from Maple Street 4asr. The memorandum recommended a ban on parking on the north side in front of the dry cleaners and post office area, utilizing special signs, special curb ma~kings, and lane arrows. It was his opinio~ that the area should be for the sole use of the citizens driving up to the deposit boxes at the curb.. Secondly hesuggested changing the 2-hour parking on the south side of the street to 30 minute parking. Third, to restrlpe,since the present stalls are too narrow and the thermoplastic restriping done late last fall did not adhere properly. Trustee Hendricks, seconded by Trustee Richardson, moved to concur with the Manager's recommendations as outlined above. Upon roll call: Ayes: Anderson Gustus Hendricks Link Richardson Scholten Motion carried. The next study related to a petition from homeowners on Evergreen east of Owen regarding post office employee parking. It was recommended that 2-hour parking now in effect west of this block be extended an additional block to preclude this solid parking. Trustee Richardson, sqconded by Trustee Link, moved to authorize the Village Manager to post two-hour parking signs as recommended. Upon roll call: Ayes: Hendricks Link Richardson Teichert Nays: Anderson Gustus Scholten Motion carried. The third matter condsidered in this memorandum of M~y 3rd was Brospect Avenue. It was recommended that "No Parking" signs be posted on the north side of Prospedt Avenue from Maple Street no Mt. Prospect Rd. and when needeR right-of- way is secured, Prospect Avenue should be widened and repaved. 2ommurer parking possibilities can be studied au this time. Trustee Richardson, seconded by Trustee Link, moved to authorize the administration to post no parking signs on the north side of Prospect Avenue, but not to he installed until such time as the new parking facilities are available. MAY 7, 1974 The Village Manager requested permission to secure proposals from several qualified firms and make a specific recommenda- tion to the board within the next two months to consider the feasibility study of the possible acquisition of Citizens Utility's holdings in the northeastern area of Mt. Prospect. Trustee Scholten~ seconded by Trustee Richardson moved ro approve authorizing the Village Manager ro get proposals or estimates and costs for a feasibility study. Upon roll call: Ayes: Hendricks Link Richardson Scholten Nays: Anderson Gustus Motion carried~ The Roppolo Blemont-Noyes Subdivi~sion plat for property within a mile and one-half of the Village limits: Trustee Hendricks, seconded by Trustee Link, moved to authorize The Mayor and Clerk To sign and attest the Rop~olo Balmont-Noyes Subdivision plat subject to ~ contribution on the formulated Pate for Special Assessment ~70. Upon roll call: Ayes: Gustus Hendricks Link Richardson Scholten Nays: Anderson Motion carried. Trustee Kichardson, seconded by Trustee Link, moved for a waiver of the rules to bring in fromt of the board ratification of action ~n making a written offer to the owners of the Central School property. Upon roll call: Ayes: Anderson Gustus Hendrlcks Link Richardson Scholten --~ The Village Manager re~orted he had been offered a sum certain in the figure of S625,000. Trustee Gustus, seconded by Trustee Richardson, moved to ratify the action of the Village ManaEer and authorize the purchase. MAYOR'S REPORT Mayor ~Teichert proclaimed the week of May 6 through May 11 as Municipal Clerks Week in the Village of Mount Prospect. Trustee Hendricks commended the Village Manager and Finance Director for the work expended on the 1974-75 budget. Trustee Hendricks, seconded by Trustee Richardson, moved to waive the rules to consider a matter not in this section ov the agenda, regarding sldeyatRs on Central Rd. Upon roll call: Ayes: Anderson Gustus Hendricks Link Richardson Scholten ~ Motion carried. ~ i Trustee Hendrlcks, seconded by Trustee Richardson~ moved to authorize the Manager to expend approximately $3,500.00 for the installation of sidewalks between St. Emily's Church and the Mt. Prospect Shopping Plaza. Upon roll call: Ayes: Hendricks, Link Richardson Teichert Nays: Anderson Gustus Scholten Motion carried. MAY 7, 1974 Mayor Teichert resumed his report. The next item on the agenda was a matter of appointments. Mayor