INVOCATION Trustee Minton gave the invocation. ROLL CALL Present upon roll call: Ayes: Teichert Floros Hendricks Minton Rhea Richardson Wattenberg APPROVAL OF MINUTES OF THE REGULAR MEETING OF SEPTEMBER 7, 1976 Trustee Wattenberg, seconded by Trustee Richardson, moved for approval of the minutes of the regular meetin§ of September 7, 1976. Upon roll call: Ayes: Floros Hendricks Minton Rhea Richardson Wattenberg Motion carried. APPROVAL OF BILLS Trustee Floros, seconded by Trustee Richardson, moved for a~proval of bills in the following amounts: General $ 186,322.09 Parking system revenue 104.60 Motor Fuel Tax. 5,009.15 Corporate Purp. Constr. 1973. 9,313.68 Corporate Purp. Constr. 1974. 33,002.50 Waterworks &.~S~werage Fund. 26,475.16 $ 260,227.18 Upon roll call: Ayes: Floros Hendricks Minton Rhea Richardson Wattenber§ Motion carried. Trustee Floros, seconded by Trustee Richardson, moved for approval of the financial report subject to audit. Upon roll call: Ayes: Floros Hendricks Minton Rhea Richardson Wattenberg Motion carried. COMMUNICATIONS & PETITIONS -- CITIZENS TO BE HEARD Norma Murauskis presented awards to one §&llon blood donors. Fred Schurhorn, 1517 Park Dr. representing Woodview Home Owners Association spoke on the Brickman construction vs. Village of Mt. Prospect lawsuit. He asked the Village to re-enter the litigation. The Board stated an agreed order between Brickman and the Village has taken place. Therefore, the Village is no longer a party in the litigation. Bob Barett, 1516 Park Dr., alsp asked the Village to re-enter the case. After an extensive discussion which included several people at once directing inqutries to the Board, Trustee Wattenberg, seconded by Trustee Minton, offered a motion to allow the Village Attorney to seek outside counsel and pursue this matter with rec'ommendations to the Board. More discussion followed, and Trustee Wattenberg withdrew his motion; Trustee Minton withdrew his second because of the vagueness of the motion. Trustee Minton, seconded by Trustee Wattenberg, moved to have the Village vacate the agreed order for Case 73L12381 and re- enter the case. The Village Attorney advised the Board was ppening itself to a lawsuit with this action. Trustee Hendricks, seconded by Trustee £1oros, moved to ta~e Trustee Minton's motion until the next Board meeting, seek outside counsel as t6 the repercussions involved if re-entry into the case i-s pursued. Upon roll call: Ayes: Floros Hendricks Minton Rhea Richardson Wattenberg Motion carried. MANAGER'S REPORT The Village Manager waived his report. MAYOR'S REPORT Kurt Teichert, Chairman of Mt. Prospect Bicentennial Commission presented the organization's final report. The Mayor accepted the report and presented.certificate~ of appreciation to the members of the Commission. The Mayor proclaimed Oct. 3 9, 1976 as Fire Prevention Week and proclaimed a Respect Life Week. The Mayor requested Board concurrance for the following persons to fill existing vacancies on various commissi, on~: Trustee Hendricks, seconded by Trustee Rhea moved to approve the appointment of Nicholas 3. He~er to Business District Development &Rede. velopment Commission. Upon roll call: Ayes: Floros Hendricks Minton Rhea Richardson Wattenberg Motion carried. Trustee Hendricks, seconded by Trustee Wattenberg, moved to approve the appointment of Terry Frakes to the Insurance Commission. Upon roll call: Ayes: Floros Hendricks Minton Rhea Richardson Wattenberg Motion carried. Trustee Wattenberg , Seconded by Trustee Richardson, moved to approve the appointment of Clem Stein to the Drainage & Clean Streams Commission. Upon roll call: Ayes: Floros Hendricks Minton Rhea Richardson Wattenberg Motion carried. Trustee Wattenberg, seconded by Trustee Hendricks, moved to approve the appointment of Arthur Brescia to the Chairman~ship of the Finance Commission. Upon roll call: Ayes: Floros Hendricks Minton Rhea Richardson Wattenberg Motion carried. Trustee Wattenberg, seconded by Trustee Richardson, moved to approve the appointment of Ross Miller to the Finance Commission. Upon roll