INVOCATION INVOCATION The invocation was given by Trustee Farley. COMI~UNICATIONS AND PETITIONS - CITIZENS TO BE HEARD Mayor Krause brought up the request received from the Lions Club CIgNTRAL/BUSSE to conduct their annual carnival at the Central and Busse Roads RETENTION BASI} Retention Basin, which property is owned by the MSD. The staff CARNIVAL SITE had determined from MSD that such an event could beheld at that location however, the MSD would await a recommendation from the Village Board before ~'ranting'fihal aDproval on the site. The following residents spoke in opposition to the proposal: Joe Moore, 616 Prospect Manor Mr. Matousek, 16 N. Waverly Mrs. Scheib, 17 N. Kenilworth Steve Kelly, 110 N. Kenilworth Mrs. Pay-ne, 15 N. Kenilworth Mr. Bertone, 113 N. Kenilworth Mrs. Semicke, 11 N. Waverly Hank Freidrichs, representing the Lions Club, indicated on a map of the retention basin where the various events would be located noting that the fireworks display would also be fenced off. The administration outlined lhe various safety measures proposed for that area, including the closing of residential streets immediately east of the basin. PAGE 1 3/4/80 Trustee Wattenberg, seconded by Trustee Floros, moved to recommend to the MSD that they approve and grant permission to the Mount Prospect LionS Club to hold their carnival at the Central - Busse Road Retention Basin July 2 - July 6, 1980, including a permit for a fireworks displ'ay. RANDVIEW/ Chuck Peterson, 606 Prospect Manor, expressed appreciation HIGHLAND to Board for the meeting held March 1st emd the assurance FLOODING given by the Board that no future storm water connections would be made to the Randview/Highland system. A Resolution will be presented at the March 18th Board meeting to that effect. MANAGER'S REPORT ELK GROVE Village Manager Burghard presented a report on the relocation YOUTH SERVICES - of the Elk Grove Services from the Village owned building at 100 E. NORTHWES~ 100 East Northwest. Mr. Burghard explained that the present HIGHWAY building is beyond repair and is proposed for demolition., The Elk Grove Youth Services have located a house on Golf Road just west of Elmhurst Road and since they will have to pay rent, have requested financial assistance from the Village. A further report on this subject will be presented March 18th. MFT - 1978 ~UDIT Mr. Burghard presented the 1978 MFT Audit submitted by the Illinois Department of Transportation. Trustee Floros, seconded bY Trustee Farley, moved to acknowled receipt of the 1978 MFT Audit and place it on file. Upon roll call: Ayes: Farley Floros ' Miller Wattenberg Nays: None Motion carried. WELL #11 - The Village Manager presented the proposal to have emergency Expenditure repairs made to Well #11 (located on the Mount Prospect Golf Course) Trustee Farley, seconded by Trustee ]^,~attenberg, moved to authorize the administration to proceed with the repairs to Well ~11 by awarding the contract to Chicago Bridge & Iron Co. in an amount not to exceed $12,000. BUDGET 80-81 Mr. Burghard distributed the proposed 1980-81 budget, noting that the first budget hearing will be March 12 at 8:00 P.M. in the Board Room of the Public Safety Building. M~hYOR' S REPORT PROCLAMATION - Mayor Krause proclaimed the month of March, 1980 as Camp Fire CA~p FIRE Service 5~onth. SERVICE MONTH Mayor Krause referred the subject of budget preparation to the BUDGET PROCESS Finance Committee to determine if and how the process could be improved. The Mayor also noted that Com~nittee members should be rotated CC?,~MITTEE and requested the members of the Board to inform her if there ASSIG~EN~S is a particular Committee they would like to be on in order that the new assignments could be made by 5{ay 1st. PAGE 2 3/4/80 COMMITTEE REPORTS BUILDING COMMITTEE Albert Street Walkway Vacation Trustee Flores, seconded by Trustee Farley moved for passage of Ordinance No. 298S, and that the adjoining residents pay the SOUTH ALBERT ST administrative costs totally $115 each for the vacation of the WALKWAY walkway. The Ordinance will be presented March 18th for second reading. ZBA l-A-80 - ZBA l-A-80, Text Amendment to Zoning Ordinance AMEND CH. 14 