INVOCATION The invocation was given by Trustee Floros. ROLL CALL Present upon roll call: Mayor Krause Trustees Floros Hendricks Minton Richardson Wattenberg Absent: Trustee Murauskis APPROVAL OF MINUTES Trustee Wattenberg, seconded by Trustee Richardson, moved to approve the minutes of the regular meeting of the Village Board held September 5, 1978. Upon roll call: Ayes: Floros Hendricks Richardson Wattenberg Nays: None Pass: Trustee Minton Motion carried. APPROVAL OF BILLS AND FINANCIAL REPORT Trustee Floros, seconded by Trustee Richardson, moved to L approve the following bills: General 405,286.18 Capital Imp. & Repair Rep. 35,100.00 Parking System Revenue 3,482.19 Motor Fuel Tax 41,309.19 Corporate Purposes Constr.1973 32,921.58 Waterworks & Sewerage Dep., Imp. & Ext. 7,326.50 Operation & Maintenance 68~668.20 594,093.84 Upon roll call: Ayes: Floros Hendricks Minton Richardson Wattenberg Nays: None Motion carried. Trustee Floros, seconded by Trustee Richardson, moved to approve the financial report dated August 31, 1978, subject to audit. COMMUNICATIONS AND PETITIONS - CITIZENS TO BE HEARD Nancy Bartlett, a resident of the Bralen Townhouses in Huntington Commons, gave a presentation relative to the development underway of the 'Knights of Huntington' One of the buildings in the 10 building development has had the foundation poured and is within 5 feet of the private swimming pool of the Bralen Townhouse owners. Mrs. Bartlett requested the Village Board to look into the possibility of having the construction stopped. Mayor Krause stated the administration would investigate the matter as to whether the case was handled in the manner provided by the Zoning Ordinance and the matter would be reported out at the October 3rd meeting of the Village Board. Pg. 1 9-19-78 A representative of Community Presbyterian Church, Main & Gregory, requested the Board waive permit fees for ~ construction at that site, except for o~t-of-pocket expenses. Trustee Richardson, seconded by Trustee~Wattenberg, moved to waive the permit fees except for out-of-pocket expenses for the Community Presbyterian Church. Mayor Krause presented a plaque of appreciation to Terry Mulder, Past President of the Mount Prospect Jay Cees for all the service he had given to that organization. MANAGER'S REPORT A~-ting Village Manager Geick presented his report. Trustee Richardson, seconded by Trustee Minton, moved to approve the engineering plans for the development known as Kensington Commons (500 E. Kensington Road). Upon roll call: Ayes: Floros Hendricks Minton Richardson Wattenberg Nays: None Motion carried. Trustee Hendricks, seconded by Trustee Minton, moved to approve the Westgate sanitary sewer engineering pIans provided that before construction would commence and installation of the sanitary sewer system that any and all deposits and sureties be posted with the Village relative to the public improvements. Upon roll call: Ayes: Floros Hendricks Minton Richardson Wattenberg Nays: None Motion carried. Mr. Geick announced that the Deputy and Director of, the Building and Zoning Department had tendered their resignations and requested Board permission to recruit replacements. The Board recommended the new Director would be permitted to participate in the recruiting of a Deputy Director. Trustee Wattenberg, seconded by Trustee Richardson, moved to authorize the Acting Village Manager to proceed with the necessary steps involved to replace the Director of Building and Zoning. Upon roll call: Ayes: Floros Hendricks Minton Richardson Wattenberg Nays: None Motion carried. Mr. Geick presented the bids opened September 19, 1978, for the planting of parkway trees. Trustee Richardson, seconded by Trustee Minton, moved to accept the low bid submitted by Klehms Nursery of Arlington Heights (bid sheets attached), for the purchase of parkway trees. Pg. 2 9-19-78 Trustee Minton, seconded by Trustee Richardson, moved to authorize the Mayor to sign and Clerk to attest her signature on the EEO Plan (Equal Employment Opportunity - Police Dept.). Upon roll call: Ayes: Floros Hendricks Minton Richardson Wattenberg Nays: None Motion carried. Mr. Geick announced that repairs are being made to the Soo Lines and Chicago Northwestern Railroads. MAYOR'S REPORT Mayor Krause proclaimed the week of October $ - 15, 1978, as Fire Prevention Week in Mount Prospect. It was also