INVOCATION The invocation was given by Trustee Murauskis  ROLL CALL Present upon roll call: Mayor.Krause Trustees Emndricks Minton Murauskis Richardson ~ Wattenberg Absent: Trustee Floros APPROVAL OF MINUTES Trustee Wattenberg, seconded by Trustee Murauskis, moved to approve the minutes of the January 3, 1978, meeting. Upon roll call: Ayes: Hendricks Murauskis Richardson Wattenberg Pass: Minton . Nays: None Motion carried. APPROVAL OF BILLS AND FINANCIAL REPORT Trustee Richardson~, seconded by Trustee Minton, moved to approve the following bills: General 375,510.88 Parking System Revenue 1,315.12 Motor Fuel Tax 8,B61.97 Waterworks& Sewerage Depr. Impr., & Ext. 3~73B.86 Operation & Maintenance 4B~043.80 $431,965.63 Up'on roll call: Ayes: Hendricks Minton Murauskis Richardson Wattenberg Nays: None Motion carried. Trustee Richardson, seconded by Trustee Minton, moved to approve the ~inancial Report dated December 31, 1977, subject to audit. Upon roll call: Ayes: Hendricks Minton Murauskis Richardson Wattenberg Nays: None Motion carried. COMMUNICATIONS AND PETITIONS - CITIZENS TO BE HEARD George Anderson, Mount Prospect Chamber of Commerce, spoke in opposition to the proposed amendment to the Zoning Ordinance which amendment would increas~ the filing fees before the Zoning Board of Appeals. MAYOR'S REPORT Mayor Krau~e presented a Certificate of Merit to Ken Kazmar. Mr. Kazmar resigned from the Zoning Board of Appeals following l0 years of service. PG 1 1/17/78 Mayor Erause presented two appointments and requested Board concurrence. Trustee Minton, seconded by Trustee Murauskis, moved to concur with the appointment of Hal Ross as Chairman of the Planning Commission, to fill the vacancy left by the resignation of Malcolm Young. This term would expire April 30, 1978. Upon roll call: Ayes: Hendrlcks Minton Murauskis Richardson Wattenberg Nays: None Motion carried. Trustee Minton, seconded by Trustee, Murauskis, moved to concur with the appointment of Col. Ralph Arthur to the Zoning Board of Appeals to fill the vacancy left by the resignation of Eugene B~adke. This term would expire April 30, 1979. Upon roll call: Ayes: Hendricks Minton Murauskis Richardson Wattenberg Nays: None Motion carried. Mayor Krause announced that Share + 3 had called a meeting for January 30th, at which time discussion would take place on the By-Laws. and proposed agreement relative to the acquisition of Lake Michigan water. The Village Attorney rendered an opinion noting that the proposed agreement was binding and that after 30 days no municipality could withdraw. Mr. Eppley was authorized to present the Village's views on the subject. Trustee Wattenberg, seconded by Trustee Richardson, moved to direct the Mayor to write a letter stating that the Village Manager would attend the meeting and that he would request the other municipalities not to enter into an agreement until the report by DAMP was received, and that if a vote were taken, Mr. Eppley was directed ~o vote no. Mayor Krause then announced that a citizens committee had been formed to study the Elk Grove Rural Fire Protection District's contract, stating that she and Fire Chief Pairitz were on the committee. MANAGER'S REPORT Village Manager Eppley presented a Resolution of Congratulation to Otto J. Semrow on his appointment as President of the Des Plaines Chamber of Commerce. Trustee Minton, seconded by T~ustee Hendricks, moved for passage of Resolution No. 1-78 A RESOLUTION OF APPRECIATION TO OTTO J. SEMROW Upon roll call: Ayes: Hendricks Minton Murauskis Richardson Wattenberg Nays: None Motion carried. Mr. Eppley then presented an annual agreement between the Village and the Illinois Department of Transportation. PG 2 1/17/78 Trustee Minton, .seconded by T~s~e Richardson, moved for passage of Resolution No. 2-78 A RESOLUTION OF AGREEMENT WITH IDOT Upon roll call: Ayes: Hendricks- Minton Murauskis Richardson Wattenberg Nays: None Motion carried. Trustee Minton, seconded by Trustee Wattenberg, moved for passage of Resolution No. 3-78 (a supplemental appropriation) A RESOLUTION FOR MAINTENANCE OFSTREETS AND HIGHWAYS Upon roll call: Ayes: Hendricks Minton Murauskis Richardson Wattenberg Nays: None Mr. Eppley presented an agreement relative