Teicher~ named Katheryn Anderson as a member ~f the USA'Mt. Prospect Bi-Centennial Committee and re?uested Board concurrence. Trustee SchoiTen~ seconded by Trustee Richardson moved to concur in the Mayor's appointment of Katheryn Anderson. Upon roll call: Ayes: Anderson Gustus Hendricks Link Richardson Scholten Motion carried. Mayor Telchert named Thomas Leo for re-appointmenT to the Fire and Police Commission for a full term to May t~ 1977, and requested Board concurrence. Trustee Richardson, seconded by Trustee Hendricks, moved to concur in the Mayor's appoint- ment ~f Thomas Leo. Upon roll call: Ayes: Anderson Gusmus Hendricks Link Richardson Scholten Motion carried. Mayor Teichert read with regret a letter Dated May 2~ 1974 from Trusmee Patrick J. Link advising of his resignation frsm the Village Board to be effective as of June 1~ 1974. COMMITTEE CHAIRMEN REPORTS BUILDING COMMITTEE The Case ZBA-11-v-7~ - Robert Norsk petition for variation of 10' to he built with 20' setback from We-Go ~Trail was considered. Attorney Cronin and Mrs. Audrey Cronin and Mr. Richard Burkhart~ 716 S. See-Gwun, appeared as objectors in this matter. The Cronin residence at 719 S. We-Go Trail is behind the Novak property and Mr. Cronin presented a letter from Jim Warriner, Vice President - General Sales Manager of Robert L. Nelson Real Estate stating it was his belief that the proposed variation in Case ZBA-11-V-74 could effedt the sade of theirfproperty but it would be difficult to appraise to just what extent it would be depreciated. The letter was submitted to the Clerk for filing. Mr. Bernard Lee, Attorney, representing the petitioners made drawings of the proposed setbacks and the easements which had been granted to the Crinlns. Trustee Richardson, seconded by Trustee Anderson~ moved that the Village Board concur in the recommendation of the Zoning Board of Appeals to grant the variation as requested by Mr. Novak in Case ZBA-11-V-74. RECESS The meeting was recessed at 11:45 PM and reconvened at 12:05 AM, Upon roll call: Anderson Gustus Hendricks Link Richardson $cholten Teichert FINANCE COMMITTEE REQUEST Trustee Scholten reported on the Finance Committee Meeting held April 15th~ at which time liquor li%ense requests from the Randhurst Corned Beef. Center, Inc. requested a Class R license. The committee a~dvised the petitioner they would look more favorably on a Cla'ss N license. This matter will be considered further. MAY 7, 1974 The Finance CommitTee received a request for a beer and wine package license aT the Convenient Food Store, 1760 W. Algonquin Road, but the committee felt the creation Df such a class- ification would set a ~recedent and recommeded denial of the petition. Trustee Scholten, seconded by Trustee Gustus~ moved To concur with the recommendation of the Finance Committee and deny the petition To Convenient Food Store. Upon roll call: Ayes: Anderson Gustus Hendricks Link Richardson Scholten Motion carried. The Committee reviewed a draft of a new wheel tax.ordinance. The attorney is making the necessary changes and will present the updated ordinance at the next Committee meeting on M~y 20. PUBLIC HEALTH AND SAFETY COMMITTEE The Committee discussed proposed new street light installation for the newly annexed area in northeast Mount Prospect, amount- ing To approximately 100 lights. No action will be taken at this rime. PUBLIC WORKS COMMITTEE Trustee Gustus, seconded by ~rustee Scholten, moved to waive the rules ro consider a formal agreement .with Cook County for installation of traffic signals aT Busse Rd. aT Westbrook School. Trustee Anderson's "pass" vote was because of his direct interest in the property and it was agreed that he would pay St~25 per square foot for the south one-half of the alley. Trustee Scholten, seconded by Trustee Link, moved to retain special counsel Marlin Smith of the firm of Ross, Hardies~ O'Keefe to take appropriate steps to commence quo warranto litigation against the City of Des Plaines with respect to the ten acres commonly known as the Stephanie property as well as properties north of Algonquin Road both east and west of Elmhurst Road which have been recently involved in litigation commenced by the City of Des Plaines against the Village of Mount Prospect.