call: Ayes: Floros Hendricks Minton Rhea Richardson Wattenber§ Motion carried. Pg. 2 9-21-76 The Mayor moved the library budget request to the floorldiscussion. Trustee Richardson, seconded by.Trustee Minton, moved to approve granting the library board an additional $75,995.00 with no restraints on the expenditure. Upon roll call: Ayes: Floros Minton Rhea Richardson Teichert Nays: Hendricks Wattenberg Motion carried, COMMITTEE REPORTS BUILDING COMMITTEE Discussion on Red Lobster Inn commenced. Trustee Minton moved for concurrence of the ZBA ruling. Craig M. Bayhi was the Real Estate representative who spoke on behalf of the Red Lobster Inns. Motion failed for lack of a second. Director of Building & Zoning provided information on the proposal. Trustee Hendricks moved the entire proposal go back to committee for further study. Motion failed for lack of a second. Trustee Minton, seconded by Trustee Rhea, moved for concurrence of the Zoning Board on Case 33-Z-76. Upon roll call: Ayes:~ Flo~os Hendricks Minton Rhea Richardson Wattenber§ Motion carried. Trustee Minton, seconded by Trustee Rhea, moved for approval of Zoning Board case 49-V-76. Upon roll call: Ayes: Floros Hendricks Minton Rhea Richardson Wattenberg Motion carried. Trustee Minton, seconded by Trustee Rhea, moved to approve the plat of subdivision subject to posting of public improvement bonds. Upo~ roll call: Ayes: Floros Hendricks Minton Rhea Richards~n'Wattenberg Motion carried. Bernie Lee, attorney for the Mt prospect Bible Church requested a variance for installation of sprinklers in the church. Fire Pre- vention Officer Watkins and Director of Building & Zoning Dutton spoke against granting this variation. Trustee Mint6n, seconded bs Trustee Hendricks, moved to concur w~th the Building Committee's report and deny the variation. Upon roll call: Ayes: Hendricks Nays: Floros Minton Rhea Richardson Wattenber§ Trustee Minton moved that the Village Manager be and is hereby authorized not to enforce the Village Building Code and/or whatever Safety Code against the Mount Prospect Bible Church with respect to the automatic sprinkling system requirements for the ex- isting structure. Pg. 3 9-21-76 Phil Buriegi, President, Huntington Commons, John Markay, Darril Didier of Dad's Quick Wash, 1722 DempSter sp6ke against the present water billing structure. A long extensive discussion on this matter took place. Trustee Hendricks left at 12:45 A.M. Trustee Rhea moved, seconde~dby Trustee Wattenberg, to have the administration seek professional help in evaluating the water rate billing structure. Upon roll call: Ayes: Floros Minton Rhea Richardson Wattenberg Motion carried. FIRE & POLICE Trustee Richardson, seconded by Trustee Floros, moved for concurrence of the committee report. Upon roll call: Ayes: Flo~os Minton R~ea Richardson Wattenberg Motion carried. PUBLIC WORKS Trustee Rhea, seconded by Trustee Minton, moved to concur with the Administration's recommendations that Well 410 be abandoned, the property appraised and offered for sale and maximum financial compensation secured from the MSD for damages. Upon roll call: Ayes: Floros Minton Rhea Richardson Wattenberg Motion carried. OTHER BUSINESS Trustee Minton moved, seconded by Trustee Richardson, that Vollman's subdivision be approved ~nd the Mayor & Clerk authorized to sign the linen. This subdivision lies outside the corporate limi~ of Mount Prospect, but needs approval for recording. Upon roll call: Ayes: Floros Minton Rhea Richardson Wattenberg Motion carried. Trustee Mlnton,,moved seconded by Trustee Richardson that a grant of easement presented by the Venture Department Store ownership be accepted. O~on roll call: Ayes: Floros Minton Rhea Richardson Wattenberg Motion carried. The Village Attorney announced that the lawsuit, Georgen & Popoin Fresh Pies vs. Village (Case 76-L-4400) was decided in favor of the plaintiff. Trustee Minton moved, sTrustee Richardson seconded, that the law firm'of Jack Siegel be authorized to present an appeal. Upon roll call: Ayes: Floros Minton Rhea Richardson ~attenberg Motion carried.