proclaimed by Mayor Krause that the week of October ! - 7, 1978, would be recognized by Mount Prospect as Respect For Life Week. Mayor Krause presented the recommendations submitted by the Library Advisory Commission (attached to these minutes) noting several of the suggestions had been acted on by the Village and Library Board. Mayor Krause noted that the item referring to a referendum would be something to be determined. by the Library Board. Following disuussion, Mayor Krause expressed appreciation to the Library Advisory Commission members and disbanded that Commission. Trustee Wattenberg, seconded by Trustee Richardson, moved to waive the rule requiring two readings of an ordinance ~' relative to amending the Northwest Suburban Water System Agreement. Upon roll call: Ayes: Floros Hendricks Minton Richardson Wattenberg ays. None Motion carried. Trustee Floros, seconded by Trustee Richardson, moved for passage of Ordinance No. 2816 AM ORDINANCE AUTHORIZING AN AMENDMENT TO THE NORTHWEST SUBURBAN WATER SYSTEM AGREEMENT Upon roll call: ~Ayes: Floros Hendricks Minton Richardson Wattenberg Nays: None Motion carried. Mayor Krause announced an Executive Session of ~he Village Board would be held September 21st at 7:00 P.M. in the Trustees' Room of the Village Hall for the purpose of discussing personnel. Mayor Krause also announced that the bookkeeping previously done by the Deputy Finance Director of the Village for the Northwest Municipal Conference would now be done by Bill Grams of the Conference. COMMITTEE REPORTS BUILDING COMMITTEE Trustee Hendricks, Chairman of the Building Committee, presented the report of the Building Committee. Trustee Hendricks, seconded by Trustee Wattenberg, moved for passage of Ordinance No. 2818 AN ORDINANCE GRANTING A SPECIAL USE FOR PROPERTY LOCATED AT 2 WEST RAND ROAD (ZBA 45-SU-78) Upon roll call: Ayes: Floros Hendricks Minton Richardson Wattenberg Nays: None Motion carried. Trustee Hendricks, seconded by Trustee Wattenberg, moved for passage of Ordinance No. 2819 AN ORDINANCE GRANTING~A VARIATION FOR PROPERTY COMMONLY KNOWN AS 500 - 502 HILL STREET (ZBA 48-V-78) Upon roll call: Ayes: Floros Hendricks Minton Richardson Wattenberg ' Nays: None Mo~ion carried. Trustee Hendricks presented the report of the Building Committee held September 13, 1978. ZBA 49-V-78 Trustee Hendricks, seconded by Trustee Wattenberg, moved for Board concurrence with the recommendations of the Zoning Board of Appeals and Building Committee and grant the requested variation under Case ZBA 49-V-78. Upon roll call: Ayes: Floros Hendricks Minton Richardson Wattenberg Nays: None Motion carried. At the request of the petitioner, Trustee Hendricks, seconded by Trustee Richardson, moved to waive the rule requiring two readings of an ordinance relative to ZBA 49-V-78. ZBA 51-V-78 Trustee Hendricks, seconded by Trustee Wattenberg, moved for Board concurrence with the recommendations of the Zoning B~ard of Appeals and the Building Committee to grant the requested amendment to Ordinance No. 2569. Trustee Hendricks, seconded by Trustee Wattenberg, moved for passage of Ordinance No. 2821 AN ORDINANCE AMENDING ORDINANCE NO. 2569, GRANTING VARIATIONS FOR PROPERTY GENERALLY LOCATED ON THE NORTHEAST CORNER OF KENSINGTON ROAD AND ELMHURST ROAD (ILL. RT. 83) Upon roll call: Ayes: Ftoros Hendricks Minton Richardson Wattenberg Nays: None Motion carried. ZBA 29-SU-78 and ZBA 30-V-78 A motion to reconsider the vote taken at the last Village Board meeting relative to ZBA 29-SU-78 and ZBA 30-V-78 was ruled out of order by the Chairman. Trustee HendriCks, seconded by Trustee Minton, moved to appeal the ruling of the Chair. Upon roll call: Ayes: Floros Krause Nays: Hendricks Minton Richardson Wattenberg Motion carried. A ~otion to reconsider the action taken at the last meeting relative to ZBA 29-SU-78 and ZBA 30-V-78 was not made. FINANCE COMMITTEE No report. FIRE AND POLICE COMMITTEE No report. JUDICIARY COMMITTEE Trustee Wattenberg presented the Judiciary Committee report of September 11, 1978. Trustee Wattenberg, seconded by Trustee Minton, moved to repeal Resolution No. 13-65 relative to public information ~ accessibility. Upon roll call: Ayes: Floros Hendricks Minton Richardson Wattenberg Nays: None Motion carried. Pg. 5 9-19~78 PUBLIC HEALTH AND SAFETY COMMITTEE In the absence of Trustee Murauskis, Trustee Richardson presented