INVOCATION INVOCATION The invocation was given by Trustee Farley. Ervin Villie MAYOR'S REPORT PROCLAMATIONS: Mayor Krause proclaimed April 22, 1982, as ~J~ Girl Scout Leaders Day; April 30, 1982, as LEADERS; Arbor Day; and May 3 - 8, 1982 as Firefighters .2k~D~D2k~_; Recognition Week. ~IREFIGHTERS ~ Mayor Krause also announced that the Police Department would hold their annual Open House on May 1, Law Day. OLD BUSINESS ~ ZBA 1-A-82, Text Amendment AME~LD~ An Ordinance amending the Zoning Ordinance relative to amusement devices and game rooms was presented for 2nd reading. Terry Gold of Just Games requested the area required for an amusement device be reduced from 40 sq. ft. to 32 sq. ft. It was suggested that if the required area was not sufficient for their operation, then an application for variation from the Zoning Ordinance could be sought at a later date. ORD. NO.3203 Trustee Farley, seconded by Trustee Arthur, moved for passage of Ordinance No. 3203 AN ORDINANCE AMENDING CHAPTER 14 OF THE ZONING ORDINANCE Upon roll call: Ayes: Arthur Farley Murauskis Krause Nays: Floros Wattenberg Motion carried. April 20, 1982 Page Two Trustee Wattenberg, seconded by Trustee Arthur, ~ moved for passage of Ordinance No. 3204 24 AN ORDINANCE ~ENDING CHAPTER 18 ENTITLED "TRAFFIC CODE" OF THE VILLAGE CODE Upon roll call: Ayes: Arthur Farley Floros Murauskis Wattenberg Nays: None Motion carried. Inasmuch as the preceding ordinance amended the notice provisions and not the initial fine for violating the fire lane requirements, an ordinance amending Chapter 21 was not necessary. Trustee Arthur, seconded by Trustee Murauskis, .~END CH. 17 moved for passage of Ordinance No. 3205. ORD. NO. 3205 AN ORDINANCE AMENDING CHAPTER 17 ENTITLED "VEHICLE LICENSES" OF THE VILLAGE CODE Upon roll call: Ayes: Arthur Farley Floros Murauskis Wattenberg Nays: None Motion carried. Trustee Arthur, seconded by Trustee Murauskis, AMEND CH. 20 moved for passage of Ordinance No. 3206. ORD. NO. 3206 AN ORDINANCE AMENDING CHAPTER 20 ENTITLED "ANIMALS" OF THE VILLAGE CODE Upon roll call: Ayes: Arthur Farley Floros Murauskis Wattenberg Nays: None Motion carried. The Public Hearing on the proposed Annexation LINCOLN CIRCLE ANNEXATION Agreement for Lincoln Circle Estates, as well as A Resolution Authorizing Execution of an Annexation Agreement, An Ordinance Annexing and An Ordinance Granting Specified Variations, all pertaining to Lincoln Circle, were continued to the May 4th Village Board meeting. MANAGER'S REPORT Village Manager Terrance L. Burghard presented a Resolution to transfer funds within various accounts for the 1981-82 budget. Trustee Floros, seconded by Trustee Murauskis, moved PJES. NO. 37-82 for passage of Resolution No. 37-82 A RESOLUTION MAILING CERTAIN APPROPRIATION TRANSFERS WITHIN THE ANNUAL BUDGET APPROVED FOR FISCAL 1981-82. . Upon roll call: Ayes: Arthur Farley Floros Murauskis Wattenberg Nays: None Motion 6arried. Mr. Burghard presented the proposed budget for ~.' 1982-83 fiscal 1982-83. A request was received from the Chamber of Commerce to allocate $3,000 for a re-printing and update of the booklet about the Village. NO. 38-82 moved for passage of Resolution No. 38-82 A RESOLUTION ADOPTING THE ANNUAL BUDGET FOR FISCAL 1982-83. Upon roll call: Ayes: Arthur Farley Floros Murauskis Wattenberg Nays: None Motion carried. .BIDS: The Village Manager presented the bid results SCHOOL & BERKSHIRE for replacement of curbs, gutters, storm sewers, IMPROVEMENT~ sidewalk, and ~avement at School Street and Berkshire Martam Construction $ 8,968.00 Nagel Excavating, Inc. 9,543.60 D'Addosio Construction 10,491.20 Schroeder & Schroeder 11,567.60 Paolo Construction 12,999.50 Globe Construction 13,021.20 MART~4 CONST. Trustee Floros, seconded by Trustee Wattenberg, moved to accept the low bid submitted by Martam Construction for the stated improvements at School Street and Berkshire,in an amount not to exceed $8,968.00. P~EPAIR WATER Mr. Burghard presented a request to authorize STORAGE TANK an expenditure for the repair of the water storage tank (Northwest Highway and Maple Street STEEL MAINTENANCE Trustee Wattenberg, seconded by Trustee Floros, CORP. moved to ratify the action taken by the Village Manager to authorize the necessary repairs to the water storage tank, which repairs will be performed by Steel Maintenance Corporation at a cost not to exceed $4,300. The Village Manager announced that maps for the route to be taken for Lake Michigan water have been received by his office. NEW BUSINESS ZBA 25-Z-81 ZBA 25-Z-81, 1740 West Dempster Street 1740 W,DEMPSTER This request was submitted to re-zone the property from B-3 to B-4. Inasmuch as the property had been a service station, not occupied for over 6 months, the gasoline tanks had been removed and permits were requested. The Zoning Board recommended the property remain B-3 with a special use be granted to operate a service station. Trustee Arthur, seconded by Trustee Murauskis, moved to concur with the recommendation of the Zoning Board of Appeals to grant a Special Use to the subject property in order to operate a service station. Pa~e Four An Ordinance will be drafted for firs~ reading May 4th. ~BA 2-SU-82 ZBA 2-SU-82 and ZBA 3-V-82, Rand & Elmhurst, McDonald's McDonalds This request consisted of special use for a drive-thru Z~2~__3_mY_r_82 window and several variations: to permit a t0' x 30' truck load space instead of the required 10' x 50'; to eliminate the required 20' rear yard; and recognition of the encroachment of the existing building into the rear yard. Trustee Farley moved to prohibit left turns from the eastern driveway from McDonald's onto Rand Road. The motion failed for lack of a second. Trustee Arthur, seconded by Trustee Murauskis, moved to concur with the recommendation of the Zoning Board of Appeals to grant the special use for a drive-thru window. Upon roll call: Ayes: Arthur Farley Floros Murauskis Wattenberg Nays: None Motion carried. Trustee Wattenberg, seconded by Trustee Floros, moved to concur with the recommendation of the Zoning Board of Appeals and grant the requested variations. Upon roll call: Ayes: Arthur Farley Floros Murauskis Wattenberg Nays: None Motion carried. Ordinances reflecting the above action will be drafted for the May 4th meeting. ZBA 4-V-82, 1310 River Road ZBA 4-V-82 This case was continued at the Zoning Board of 1310 River Rd Appeals level. ZBA 5-V-82, 310 West Northwest Highway (Winklemans) ZBA 5-V-82: This request for variation was received inasmuch as 310 Northwe~ the petitioner desires to change' the sign for the ~Hwy. brand of gasoline sold and the sign exceeds the allowable dimensions. Robert Moore, petitioner's attorney, presented the request, stating that the petitioner will make every attempt to provide some type of beautification. Trustee Arthur, seconded by Trustee Farley, moved to concur with the recommendation of the Zoning Board ©f Appeals and grant the requested variation.
