September 15, I981 MAYOR'S REPORT pNITED WAY WEEK Mayor Krause proclaimed the week of September 13-20, 1981 as United Way Week and the FIRE PREVENTION week of October 4-10, 1981 as Fire Prevention Week. WEEK An Ordinance Amending Chapter 13, providing for the AMEND CH. 13 drinking age to be raised to 21 years of age, in accordance -' · ''- '- with State Statutes, had its first reading and will _~ge to 21 be presented October 6th for second reading. Ordinances authorizing the issuance of bonds for BOND_S_: S~P~E~J~gL SE21Ji%_C~ Special Service Areas 3 and ~ were presented for first readings. Trustee Floros, seconded by Trustee Farley, moved to waive the rule requ~iring two readings of an ordinance, in order to take action on the issuance of bonds for Special Service Area 3. NO. 3144_ Trustee Farley, seconded by Trustee Wattenberg, moved for passage of Ordinance No. 3144 AN ORDINANCE AUTHORIZING THE ISSUANCE AND SALE OF BONDS IN THE AMOUNT OF $50,000 FOR VILLAGE OF MOUNT PROSPECT SPECIAL SERVICE AREA NUMBER 4 Upon roll call: Ayes: Arthur Farley Floros Miller Murauskis Wattenberg Nays: None Motion carried. NEW BUSINESS THE ~DT.ONY: As discussed at the Committee of the Whole meeing held September 8th, a request was presented to extend the building permits for the townhouses at Old Orchard Colony. It was explained that due to financial conditions, the builder was unable to complete the specified project and inasmuch as Village Codes state that building permits are valid for a period of one year, the contractor has submitted the request for a time extension. The contractor also stated that as the existing units are sold, those monies will be put into the partially completed townhouses, being the subject of this request. Trustee Arthur, seconded by Trustee Farley, moved to authorize the time period for building permits for the townhouses at the Colony in the Old Orchard development for an additional year, to expire September 15, 1982. A resolution was presented that would authorize MFT an additional $4,325 for the previously approved traffic signal at Council Trail and Elmhurst Road COT~NCTI. TRAIL~ (Route 83) from MFT funds. It was stated that ST ROAD with this additional expenditure, the Village's TRAFFIC SIGNA~ share would total approximately $10,000 for this project. Trustee Floros, seconded by Trustee Farley, moved RE~. MO. ~4-~l for passage of Resolution No. 34-81 A RESOLUTION APPROPRIATING MFT FUNDS (Council Trail & Elmhurst Road traffic signal) Upon roll call: Ayes: Arthur Farley Floros Miller Murauskis Nays: Wattenberg Motion carried. JOHN'S PROPERTY the Committee of the Whole of September 8th, with the recommendation from the Zoning Board of Appeals to deny the requests. It was the decision of the petitioner that the requests might be amended and go back before the Zoning Board of Appeals for consideration. Residents of the area would be notified of any such amended request or new case date~, MANAGER'S REPORT BID: Village Manager Terrance Burghard presented bids PARKWAY TREES- received for parkway tree purchase and planting. PURCHASE & Two companies submitted bids on the various species, ~_L2kliT_ING complete bid tabulations are attached to these minutes. Trustee Arthur, seconded by Trustee Wattenberg, KLEHM'S moved to concur with the recommendation of the administration and accept the 1ow bids submitted by Klehm's Nursery, with the exception of the 25 Crimson King trees, for a cost not to exceed $21,981.25. Trustee Farley, seconded by Trustee Wattenberg, HALLORAN moved to accept the low bid submitted by Halloran T~AND~EAPIN~ Landscaping for 25 Crimson King trees at a cost not to be exceed $2,250.00. DONATION: Mr. Burghard presented a request received from Fire ~ TAN~ TRUCW FOR Chief Pairitz to authorize acceptance of a donation~~ FIRE DEPARTMENT from Shell Oil Company of a 1,200 gallon tank truck, FROM SHELL OIL It was noted that the Fire Department is in need of such a vehicle in order to effectively handle a fire situation at the tank farms. The piece of