INVOCATION The invocation was given by Trustee Floros. COMMUNICATIONS AND PETITIONS CITIZENS TO BE HEARD Mayor Krause and Firefighter Lonnie Jackson, Public FIRE PREVENTION Education Officer for the Fire Department, presented AWARDS the annual awards to local school children for their Fire Prevention posters and essays. RECESS Mayor Krause called a brief recess at 8:25 P.M. while the audience in attendance for the presentations left the meeting. RECONVENE The meeting was reconvened at 8:31 P.M. Present upon roll call: Mayor Krause Trustees Arthur Farley Floros Murauskis Wattenberg Absent: Trustee Miller ~ROCLJM MAYOR'S REPORT HALLOWEEN Mayor Krause proclaimed Saturday, October 31,1981 as the official day to celebrate Halloween. PROSPECT HIGH Mayor Krause also presented a proclamation MARCHING BAND honoring the many awards earned by the Marching Band of Prospect High School. ENSE A request was presented for a Class "R" liquor REQUEST: license as submitted by Yasuke Corporation for ff~. a proposed restaurant at 1812 W. Algonquin Road. ' 1812 W. Algonquin Bernard Lee, Attorney for the petitioner, stated that petitioner and owner of the shopping center would comply with the Village requirements relative to re-aligning the parking lot in order to accommodate the required number of parking stalls, as well as petition for a zoning amendment from B-1 to B-3. Trustee Arthur, seconded by Trustee Wattenberg, moved to authorize the creation of a Class "R" liquor license for Yasuke Corporation, 1812 W. Algonquin Road, subject to the property ~-. receiving the B-3 zoning, occupancy certificates and complying with the requirements of the Village relative to parking. Upon roll call: Ayes: Arthur Farley Floros Murauskis Wattenberg Nays: None Motion carried. ~PPOINT: Mayor Krause requested concurrence with her THOMAS BORRELLI appointment of Thomas Borrelli, 252 Wimbolton Dr. PLAN COMMISSION to the Planning Commission, to fill the term of J. C. Busenhart, which expires May 1, 1984. Trustee Farley, seconded by Trustee Wattenberg, moved to concur with the appointment of Thomas Borrelli to the Planning Commission, term to expire May 1, 1984. Trustee Floros, seconded by Trustee Wattenberg, moved for passage of Ordinance No. 3149 ORD. NO. 3149 AN ORDINANCE GRANTING SPECIFIED VARIATIONS FORPROPERTY AT 621 N. MAIN ST. An Ordinance Amending Schedule IV of Chapter 18 AMEND CH. 18 (Traffic Code) had its first reading and will be SCH. IV. presented November 3 for second reading. Trustee Murauskis, seconded by Trustee Wattenberg, 21 moved for passage of Ordinance No. 3151 ORD. NO. 3151 AN ORDINANCE AMENDING SECTION 21.620 ENTITLED "PARKWAY TREE DEPOSIT" OF CHAPTER 21 OF THE VILLAGE CODE OF MOUNT PROSPECT Upon roll call: Ayes: Arthur Floros Murauskis Wattenberg Nays: Farley Motion carried. Trustee Murauskis, seconded by Trustee Wattenberg, AMEND CH. 16 moved for passage of Ordinance No. 3152 ORD. NO- 3152 AN ORDINANCE AMENDING CHAPTER 16 ENTITLED "DEVELOPMENT CODE" OF THE VILLAGE OF MOUNT PROSPECT Upon roll call: Ayes: Arthur Floros Murauskis Wattenberg Nays: Farley Motion carried. NEW BUSINESS An Ordinance Amending Article VIII of Chapter 4 AMEND CH. 4 Entitled "Department of Police" of the Village Code, COMMUNITY SERVICE providing for the establishment of Community Service OFFICER Officer, had its first reading and will be presented November 3 for second reading. An Ordinance Amending Article VII of Chapter 5 of the Village Code, expanding the authority of the F%RE ~ POLICE COM. Fire and Police Commission and establishing various RULES & REGULATIONS standards for promotions and selection procedures, had its first reading and will be presented November 3 for second reading. The following Zoning Board of Appeals recemmendations were presented: ZBA 17-A-81 and ZBA 18-SU-81, 217 N. Stevenson ZBA 17A-81 & This request represents a text amendment and special ZBA 18-SU-81 use to enable the petitioner to place a wind energy 217 N. Stevenson conversion system (115 foot windmill type structure) in the rear yard of the subject property. Trustee Murauskis, seconded by Trustee Wattenberg, moved to concur w~th the recommendation of the Zoning Board of Appeals and deny the requests under cases ZBA 17-A-81 and ZBA 18-SU-81. Upon roll call: Ayes: Arthur Floros Murauskis Wattenberg Nays: Farley Motion carried. It was noted that staff might want