INVOCATION The invocation was given by Trustee Hendricks ROLL CALL Present upon roll call: Krause Floros Hendricks Murauskis Richardson Wattenberg Absent: Minton APPROVAL OF MINUTES OF REGULAR MEETING, JUNE 7, 1977. Corrections to roll call vote infirst motion, noting that Trustee Floros was stated in the Nays and should be Ayes, and change date to June 8th when Mr. Muldowney's report would be delivered to Trustees. Trustee Waktenberg, seconded by Trustee Richardson, moved to approve the minutes of the regular meeting held June 7, 1977, with corrections. COMMUNICATION AND PETITIONS CITIZENS TO BE HEARD Mr. Ed Walsh, 714 S. Emerson, spoke to the Board relative to the pending construction by MSD in the general area of Emerson an~ Lonnquist. Mr. Walsh asked that the Village agree to inspect the residents homes before blasting in that area began noting any and alt conditions and that a bond be placed with the Village by the qonstruction company insuring payment of any damage done to homes due to the blasting. Village Attorney Zimmermann explained the Village does have an agreement with MSD and that no bond can be required by the construction company due to prior court decisions on this subject. Main Ray Martin, 101 Wa Pelta Mayor Krause stated that the Village, through the Mayor and Village representatives~ would meet with MSD and express their concern for the residents of the Village with these complaints. Those residents having expressed concerns would be notified as to the outcome of the meeting. Mrs. K. Knuth, 813 S. Lancaster, approached the Board with a request for a crossing guard to be positioned at Lonnquist and Busse Road for the summer months in order to provide children a safe crossing at that intersection, especially now with the detour because of the "S" curve construction. Police Chief Doney noted that the budget did not allow for a crossing guard at that location stating that $1,905 would be the amount necessary to fund this request. Trustee Floros, seconded by Trustee Hendricks, moved for waiver of the rule to bring a matter to the floor that was not on the agenda. Trustee Floros, seconded by Trustee Hendricks, moved to approriate $1,905 to implement crossing guards to be used at the intersection of Busse Road and Lonnquist Blvd. Upon roll call: Ayes: Floros Hendricks Murauskis Richardson Wattenberg Bernie Lee~ Trustee Elk Grove Township, stated that the Township would fund one-half of the cost for the crossing guard. John L. Priola, 710 S. Emerson, requested the Police Department to regulate the thru traffic generated on Emerson Street due to the "S" curve construction and the detour necessary. It was noted that the traffic would be blocked off completely at Golf and Route 83 and at Route 83 and Prospect Avenue in an attempt to detour traffic. Village Manager Eppley noted that the State would have to concur with this action. Mrs. J. Grief, 103 E. Hiawatha, requested permission be given to the construction workers at Hiawatha and Emerson to park on the parkway, which would allow a smoother flow of traffic on Emerson at that point. MANAGER'S REPORT Village Manager Eppley presented Mayor Krause and Trustee Murauskis diplomas for completing the tours of each department in order to learn their functions. MAYOR'S REPORT Mayor Krause presented a water conservation flag to Randhurst Corporation for saving thousands of gallons of water. Mayor Krause presented Edward B. Rhea, Jr. a resolution of appreciation for his service as Trustee. Pg. 2 6-21-77 Robert Sherman was presented a Certificate of Merit by Mayor Krause for serving on the Zoning Board of Appeals Robert D. Teichert presented Mayor Krause a Certificate of Merit for serving as Chairman of the Zoning Board of Appeals on behalf of the former Board of Trustees. Trustee Floros, seconded by Trustee Richardson, moved to continue deliberation with Share + 3 into the next step of acquiring water, and authorize the Mayor to send a letter to that effect. Mayor Krause announced that a Special Meeting of the Mayor and Board of Trustees would be held June 28, 1977, at 8:00 P.M. for the purpose of discussing water rates. Trustee Murauskis, seconded by Trustee Hendricks, moved to concur with Mayor Krause's appointment of Don Miller, 1815 Pheasant Trail, to the Planning Commission. Upon roll call: Ayes: Floros Hendricks Murauskis Richardson Wattenberg Motion carried. Trustee Murauskis, seconded by Trustee Wattenberg, moved to concur in the re-appointment of J. C. Busenhart, Lynn Kloster, Harold Ross, Louie Velasco, and Donald C. Weibel to the Planning Commission. Upon roll call: Ayes: Floros Hendricks Murauskis Richardson Wattenberg Motion carried. Trustee Wattenberg, seconded by Trustee Murauskis, moved