equipment offered by Shell Oil would serve that need, following minor repairs by the Fire Department personnel. Trustee Wattenberg, seconded by Trustee Arthur, moved to accept the donation of a 1,200 gallon GMC tank truck from Shell Oil, subject to final inspection by Chief Pairitz that it meets standards. ANY OTHER BUSINESS ZBA 14-A-81 ZBA 14-A-81, Maple Street Parking Lot (at Prospect Ave.) MAPLE STREET LOT This case went before the Zoning Board of Appeals to bring the Village owned parking lot at Maple Street and Prospect Avenue into conformance with the Zoning Ordinance. Trustee Miller, seconded by Trustee Arthur, moved to concur with the recommendation of the Zoning Board of Appeals and grant the requested re-zoning in ZBA 14-A-81 to P-2 zoning. Upon roll call: Ayes: Arthur Farley Floros Miller Murauskis Wattenberg Nays: None Motion carried. An ordinance will be drafted for first reading at the next Board meeting on October 6th. ZBA 15-V-81, 621 North Main Street ~BA 15-V-81 The petitioner in this case has requested a 621 NJ Main variation to allow two uses on one lot of record and variations from the number of parking spaces required along with a variation from the truck loading area requirement. Trustee Miller, seconded by Trustee Arthur, moved to concur with the recommendation of the Zoning Board of Appeals and grant the requested variations in ZBA 15-V-81. An Ordinance will be drafted to reflect the variations granted and will be presented October 6th for first reading. An Ordinance authorizing the vacation of a small ~ area of right-of-way at the intersection of DUNKIN DONUT'~ Busse Avenue/Wille Street/Northwest Highway was VA~ presented for first reading. This vacation, along DEDICATION with the dedication of another small area of the property known as the Dunkin' Donut property will be presented October 6th for approval. These actions are a part of the Busse/Wille improvement. Also in connection with the Buss~/Wille improvement, WILT,~'S RESUB a small area at the southeast corner of the 'Aldi' {_% building is to be dedicated to the Village. A plat of re-subdivision of the Wille's Re-subdivision was presented for Board approval. This plat provides for the dedication of that area as well as reflecting the lot lines for that subdivision. Trustee Wattenberg, seconded by Trustee Arthur, moved to authorize the Mayor to sign and Clerk to attest her signature on the Wille's Plat of Re-subdivision #2. Upon roll call: Ayes: Arthur Farley Floros Miller Murauskis Wattenberg Nays: None Motion carried. A plat of subdivision was presented for the Kensington KENSINGTON Center development. This plat would create a lot of CENTER RESUB record allowing for an additional 24 feet for the ~5_ Xytel Corporation lot, within the Phase II development. GAME MACHINES Mayor Krause asked the Board for their feeling on the number of game machines in the Village, with the possibility of placing a moratorium on issuing any more licenses for these machines. It was also noted that many establishments with liquor licenses have several games machines. It was the feeling of the Village Board that until a specific problem was experienced by having game machines, they saw no need for a moratorium at this time. Mayor Krause noted that she would research the subject of allowing game machines in establishments with liquor licenses. MOUNT PROSPECT Mr. Burghard noted that a neighborhood meeting ROAD IMPROVEMEN% had been held to inform those residents living along Mount Prospect Road, between Central Road and Northwest Highway, that the State has asked the Village to assume responsibility of that portion of Mount Prospect Road. tf the Village did assume responsibility of that road, the Village would improve it with curb, gutter and the residents had expressed concern and displeasure at the prospects of those improve- ments. A further status rep~ort will be given when a final decision has been made on this subject. ~ ADJOURNMENT Trustee Arthur, seconded by Trustee Wattenberg, moved to adjourn the meeting.
