IV. PROPOSED VILLAGE CODE MODIFICATIONS
Over the past several months, staff has worked with Village Attorney Everette Hill on a number of
amendments to the Municipal Code. These modifications are designed to either clarify existing Code
Sections or establish regulations or offenses that will assist in maintaining the favorable quality of life
in the community. Staff is now ready to bring these proposed Code amendments forward for Village
Board review and direction. The following is a synopsis of the recommended Code amendments:
1. Solicitation Ordinance
Trustee Wilks recently noted that differing portions of our regulations for solicitors were found in
different chapters of our Village Code. She suggested that it would make sense to put these
regulations in one place. This ordinance accomplishes that. Additionally, we've added ^seeking to
recruit membership for any organization of any kind or nature~ to the definition of solicitation. The
definition of ^solicitor-~ has also been simplified. The penalty has been raised from a range of $25.00-
$500 to a range of $200-$1,000.00 ... an attempt to more realistically cover our enforcement and
prosecution costs.
2. Seat Safety Belts.
This is an ordinance recommended by the Police Department. A subcommittee of state law
enforcement officials is requesting that municipalities recognize seat belt violations as primary
offenses. In other words, an officer may stop a motorist solely for failure to wear a seat belt. The
policy of the state law on this subject has been to write a ticket for a seat belt violation only if the initial
traffic stop was for another violation. As a home rule municipality, we have the right to legislate in
conflict with the state on this issue.

3. Obscene and Harassing Phone Calls.
There is currently a state law prohibiting obscene and harassing phone calls. The Police Department
has requested that we adopt our own ordinance on this subject to simplify and make more consistent
our prosecution of those offenses. Our ordinance is virtually identical to the state law, which makes
lewd, threatening or harassing calls illegal.
4. Ordinance Regulating Secondhand Dealers.
In March of 1998, we adopted an ordinance strictly regulating persons who dealt in secondhand gold
and silver jewelry and other objects. That ordinance established very restrictive licensing standards,
inspection standards, waiting period and daily reports of all transactions to the Police Department. Our
detective division has now requested that we expand our strict regulation of gold and silver dealers to
include dealers in any kind of secondhand goods (except those conducted by charitable or religious
organizations). The ordinance requires an annual $1,500 license fee.
5. Placement of Publication Vending Equipment on Public Property
As you are aware, we have set aside an area at the train station for newspaper vending machines. This
ordinance makes it unlawful and a nuisance to place such equipment outside that designated area.
It also permits the Village Manager to establish other rules for the placement, maintenance and care
of such equipment.
Mr. Hill, along with appropriate Village staff, will be in attendance to answer questions and facilitate
discussion.
