HomeMy WebLinkAboutRes 01-63 01/02/1963 i Ii . I II I II II RESOLUTION NO. 1-63 A RESOLUTION REQUESTING SPECIAL ELECTION WHEREAS, the Honorable Walter P. Dahl was elected Justice of the Peace of Wheeling Township in April of 1961 for a term of office for four years to expire in April of 1965; and WHEREAS, the Honorable Walter P. Dahl was in November of 1962 elected as Associate Judge of the Superior Court of Cook County; and WHEREAS, by virtue of said election of Walter P. Dahl to the Superior Court of Cook County, a vacancy now exists in the office of Justice of the Peace of Wheeling Township; and WHEREAS, a large portion of the Village of Mount Prospect is II located within said Wheeling Township and it is of vital necessity to I ! the citizens of Mount Prospect and of Wheeling Township that the office i i I of Justice of the Peace be filled as soon as possible in order to permit !I II and expedite the administration of justice in ~~eeling Township; and WHEREAS, under the provisions of Section 7 of the Justices & Constables Act (Ill. Rev. Stats. Ch.79 & 7) it is provided that it shall be the duty of the County Clerk to issue his order for the calling of a special election to fill the office of Justice of the Peace when a vacancy has occurred; and WHEREAS it is considered in the best interest of the Village of Mount Prospect and Wheeling Township that the office of Justice of the Peace, vacated by virtue of the election of the Honorable Walter P. Dahl to the Superior Court of Cook County, be filled forthwith; NOW THEREFORE BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT: SECTION 1: That the corporate authorities of the Village of Mount Prospect do hereby request the Honorable Edward J. Barrett, County Clerk of Cook County, to issue his order to the judges of election Page One of Wheeling Township requiring them on a certain day to hold an election to fill the vacancy in the office of the Justice of the Peace of Wheeling Township, and that the County Clerk designate a date not more than ninety (90) days from the date of this resolution. SECTION 2: That the President of the Village of Mount Prospect and the Village Manager of Mount Prospect are hereby directed to use all efforts necessary to urge upon the County Clerk of Cook County the necessity of filling said vacancy by special election. SECTION 3: That the Village Clerk of Mount Prospect is hereby directed to transmit a certified copy of this resolution to the Honorable Edward J. Barrett, County Clerk of Cook County, upon its passage. SECTION 4: This resolution shall be in full force and effect from and after its passage and approval in the manner provided by law. AYES: Trustees Bruhl, Bickley, Casterline, Ekren, Gaw and Phillips NAYS: None.