to research the feasibility of the various aspects of this type of request for future considerations. ZBA 19-SU-81 ZBA 19-SU-81, 1904 Cholo Lane 1904 CHOLO LANB This request is for authorization to operate Day Care Home a day care home in a residential area. Trustee Arthur, seconded by Trustee Murauskis, moved to concur with the recommendation of the Zoning Board of Appeals to grant the requested special use to operate a day care ~_~ home at 1904 Cholo Lane. Upon roll call: Ayes: Arthur Floros Murauskis Wattenberg Nays: None Abstain: Farley Motion carried. An ordinance will be prepared for first reading on November 3rd. ZBA 2 -~ ZBA 20-Z-81, 302 E. Northwest Hwy. 502 E. NORTHWEST HWY. This request comes to bring the established business into conformity with the zoning ordinance in order for the property owner to expand the service station, presently zoned B-3. Trustee Murauskis, seconded by Trustee Arthur, moved to concur with the recommendation of the Zoning Board of Appeals to grant a special use permit to allow this service station to operate in a B-3 zoning district and permit ~-~ the expansion of that business, and to initiate a text amendment to permit such a special use allowable in a B-3 district. Staff was directed to draft the necessary amendment to the Zoning Ordinance to allow for such special uses in a B-3 District. %j~ ZBA 21-V-81, 719 Dresser Drive 719 DRESSER DRIVE The petitioner is this case has requested a variation to allow expansion of an existing one-car driveway. Trustee Arthur, seconded by Trustee Wattenberg, moved to concur with the recommendation of the Zoning Board of Appeals to grant the requested variation. ZBA 22-A-81 ~.BA 22-A-81 This request, brought by staff, is to amend 6MEND ZONING ORD. the Zoning Ordinance to provide for a "zoning O~-,t-~h~r 20, ~981 ~ .... compliance fee. Trustee Murauskis, seconded by Trustee Wattenberg, moved to concur with the recommendation of the Zoning Board of Appeals to grant the amendment to Chapter 14 (Zoning Ordinance). Upon roll call: Ayes: Arthur Farley Murauskis Wattenberg Krause Nays: Floros Motion carried. An Ordinance will be drafted for first reading November 3rd. MANAGER'S REPORT Village Manager Terrance L. Burghard presented EMPLOYEE PARKING a brief summary of the employee parking situation, noting that in an effort to resolve the employee parking problem, he had entered into an agreement with Fannie May Candy Store (immediately south of the Village Hall lot) to allow 12 cars to park in their lot in exchange the Village would plow the Candy store lot during the winter months. It was noted that although parking arrangements have been made with the Mount Prospect Public Library for employee parking, several employees have experienced vandalism to their vehicles and some felt personnal fear being under the library building. Several Board members expressed concern about the Village plowing a private parking ~ lot (Fannie May). Trustee Murauskis, seconded by Trustee Arthur, moved to cancel the parking agreement with Fannie May Candy Store. Upon roll call: Ayes: Arthur Murauskis Krause Nays: Farley Floros Wattenberg Motion failed. Mayor Krause suggested that the Village staff presently authorized to park in the Village Hall lot park in the Fannie May lot, and the employees presently parking in the Fannie May lot park either under the library, on School Street (between Northwest Hwy. & Evergreen) or in the Maple Street Lot. It was the consensus of the Board that such a parking arrangement would be acceptable, and the Village would plow the Fannie May lot in exchange for such parking benefit. Trustee Farley, seconded by Trustee Wattenberg, moved to accept the low bid submitted by Milburn Bros. for the Prospect Avenue improvement, between Emerson and School Streets, in the amount of $133,970.70. NO. 3153 AN ORDINANCE TO AMEND SECTION 4.103 ENTITLED "POWERS AND DUTIES" PERTAINING TO THE PURCHASING POWER OF THE VILLAGE MANAGER, OF CHAPTER 4, ARTICLE I OF THE VILLAGE CODE OF MOUNT PROSPECT, ILLINOIS Upon roll call: Ayes: Arthur Farley Ftoros Murauskis Wattenberg Nays: None Motion carried. JOHN HEDSTROM Village Manager Burghard announced that DIR. OF John Hedstrom will begin employment with MANAGEMENT the Village as of October 26th as Director -~ of Management of Service, filling the ~--~. vacancy caused by Martha Peppler's resignation.