to concur with the Mayor's appointment of Ray Friend, 414 S. Wille Street to the Business Distri'ct Development and Redevelopment Commission. Upon roll call: Ayes: Floro2 Hendricks Murauskis Richardson Wattenberg Motion carried. Trustee Murauskis, seconded by Trustee Hendricks, moved to concur with the Mayor's re-appointment of Nicholas A. Michas, and Nicholas Helmer to the Business Development of Redevelopment Commission. Upon roll call: Ayes: Floros Hendricks Murauskis Richardson Wattenberg Motion carried. Trustee Murauskis, seconded by Trustee Wattenberg, moved to concur with the appointment of Bill Warner, 1415 Bridgeport Drive, to the Board of Fire & Police Commissioners. Trustee Murauskis, seconded by Trustee Wattenberg, moved to concur with the appointment of Ed Miller, i31 S.Kenilworth to the Board of Fire & Police Commissioners. Trustee Wattenberg, seconded by Trustee Murauskis, moved to concur with the Mayor's re-appointment of David Bruce, Ruth Cyrier, Robert Meersman, and Dr. Fred Neal to the Board of Health. Trustee Richardson, seconded by Trustee Hendricks, moved to concur with the Mayor's re-appointment of Ken Kazmar and Ken Petrine to the Zoning Board of Appeals. Trustee Floros, seconded by Trustee Richardson, moved to concur with the Mayor's re-appointment of Richard Bachhuber and Carl Beier to the Finance Commission. COMMITTEE REPORTS BUILDING COMMITTEE Trustee Hendricks presented the Building Committee report noting that ZBA Case No. 50-V~76 had been withdrawn by the petitioner. Trustee Hendricks, seconded by Trustee Richardson, moved to grant the variation requested in ZBA Case l-V-7?. Upon roll call: Ayes: Floros Hendricks Murauskis Richardson Wattenberg Motion carried. Village Attorney Zimmermann was requested to prepare the appropriate ordinance relative to this case. Trustee Hendricks, seconded by Trustee Wattenberg, moved to grant the requested front yard variation as stated in ZBA Case No. 5-V-77. Pg. 4 6-21~77 Trustee Wattenberg, seconded by Trustee Murauskis, moved to waive the rule requiring two readings of an ordinance. Trustee Hendricks, seconded by Trustee Floros, moved for passage of Ordinance No. 2717 AN ORDINANCE GRANTING A FRONT'YARD VARIATION FOR PROPERTY LOCATED AT THE NORTHWEST CORNER OF HENRY STREET AND MAPLE STREET. Upon roll call: Ayes: Floros Hendricks Murauskis Richardson Wattenberg Motion carried. Trustee Hendricks noted that ZBA Case No. 6-V-77 was to Pe-publish the legal notice due to inefficiencies and that upon completion of that this case would come directly to the Board for approval since all other aspects had been reviewed by the Building Committee. Trustee Hendricks reported on ZBA Case No. 8-SU-77, a request to build an additional theater in connection with the Randhurst Theater. Trustee Floros expressed his concern relative to another building on the Randhurst property noting the area surrounding the shopping center was being built on more than original concept called for. Trustee Hendricks, seconded by Trustee Richardson, moved to grant the special use requested under ZBA 8-SU-77. Trustee Hendricks, seconded by Trustee Richardson, moved to concur with the Committee's recommendation and grant the requested re-zoning under ZBA Case No. 10-Z-77. Upon roll call: Ayes: Floros Hendricks Murauskis Richardson Wattenberg Motion carried. Trustee Hendricks, seconded by Trustee Richardson, moved to ccncur with the Committee's recommendation and grant the requested special uze under ZBA Case No. 10-SU-77. Upon roll call: Ayes: Floros Hendricks Murauskis Richardson Wattenberg Motion carried. Mr. Mulrooney,Champaign, Illinois, representing the petitioner in Case 10-Z-77 and 10-SU-77, requested the date when building permits could be secured for the subject property. Mayor Krause and Trustee Hendricks stated that passage of the necessary ordinances could be expected at the next Village Board meeting to be held July 5, 1977. Pg. 5 6-21-77 Trustee Hendricks noted that revisions of the filing fees for a Zoning Board of Appeals case were being investigated. JUDICIARY COMMITTEE Trustee Wattenberg noted that although the previous Board had not agreed to give financial assistance to those residents involved in the Brickman litigation, he felt that the present Board should reconsider that decision. Since Trustee Floros had no had a chance to review the Judiciary Committee's report, Trustee Wattenberg would present his motion at a later time. PUBLIC WORKS COMMITTEE Trustee Richardson, seconded by Trustee Murauskis~ moved for concurrence with the Public Works Committee recommendation to install sidewalks along the eastern end of ~rospect Avenue and along Euclid Avenue from Wolf Road with the remainder of the budgeted amount