INVOCATION The invocation was given by Trustee Floros. MANAGER'S REPORT Village Manager Burghard requested waiving the bidding process in order to purchase and install an emergency recording device from Reshal Associates of Arlington Heights to be installed by January l, 1979.~ Trustee Floros, seconded by Trustee Richardson, moved to waive the bidding process in order to purchase a recording device at a price not to exceed $10,000. Mr. Burghard noted that a request had been made bY Citizens Utilites Company for a 27~% rate increase, and asked if the Village would want to intervene in this case. Trustee Wattenberg, seconded by Trustee Murauskis, moved to authorize the Village to intervene in the rate increase request filed by Citizens Utilities Company and to investigate the possibility of sharing such costs with oDher municipalities with expenses incurred by the Village in this matter to be included in the purChase price of the Citizens Utilities system. Village Manager Burghard presented an interim agreement with the Elk Grove Rural Fire Protection District until that District could set-up their new service. Trustee Watt~nberg, seconded by Trustee Murauskis, moved to authorize the Mayor to sign and Clerk to attest her . signature on the Agreement for Interim Backup Service Fire Protection and Emergency Service AsSistance dated December 19, 1978. Mr. Burghard mentioned that the request received from Arlington Heights to amend the boundary agreement had been withdrawn. Trustee Floros, seconded by Trustee Murauskis, moved to authorize the administration to initiate repairs for Well #16 with the amount not to exceed $6,500. MAYOR'S REPORT Since all construction problems with the Mount Prospect ~ Library had been resolved, Mayor Krause requested ~ Board concurrence with the return of $5,?50.00 of the amount being held as guarantee. Trustee Richardson, seconded by Trustee Murauskis, moved to authorize the Mayor to sign and Clerk to attest her signature on the Mutual Release between the Village of Mount Prospect and Chell and Anderson. COMMITTEE REPORTS BUILDING COMMITTEE TrUstee Hendricks presented the Building Committee report of the December 13th meeting. ZBA 67-Z-78 and 68-V-78, Helena & Haven Since the petitioner had withdrawn the request for variation, elimating action on MBA 68-V-78. Trustee Hendricks, seconded by Trustee Wattenberg, moved to concur with the recommendation of the Building Committee and Zoning Board of Appeals and grant the requested rezoning in case ZBA 67-Z-78. ~ Upon roll call: Ayes: Floros Hendricks Minton Murauskis Richardson Wattenberg Nays: None Motion carried. ZBA 79-Z-78, White Oak Area Trustee Hendricks, seconded by Trustee Minton, moved to concur with the recommendation of the Building Committee and Zoning Board of Appeals and grant the rezoning subject to annexation. Attorney for the petitioners, Bernard Lee, requested the Board to insure the residents of the White Oak area that the rural nature of the area would be maintained following annexation, and that no sidewalks, lights, etc. would be installed until such time as it would effect the health and safety of the community. Mayor Krause stated that such rural nature would be maintained as stated~ Trustee Hendricks, seconded by Trustee Wattenberg, moved to waive the rule~r~quiring two readings of an ordinance relative to the White Oak Area. Trustee Hendricks, seconded by Trustee Wattenberg, moved that the basic rural nature of the area involved with the annexations occurring under Ordinance Nos. 2841 and 2842 be retained and that in addition, until such time as a ma$ority of the owners of the land in question come forward and ask for them, that no sidewalks, curbs, or street lights will be constructed or installed in that area, except any land or territory that in the future might be further subdivided and furthermore, that the water supply s~stem of the Village need not be installed until such t!ime as the Village feels that the public health, safety, and welfare of the community is involved and the necessity o2 the preservation of that safety and welfare cause the construction of the water mains and the Village's system in the areas involved with Ordinance Nos. 2841 and 2842. Harris, being the owner of property recently annexed into the Village, requested the Village Board to give consideration to the petitioner relative to waiving the requirement of installing curbs, street lights, and sidewalks as was stated in the preceeding motion for the neighboring area. Trustee Wattenbe~rg, seconded by Trustee Minton, moved to waive the requirements previously agredd upon for the petitioner to install curbs, sidewalks, and street lights being the subject of ZBA 15,Z-78 and 16-SU-?8, and that wording as agreed upon would be spread across the Plat of Subdivision for that property. Mr. Gattone, a resident on Susan Drive, requested information as to the procedure to be followed should any of the newly annexed residents desire to make certain improvements to their property. Mayor Krause explained that should such improvements not fall within the R-E District, proper application would have to be made and filed for rezoning or variation.· Trustee Hendricks, seconded by Trustee Wattenberg, moved for passage of Ordinance No. 2849. PAGE 9 12/I9/78 Trustee Hendricks, seconded by Trustee Richardson, moved that the lake known as Lake Briarwood be maintained by the Homeowners Association in perpetuity; and that furthermore, that retroactive application of the Village's subdivision control and development code ordinances with respect to street lights, sidewalks, curbing, and such other public improvements normally required but which were not contained in the plat of subdivision for the subject property being the subject of Ordinances 2851 and 2852 be waived. Upon a question from the audience, Mayor Krause assured the residents of the area that the Village would not at any time condemn the lake. Trustee Richardson, seconded by Trustee Hendricks, moved to authorize the Village Attorney to proceed to the Zoning Board of Appeals on behalf of the Village Board to rezone the property involved with Ordinances 2851 and 2852, from R-X to R-1. Trustee Floros, seconded by Trustee Richardson, moved to concur with the recommendation of the Finance Committee to transfer a Class "W" liquor license to the new owners of the Sizzler Steak House. At the direction of the Board, the Finance Committee arranged with the Northwest Municipal Conference to pay an office maintenance support in the amount of $4,015 yearly, to commence May l, 1979. FIRE AND POLICE COMMITTEE No report. JUDICIARY COMMITTEE Trustee Wattenberg presented the Judiciary Committee report of the meeting held December ll, 1978, relative to legal expenses. PUBLIC HEALTH AND SAFETY COMMITTEE Trustee Murauskis presented the November 27, 1978, report of the Public Health and Safety Committee meeting. Trustee Richardson, seconded by Trustee Murauskis, moved to concur with the recommendation of the Public Health and Safety Committee to have that Committee review the ordinances regulating taxi cabs in the Village. Trustee Richardson, seconded by Trustee Murauskis, mo~ed to concur with the recommendation of the Public Health and Safety Committee regulating garbage pickup regulations. OTHER BUSINESS Mayor Krause called the public hearing to order relative to the proposed annexation agreement with the "Tank Farms". Village Attorney Zimmermann briefly explained the proposed agreement. Attorney Stuart H. Diamond, representing the Tank Farms, was present. Wi~h no questions coming from the audience relative to the proposed annexation agreement, Mayor Krause declared the public hearing closed. At this point Mayor Krause called a recess.