to the traffic signal maintenance at the intersections of Rand/Central/ Mount Prospect Roads following improvement of that inter- section. The agreement would be'between the ~Ylage of Mount Prospect, the City of Des Plaines, and the Illinois Department of Transportation. Trustee Minton, seconded by Trustee Richardson, moved to authorize the Mayor to sign and Clerk to attest the supplemental agreement. COMMITTEE REPORTS BUILDING COMMITTEE The attorney for the petitioner in ZBA 46-Z-77, 47-V-77- had requested a continuance of this ~at~er to the February 7th meeting of the Village BOard. Robert F. Moore, attorney for-the petitioner in ZBA Cases 54-Z-77, 55-SU-77, 56-V-77, gave a presentation on the subject case. The request for a special Use (55-SU-77) 'was withdrawn by Mr. Moore. The proposed development involved the construction of six buildings., 72 units, on property located north of Kensington east Of the Twin Rinks Ice Arena. The following residants spoke in opposition to the proposed development: Jim Fatima, 916 Boxwood Drive Jackie Noble, 922 A Boxwood Drive Jim LUmko, 918 Boxwood Drive Rae Razinski, 920 Boxwood Drive Elaine Schultz, 904 B Boxwood Drive Bill Schultz, 904 B Boxwood Drive Mrs~ W. Mary Stembr~dge, 600 Greenwood Trustee Minton, se$°nded by Trustee Richardson, moved to concur with the recommendation of the Building Committee and Zoning Board of Appeals to grant the re-zoning and variation requested in ZBA 54-Z-77 and 56-V-77. ~/7/78 Upon roll call: Ayes: Minton Riahardson Nays: Hendricks Murauskis Wattenberg Krause Motion failed. Trustee Hendricks presented ZBA 41-SU-77, Mansard Lane Apartments. The petitioner had requested a change from the original plan and not construct the swimming pool as indicated in the plans. Trustee Hendricks, seconded by TrUstee Murauskis, moved to concur with the recommendation of the Building Committee and Zoning Board o£ Appeals and deny the request. Upon roll call: Ayes: Hendricks Murauskis Richardson Krause Nays: Minton Wattenberg Motion carried. Trustee Hendricks, seconded by Trustee Murauskis, moved for Board concurrence with the recommendation of the Building Committee and Zoning Board of Appeals and grant the requested variation in ZBA B-V-78 (601 W. Carboy Road). Upon roll call: Ayes: Hendricks Minton Murauskis. Richardson Wattenberg Nays: None Motion carried. Mr. William Duguid, petitioner in ZBA B-V-?7, requested the Board to waive the requirement of readings of an ordinance since he could not secure a mortgage without passage of the ordinance granting the requested variation. Trustee Hendricks, seconded by Trustee Wattenberg, moved to waive the rule requiring two readings of an ordinance. Trustee Hendricks, seconded by Trustee Richardson, moved for passage of Ordinance No. 2761 (ZBA B-V-F?) AN ORDINANCE AMENDING ORDINANCE NO. 2715 Upon roll call: Ayes: Hendricks Minton Murauskis Richardson Wattenberg Nays: None Motion carried. Trustee Hendricks presented ZBA 49-V-77, 109 S. Busse Rd., Since a legal opinion had been rendered by the Village Attorney relative to this case, the Board requested time to review the opinion and vote on concurrence at the next meeting of the Village Board scheduled for February ?th. Trustee Hendricks reported on ZBA 58-V-77, B02 West Northwest Highway. Trustee Hendricks, seconded by Trustee Wattenberg, moved for Board concurrence with the recommendation of the Building Committee and Zoning Board of Appeals to grant the requested variations(ZBA 58-V-??). PG 4 1/17/78 Upon roll call: Ayes: H~d~icks Minton Murauskis Richardson Wattenberg Nays: None .~otion carried~ An ordinance granting certain variations for property commonly-known as B02 West Northwest Highway had its first reading, Trustee Minton stated he WOuld have to leave the meeting at this time but did give a statement on the proposed amendment to the Ethics Ordinance, which amendment was on the agenda. Trustee Minton noted that he would favor pledge signed by elected officials and not in the form of an,ordinance, as proposed, and urged the members of the Boardnot to pass the ordinance. 