around Clearwater Park. Upon roll call: Ayes: Floros Hendricks Murauskis Richardson Wattenberg Motion carried. It was reco~mmended by the Public Works Committee that a letter be sent to the home owners association in the area along Gregory Street soliciting their comments relative to the installation of sidewalks along Gregory between Fairview and Meadows Park to insure the safety of those going to the park. Trustee Murauskis noted the need for resurfacing of the 1800 block of Pheasant Trail. Village Engineer stated that MFT funds allowing, this project could be undertaken. It was reported that the Board of Local Improvements would repoyt to the Village Board on their recommendation relative to curb and gutter work proposed in the area of George and Albert Streets n0rth-of Northwest Highway. The Committee requested Planned Unit Development ordinances from surrounding communities in order to revise the current ordinance in the Village. Trustee Richardson, seconded by Trustee Murauskis, moved for concurrence with the recommendation of the Public Works Committee to authorize the Mayor to sign the agreement between the State of Illinois and the Village of Mount Prospect relative to the road improvement at the intersection of Rand and Central Roads. It was reported that the Dyno testing project submitted by Village Engineer Hemmeter had been rejected by the ComMittee. The Committee requested Mr. Bob Novak attend the next Public Works Committee in order to provide additional information on this proposed project. OTHER BUSINESS Trustee Richardson~ seconded by Trustee Wattenberg, moved for passage of Ordinance No. 2718 AN ORDINANCE AMENDING THE BUILDING CODE Upon roll call: Ayes: Floros Hendricks Murauskis Richardson Wattenberg Motion carried. Pg. 6 6-21-77 Trustee Wattenberg, seconded by Trustee Richardson, moved for passage of Resolution No. 24-77 A RESOLUTION RELATING TO PARTICIPATION BY PART TIME ELECTED OFFICIALS IN THE ILLINOIS MUNICIPAL RETIREMENT FUND Upon roll call: Ayes: Hendricks Murauskis Richardson Wattenberg Nays: Floros Motion carried. The plat of Subdivision for the Roppolo property located at Central and Hi Lusi was submitted for approval. Trustee Wattenberg, seconded by Trustee Richardson, moved to authorize the Mayor to sign and Clerk to attest the Roppolo ~lat of subdivision, subject to the posting of any public improvements bonds, if~necessary. Upon roll call: Ayes: Hendricks Murauskis Richardson Wattenberg Nays: Floros Trustee Wattenberg, seconded by Trustee Richardson, moved that pursuant to the home rule powers vested in the Mayor and Board of Trustees of the Village of Mount Prospect by way of Article VII of the Constitution of the State of Illinois, to authorize the Mayor to sign and Clerk to attest her signature on the Grant of Easement thereby accepting same from Chicago Title & Trust Company as Trustee under Trust No. 1068741, dated May I, 1976, which easement is for access to and maintenance of certain public utilities located within Phase III of the Colony and further, that such signing be conditioned upon the correction first of all minor adjustments to man-holes, valve vaults as well as the clearing up of certain title objections that have been reflected in Title Commitment No. 65 46 036, dated June 17, 1977, being a title commitment from the Chicago Title Insurance Company, and, further conditioned upon proper recordation of the Grant of Easement so that the title policy guaranteeing easement rights to the Village of Mount Prospect can and shall issue. Trustee Wattenberg, seconded by Trustee Richardson, moved that upon the Mayor's execution of the aforesaid easement and recordation and proper registration thereof with the Registrar of Titles, that the Village accept proper bill of sale for the underlying water mains, sanitary sewer mains and appurtenances. COMMITTEE ANNOUNCEMENTS Trustee Hendricks noted that the Building Committee would be held July 13th and that all matters referred would be heard that evening. Po. 7 6-21-77 he Finance Committee meeting would be held June 22, and since the Library Board was meeting that evening, Assistant Village Manager Ed Geick was asked to attend as liason from the Village at that Library Board meeting. The Fire & police Committee would be held July ISth as scheduled. FOR INFORMATION ONLY Mayor Krause announced that a Special meeting will be held relative to the water rate structure reconnmended In the letter and report submitted by Fletcher Engineering. Trustee Wattenberg, seconded by Trustee Murauskis, moved to authorize the Village Manager to send a letter to Arlington Federal Savings & Loan relative to the Wille Lumber Yard stating the Village had no interest in purchasing that property.