Trustee Floros presented An Ordinance Temporarily Suspending the Reclassification.of Zoning Districts for first reading with the second reading to take place March 18th. FINANCE COMMITTEE SPECIAL SERVICE Trustee Miller, seconded by Trustee Farley, moved to waive AREA NO. TWO - the rule requiring two readings of an ordinance relative to BLACKHAWK the creation of Special Service Area Number Two. Upon roll call: Ayes: Farley Floros g{iller Wattenberg Krause Nays: None Motion carried. _ORD. 2987 Trustee Miller, seconded by Trustee Wattenberg, moved for passage of Ordinance No. 2987 AN ORDINANCE PROPOSING THE ESTABLISHMENT OF VILLAGE OF MOUNT PROSPECT SPECIAL SERVICE AREA NUMBER TWO AND PROVIDING FOR A PUBLIC HEARING AND OTHER PROCEDURES IN CONNECTION THEREWITH Upon roll call: Ayes: Farley Floros Miller Wattenberg Krause Nays: None Motion carried. FIRE AND POLICE COlVIMITTEE ALAR~ SYSTEMS - The Fire and Police Committee's recommendation relative to AMEND CH. 24 establishing requirements for alarm systems was discussed. ARTICLE XIV Mr. Keefer, 15 N. Waverly, expressed his opposition to the proposal. Trustee Floros, seconded by Trustee Farley, moved to concur with the recommendation of the Fire and Police Committee to establish certain requirements for alarm systems. An Ordinance Establishing Requirements for Alarm Systems had its first reading and will be presented g~!arch 18th for second reading. . M .E .R.I .T. Trustee Farley, seconded by Trustee Fioros, moved to bring .PROGRAM an item to the floor not listed on the agenda, being the subject of the M.E.R.I.T. Program. Trustee Farley requested the Village Board to yo on record as indicating their intent to join the M .E .R .I.T. Program. Following discussion, the Village Attorney was directed to draft a Resolution of intent to join the M .E .R .I .T. Program to be presented March 18, which resolution will contain such wording' to the effect that the Village will become a member of the M.E .R.!.T. Program subject to the Boards approval of the By-Laws of that joint venture. Trustee Wattenberg presented An Ordinance Amending AMEND CH. 11 - Article XI of Chapter 11 of the Municipal Code (Taxi-cab Taxi-Cab Ord. regulations) for first reading, with the second ,reading to take place 'March 18. Trustee Wattenberg, seconded by Trustee Farley, moved AMEND CH. 18 - for passage of Ordinance No. 2989 TRAFFIC CODE AN ORDINANCE AMENDING THE TRAFFIC CODE ORD. 2989 Upon roll call: Ayes: Farley Floros Miller Wattenberg Nays: None Motion carried. A status report was given on the following subjects: Bicylce Safety for Commuters IRMA Proposal to allow for "No Smoking" areas in restaurants Proposed amendment to pick-up days for garbage collection PAGE 5 3/4/80 OTHER BUSINESS An Ordinance Involuntarily Annexing to the Village of Mount PROPOSED Prospect Land Lying in Section 27, Township 42 North, ANNEXATION - Range 11 East of the Third Prinipal Meridian in Cook County, Illinois was continued to the triarch 18th Board meeting. S/E CORNER RAND & i{UCLID Village Attorney Marlin Smith gave a history and status report on litigation known as the MSD Sewer Rate Case. MSD SEWER RATE Trustee Miller, seconded by Trustee Floros, moved to ~CASE authorize the law firm of Ross, Hardies, O'Keefe'; Babcock and Parsons to file an Appeal on behalf of the Village in MSD Sewer Rate Case. Upon roll call: Ayes: Farley Floros Miller Wattenberg Krause Nays: None Motion carried. Mr. Smith then gave a brief status report on the I. Gordon vs. Mount Prospect (Knights of Huntington) case. The Village Attorney announced that the court had reached a decision in the Metropolitan Housing Development Corp. vs. LINCOLN/GREEN LAW SUIT Arlington Heights and Mount Prospect (Lincoln Green, subject property located immediately west of St. Cecilia's Subdivision at Golf Road) noting that the decision was not in favor of the Village of B{ount Prospect. Trustee Miller, seconded bY Trustee Floros, moved to authorize the law firm of Ross, Hardies, O'Keefe, Babcock and Parsons to file a Petition for re-Hearing with the suggestion to be heard en bane in the Metropolitan Housing Development Corp. vs. Arlington Heights and Mount Prospect law suit.