the August 31st report of the Public Health and Safety Committee. Trustee Richardson, seconded by Trustee Hendricks, moved to concur with the recommendation of the Public Health and safety Committee to amend Chapter XI of the Municipal Code to regulate the sale of drug paraphernalia. Upon roll call: Ayes: Floros Hendricks Minton Richardson Wattenberg Nays: None Motion carried. An Ordinance Amending Chaper 11 of the Municipal Code would have its second reading October 3rd. The subject of instituting parking restrictions on south Pine between Evergreen and Prospect Avenue on Sundays would be voted on at the October 3rd meeting. Trustee Richardson, seconded by Trustee Hendricks, moved to concur with the recommendation of the Public Health and Safety Committee to amend the Traffic Code to reflect one way traffic southbound on Helena Avenue between Lincoln and~ Haven streets. Trustee Richardson, seconded by Trustee Hendricks, moved to concur with the recommendation of the Public Health and Safety Committee to amend Section 18.1324 of the Traffic Code, to recognize and enforce the use of handicapped parking identification cards. Trustee Richardson, seconded by Trustee Hendricks, moved for passage of Ordinance No. 2822 AN ORDINANCE AMENDING THE TRAFFZC CODE Upon roll call: Ayes: Floros Hendricks Minton Richardson Wattenberg Nays: None Motion carried. The subject of decriminalization of small amounts of marijuana would be discussed at the next meeting of the Committee.~ PUBLIC WORKS COMMITTEE Trustee Richardson presented the report of the Public Work Committee meeting held August 29, 1978. Trustee Richardson, seconded by Trustee Floros, moved to concur with the recommendation of the Public Works Committee to approve the purchase price of $75,000 to $78,000 of the Prospect Meadows Water Company, subject to the approval by the residents. Pq. 6 9-1Q-?R Trustee Richardson, seconded by Trustee ~toros, moved to concur with the recommendation of the Public Works Committee to deny the request of Mr. James Scott, 706 N. Elmhurst Ave., to permit his use of a parkway tree as a--part of his shortwave antenna system. Upon roll call: Ayes: Floros Hendricks Minton Richardson Wattenberg Nays: None Motion carried. Trustee Richardson, seconded by Trustee Floros, moved to concur with the recommendation of the Public Works Committee to grant an easement to Commonwealth Edison across the Village's park site at Tamarack and Palm, but not to grant the right to trim or remove trees, bushes and samplings. Trustee Richardson, seconded by Trustee Floros, moved for Board concurrence with the recommendation of the Public Works Committee to recommend appointment of the Village Manager as. the person to take charge of the Emergency Water Use Plan by amending Ordinance No. 2748. Trustee Richardson, seconded by Trustee Floros, moved to concur with the recommendation of the Public Works Committee to immediately proceed with condemnation proceedings against the Kennicott property relative to improving Lonnquist Blvd. Upon roll call: Ayes: Floros Hendricks Minton Richardson Wattenberg Nays: None Motion carried. Trustee Richardson, seconded by Trustee Floros, moved for passage of Ordinance No. 2823 AN ORDINANCE AMENDING THE PLUMBING CODE ~ Upon roll call: Ayes: Floros Hendricks Minton Richardson Wattenberg Nays: None Motion carried. OTHER BUSINESS Trustee Hendricks, seconded by Trustee Richardson, moved to authorize the Mayor to sign and Clerk to attest her signature on the Wille's Plat of Consolidation., subject to the plat being reproduced on linen and after any and all bonds or sureties for public improvements have been posted with the Village of Mount Prospect. Trustee Hendricks, seconded by Trustee Richardson, moved to authorize the Mayor to sign and Clerk to attest her signature on the De Leo's Plat of Subdivision following certain corrections having been drawn on the previously approved plat. COMMITTEE ANNOUNCEMENTS The Finance Committee meeting would take place September 2?th. The subject of 'streamlining the agenda' wa~ referred to the Fire and Police Committee. No meeting of the Fire and Police Committee will be held in October. The Public Works Committee would not meet in September. Mr. Geick invited the elected officials to attend an instructional session on Zero Based Budgeting the 28th of September, at 7:30 P.M. in the Trustees' Room.
