INVOCATION INVOCATION The invocation was given by Trustee Farley. OLD BUSINESS J~ ZBA 30-A-81, Text Amendment Amend Ch. 14 Trustee Floros, seconded by Trustee Arthur, moved for "Zoninq" passage of Ordinance No. 3184. ORD. NO. 3184 AN OPJ)INANCE AMENDING CHAPTER 14 ENTITLED "ZONING ORDINANCE" OF THE VILLAGE CODE REGkRDING THE ESTkBLISHM_ENT OF AUTOMOBILE SERVICE STATIONS AS A SPECIAL USE IN B-3 DISTRICTS Upon roll call: Ayes: Arthur Farley Floros Murauskis Nays: None Motion carried. DISTRIBUTION The Village Manager, Terrance L. Burghard distributed PROPOSED BUDGET ~-$~ the proposed budget for 1982-83 fiscal year. NEW BUSINESS ~END CH. 18 Trustee Farley, seconded by Trustee Floros, moved to ~ROHIBIT PARKIN~ concur with the Safety Commission's recommendation to 0~.WEST SIDE prohibit parking on the west side of Wheeling Road, OF WHEELING approximately 150 feet north of Kensington Road. An Ordinance will be presented for 1st reading on February 16, 1982. _~M~ND CH. 18 Trustee Farley, seconded by Trustee Floros, moved to ~--- NO LEFT TUI~N concur with the Safety Commission's recommendation to prohibit left turns for northbound traffic from Emerson Street onto Central Road which recommendation was a~ended to enclude the provision of No Left Turn from 4 PM to 6 PM. An Ordinance will be presented for 1st reading on February 16, 1982. k~LEND CH. 23.3 An Ordinance A~ending Article III of Chapter 23 entitled 'PARENTAL P~ESPON." "Trespass" of the Village Code, had its first reading and will be presented February 16,-1982 for 2nd reading. This ordinance provides for a stricter 'parental responsibility' section of the Code. CLOSING BOND An Ordinance was presented that would close the bond accounts ~CCOUNTS established by Ordinance No. 745. Trustee Murauskis, seconded by Trustee Farley, moved to waive the rule requiring two readings of an ordinance in order to take action on the proposed ordinance. MANAGER'S P~PORT Village Manager Terrance L. Burghard presented the proposed IRMA amendments for IRi~A notifications. The members of IR/~A have suggested an amendment of the by-laws to require notication prior to law suits being filed. Trustee Floros, seconded by Trustee Murauskis, moved to authorize the manager to vote infavor of version 92 (Proposed Amendments attached to these minutes) at the next IRMA meeting. Upon roll call: Ayes: Arthu~ Farley Floros Murauskis Nays: None Motion carried. ~ OTHER BUSINESS Trustee Arthur brought up the subject of solid waste, as being SOLID WASTE studied by NWMC. Trustee Arthur, seconded by Trustee Floros, moved to authorize an expenditure of $7,000 as the Village's share of the Consultants study of solid waste. Fields Page 3 Village Clerk (Version 1) A~MENDMENT TO CONTRACT .hued BY-LAWS CF THE INTERGOVERNMENTAL RISK M' NAG'-V=::~ AGENCY AMENDMENT TO ARTICLE XI Subsection (h) Section (h) shall be amended to hereinafter read as follows: (h) To report to the AGENCY in accordance with the schedule set out in this section all incidents which could result in the AGENCY being required to consider a claim for casualty losses to muni- cipal property or injuries to persons or property within the scope of loss protection undertaken by the AGENCY. IR~ will provide no coverage or defense in the event that a MEMBER does not furnish to the AGENCY notice of any claim within at least 60 days after an officer or employee of the b~EMBER has learned of an incident as described above. will provide no coverage or defense where any summons and complaint or a petition before the Illinois Industrial Commission is received by an officer or employee of the municipality and such written document is not furnished to the AGENCY within 30 days after its receipt. ~ NU}~BER 19 ~MENDM_NT Passed by the 3oard of Directors of I~.~ at a meeting held on the day of ~ , 19 (Version 2) kMENDMENT TO CONTRACT AND BY-LAWS OF THE INTERGOVERNMENTAL RiSK MANAGEMEXT AGENCY AMENDMENT TO ARTICLE XI Subsection (h) Section (h) shall be amended to hereinafter read as follows: (h) To report to the AGENCY as promptly as possible all incidents which could result in the AGENCY being required to consider a claim for casualty losses to municipal property or injuries to persons or property within the scope of loss protection undertaken by the AGENCY. In the event that notice of such an incident is not furnished to the AGENCY within 60 days after an officer or employee of the MEMBER has learned of the incident or within 30 days after an officer or employee of the MEMBER has received a summons and complaint or a petition before the Illinois Industrial Commission, the Board of Directors of the AGENCY, by a vote of a majority of a cuorum of the Board, at a regular or special meeting, may in whole or in part decline to provide a defense to the MEMBER or to extend the funds of the AGENCY for the payment of losses or damages incurred. In reaching its decision, the Board shall consider whether and to what extent the AGENCY was prejudiced in its ability to investi- gate and defend the claim due to the failure of the MEMBER to promptly furnish notice of the claim to the AGENCY. In the absence of fraud or a gross abuse of discretion, the decision of the Board of Directors shall be final and the MEMBER shall not seek a modification of the decision of the Board in any othe~ forum.
