Minton APPROVAL OF MINUTES OF REGULAR MEETING OF JULY 6, 1976 Amend sentence to read "Mayor Teichert finally suggested the Fire & Police Committee meet with a sub-committee of School Board 59 in the hopes of resolv- ing the problem". Trustee Floros, seconded by Trustee Wattenberg, moved to approve the minutes of the Regular Meeting of July 6, 1976 as amended. Upon roll call: Ayes: Floros Rhea Richardson Wattenberg Motion carried. COMMUNICATIONS AND PETITIONS - CITIZENS TO BE HEARD Norma Murauskis presented awards for one gallon blood donors. Lynn Bennett presented petitions from students protesting inadequate funding and services provided currently by. the Mt. Prospect Library. John Parsons presented petitions from residents of Mount Prospect asking the Board to restore the $160,995 cut from the Library's budget. Numerous people from the audience spoke about what was felt to be inadequate funding by the Village Board to allow for normal library services. After much discussion by all parties, Mayor Teichert tenatiYely set Tuesday August 10, 1976 at 7:30 P.M. in the Board Room for a Committee of the Whole meeting with the Library Board. Phillip Buriegi spoke on behalf of all Mt. Prospect condominium owners regarding the present water rate fee charge. After much discussion by all parties, Mayor Teichert referred this matter to the Building Committee with the hopes that a different committee studying the problem~may shed new light on the subject. Trustee Minton said he would try to have a meeting on this Pg. 1 7-20-76 subject in either August or September. MANAGER'S REPORT The Village Manager reported on the 'S" Curve contract letting and requested the concurrence of the Board for a January 1977 contract letting. Trustee Richardson, seconded by Trustee Minton, moved for acceptance of January 1977 for contract letting on the "S" Curve. Upon roll call: Ayes: Floros Hendricks Minton Rhea Richardson Wattenberg Motion carried. The Village Manager reported and requested approval of a Resolution to participate in the Northwest Municipal Conference Insurance Study. Trustee Minton, seconded by Trustee Richardson, moved for approval of Resolution ~22-76: A RESOLUTION OF GOOD INTENT TO PARTICIPATE IN THE JOINT MUNICIPAL RISK MANAGEMENT STUDY PROPOSED BY THE DUPAGE MAYORS AND MANAGERS CONFERENCE AND THE NORTHWEST MUNICIPAL CONFERENCE Upon roll call: Ayes: Floros Hendricks Minton Rhea Richardson Wattenberg Motion carried. Next, the Village Manager reported on the establishment of a Juvenile Court in the suburbs. The Manager said a Resolution is needed to pursue this matter and would be an extension of past Board action. Mayor Teichert asked the Village Staff to further study this matter and advise the Board accordingly. The Village Manager provided the Board with an update of the Swine Flu Program saying the Village is working very closely with the County on this matter. MAYOR'S REPORT Mayor Teichert turned down the request by the Northwest Suburban Center for Transcendental Meditation for a Proclamation of Endorsement because of its seemingly close religious nature. A letter to that effect will be sent to the organization. COMMITTEE CHAIRMEN REPORTS BUILDING COMMITTEE Trustee Minton, seconded by Trustee Ftoros, moved for waiving the rules requiring a second reading of Case 23-V-76. Upon roll call: Ayes: Floros Hendricks Minton Rhea Richardson Wattenberg Motion carried. Trustee Minton, seconded by Trustee Hendricks, moved for con- currence of the Building Committee recommendation of approval for Case 23-V-76. Trustee Minton, seconded by Trustee Hendricks, moved for waiving the rules requiring a second reading of Case 28-V-76. Upon roll call: Ayes: Floros Hendricks Minton Rhea Richardson Wattenberg Motion carried. Mr. Durant spoke on behalf of his request. Pg. 2 7-20-76 After thorough discussion of this matter, the phrase "Drive In Rest- aurant'' was stricken from request. , Trustee Minton, seconded by Trustee Richardson, moved for concurrence with the Building Committee recommendation of approval for Case 28-V-76. Upon roll call: Ayes: FlOros Hendricks Minton Rhea Richardson Wattenberg Motion carried. Trustee Minton asked the Clerk tO put cases 19-V,76 and 20-V,76 on the agenda for the next meeting. Trustee Minton reported on Cases 5-V-76 and 25-V-76. There was considerable discussion on this matter. -Bernie Lee spoke on behalf of William Roppolo, the,~party requesting the zoning variance. Dr. Paul Heck, 435 W. Prospect Ave., spoke against granting the variance due to the increased density it would create. Stoh Allen, 747 S. Myer Rd. and Marilyn Powell spoke against the proposed change also. Trustee Minton, seconded by Trustee Hendricks, moved for concurrence of the Building Committee recommendation of approval for Case 5-V-76 and 25-V-76. Upon roll call: Ayes: Minton Richardson Wattenberg Nays: Floros Hendricks Rhea Teichert Motion fails. JUDICIARY COMMITTEE Trustee Wattenberg discussed a conflict of interest ordinance revision. A thorough discussion on the ordinance took place. The Village Attorney was asked to re-draft the ordinance to include changes in Section 8.115, Para- graph 7 and allow for some form of percentage of income disclosure. It was the consensus of the Board the ordinance, if approved, would not go into effect until January 1977. PUBLIC WORKS COMMITTEE The second reading of the lawn sprinkling ordinance took place.' Trustee Floros, seconded by Trustee Wattenberg, moved to strike the word "Greenhouse" from Paragraph F Sub Paragraph 2. Upon roll call: Ayes: Floros Hendricks Minton Rhea Richardson Wattenberg Motion carried. Trustee Rhea, seconded by Trustee Wattenberg, moved for approval of Ordinance 2648: AN ORDINANCE AMENDING SECTION 23.111 AND SECTION 23.112 OF THE MUNICIPAL CODE Upon roll call: Ayes: Floros Hendricks Minton Rhea Richardson Wattenberg Moti.on carried. OTHER BUSINESS Trustee Wattenberg, seconded by Trustee Rhea, moved for waiving the rules requiring a second reading of Ordinance #2646. Upon roll call: Ayes: Floros Hendricks Minton Rhea Richarson Wattenberg Motion carried. Trustee Minton, seconded by Trustee Richardson, moved for waiving the rules requiring a second reading of Ordinance #2647. Trustee Minton, seconded by Trustee Rhea, moved for approval of Ordinance #2647: AN ORDINANCE ADOPTING THE 1976 DEVELOPMENT CODE Upon roll call: Ayes: Floros Hendricks Minton Rhea Richardson Wattenberg Teichert Motion carried. Trustee Minton, seconded by Trustee Wattenberg, moved for approval of the Tamarack & Palm Consent Decree. Upon roll call: Ayes: Floros Hendricks Minton Rhea Richardson Wattenberg Teichert Motion carried. ITEMS TO BE REFERRED Letter of Robert Gordon, Esq. Case # 76L 4400 was referred to the Judiciary Committee. Proposed residency requirement was referred to the Fire & Police Committee.