'Trustee Hendricks presented ZBA Cases 59-Z-??, 60-Z-??, and 62-Z-??, all of which were requests to rezone in order to comply with the zoning for self-service~gas stations. Trustee Hendricks, seconded by Trustee Richardson, moved to concur with the recommehdation of the Building Committee and Zoning Board of Appeals and grant the requested re- zoning in ZBA Cases 59-Z-??, 60-Z-??, and 62uZ-??. Upon roll call: Ayes: Hendricks Murauskis Richardson Wattenberg Nays: None Motion carried. Ordinances amending maps 43-N, 42-S, and BB-N had their first reading. The next case was ZBA 6B-V-??. Trustee Hendricks, seconded by Trustee Richardson, moved to concur with the recommendation of the Building Committee and Zoning Board of ApPeals to grant the requested variation in ZBA 6S~V~?? Upon roll call: Ayes: Hendricks Murauskis Richardson Wattenberg Nays: None Motion carried. An ordinance granting certain variations for p~erty located at 1001 Callero Drive had its first reading. Trustee Hendricks then presented ZBA Case 65-V-??,. 2~1-2~1 W. R~nd Road Trustee Hendricks, seconded by-Trustee Wattenberg, moved to concur with the recommendation of the Building Committee and Zoning Board of Appeals and grant the requested variation in ZBA 65-V-??. Upon roll call: Ayes: Hendricks Murauskis Richardson Wattenberg Nays: None Motion carried. Allan Miller, attorney for the petitioner, requested the Board waive the requirement for two raidings of an ordinance. Trustee Hendricks, seconded by Trustee Wattenberg, moved for passage of Ordinance No. 2762 AN ORDINANCE GRANTING CERTAIN VARIATIONS FOR PROPERTY LOCATED AT 201-241 WEST RAND ROAD Upon roll call: ~ Ayes: Hendricks Murauskis Richardson Wattenberg Nays: None Motion carried. JUDICIARY COMMITTEE An ordinance enacting strict controls over conflict of interest had its first reading. Mr. Ed Miller, 131 Kenilworth, spoke in support of the proposed amendment to the Ethics Ordinance. PUBLIC HEALTH AND SAFETY COMMITTEE Trustee Richardson, seconded by Trustee Murauskis, moved to concur with the recommendation of the Public Health and Safety Committee referring to the Intergovernmental Public Health Service and Agreement and authorizing the Mayor to sign the Agreement. Upon roll call: Ayes: Handricks Murauskis Richardson Wattenberg Nays: None Motion carried. OTHER BUSINESS Trustee Wattenberg, seconded by Trustee Richardson, moved for passage of Resolution No. 4-78 A RESOLUTION OPTING TO PROVIDE UNEMPLOYMENT COMPENSATION INSURANCE ON A REIMBURSEMENT BASIS Upon roll call: Ayes: Hendricks Murauskis Richardson Wattenberg Nays: None Motion carried. Trustee Wattenberg, seconded ~y Trustee Richardson, moved for passage of Resolution No. 5-78 A RESOLUTION AUTHORIZING THE EXECUTION OF AN AGREEMENT WITH THE FOREST RIVER FIRE PROTECTION DISTRICT Upon roll call: Ayes: Hendricks Murauskis Richardson Wattenberg Nays: None Motion carried. An ordinance increasing fees before the Zoning Board of Appeals had its first reading. ~Trustee Richardson seconded by Trustee Hendricks moved to waive the rule requiring two readings of an ordinance. Trustee Richardson, seconded by Trustee Hendricks, moved for passage of Ordinance No. 2763 AN ORDINANCE TO PROVIDE FOR PROCEDURES FOR THE ENTRY INTO AGREEMENTS FOR TH~ ANNEXATION OF NON- CONTIGUOUS PROPERTIES TO THE VILLAGE OF MOUNT PROSPECT Upon roll call: Ayes: Hendricks Murauskis Richardson Wattenberg Krause Nays: None Motion carried. Trustee Wattenberg, seconded by Trustee Richardson, moved to authorize the Mayor to sign and Clerk to attest her signature and accept the easement located at Well #16. Upon roll call: Ayes: Hendricks Murauskis Richardson Wattenberg Krause Nays: None Motion carried. Trustee Richardson, seconded by Trustee Hendricks, moved to authorize the Mayor to sign and Clerk to attest her signature on the Catholic Bishop of Chicago plat of subdivision (St. Thomas Becket Church, on Wolf Road), subject to any public improvement bonds. Upon roll call: Ayes: Hendricks Murauskis Richardson. Wattenberg Krause Nays: None Motion carried. COMMITTEE ANNOUNCEMENTS Trustee Richardson announced the Public Works Committee would hold the next meeting January 25th. ITEMS TO BE REFERRED The subject of burglar alarm fees for false alarms was referred to the Fire and Police Committee ADJOURNMENT Trustee Hendricks, seconded by Trustee Murauskis, moved to adjourn the meeting.
