COMMUNICATIONS AND PETITIONS, CITIZENS TO BE HEARD ELIZABETH Village Manager Terrance L. Burghard introduced Elizabeth KROMER: Kromer who will be assuming the new position of Administrative PUBLIC Aide to the Director of Public Works. WORKS MAYOR'S REPORT Mayor Krause presented a Certificate of Merit to John Zolnier.CER~IFICATE Mr. Zolnier was responsible for putting out a trash can fire OT MERIT: in the Senior citizen Center, which fire could have caused JOHN ZOLNIER Considerable damage if he hadn't been for Mr. Zolnier's quick action. The Village Board commended him for his efforts. PROCLAMATIONS: Mayor Krause proclaimed the week of May 6 - 11, 1985 as FIREFIGHTERS RECOGNITION WEEK. Various activities will be FIREFIGHTERS held at the Randhurst Shopping Center during the week. RECOGNITION WEEK A proclamation was also presented proclaiming the week of May 19 25, 1985 as PUBLIC WORKS WEEK. An open house with PUBLIC WORKS WEEK equipment on display and refreshments will be conducted on Saturday, May 18th between the hours of 9 A.M. and 1:00 P.M. Mayor Krause proclaimed the month of May, 1985 as SPECIAL SPECIAL OLYMPICS MONTH in the Village, honoring both Participants OLYMPICS and those involved with the event for the 'special' MONTH residents of the area. Police Officer Andy Toth, President of the Mount ProspeCt POLICE Police Association and Mayor Krause presented awards to ASSOC. ' the winners of the 3rd grade classes for their anti- POSTER vandalism posters. Savings Bonds were presented to the AWARDS winners. Everett Hill, Village Prosecutor, presented a report on DUI p ....... i^Nthe recent court proceedings on Drivin~ While Under the n~luence (DUI) Ora!nance. Mr. Hill stated that he has followed the village policy of actively pursuing these cases with little to no 'plea bargaining', however, local DUI cases have recently been assigned to the Harwood Heights Court Room, which could eause additional expense to the Village. It was explained that the Police Officer involved, the witnesses and all those involved with each individual case would be required to appear in Harwood Heights when ever their particular case is scheduled. While Mr. Hill recommended the continued practice of actively seeking maximum penalties for this offense, he requested discretion in 'plea bargaining'. It was the concensus of the Village Board that the Village Prosecutor be given a certain amount of discretion on a case by case basis, relative to DUI violations. OLD BUSINESS ZBA 3-A, ZBA 3-A, 22'SU and 5-V-85, Kinder-Care Learning Center 22-SU & 5-V-85 This case deals with a request for a text amendment to the Zoning Ordinance to permit a day care center as a Special KINDER CARE Use when located within a Planned Unit Development; a Special Use to permit their facility as part of a Planned Unit Development at the northeast corner of William Street and Golf Road; a variation to permit parking in the required side yard; and a variation to allow a fence to extend in front of the building line. The Zoning Board of Appeals recommended denial of these requests. Sandra Birdsali, attorney for the petitioner, stated that in her opinion, the Zoning Board of Appeals did not address the fact that the subject parcel is a difficult piece of land to develop, since Kellens Florist/Nursery was only selling a portion of the property at this time. A brief history was given of the property and the case. Mayor Krause stated that the petitioner had not demonstrated sufficient evidence to warrant a commercial venture in a residential area, and given that fact the other requests involved with this case would be void. Trustee Murauskis, seconded by Trustee Wattenberg, moved to concur with the recommendation of the zoning Board of Appeals in Case No. ZBA 3-A-85, which was to deny the request for text amendment. Trustee Murauskis, seconded by Trustee Wattenberg, moved to concur with the recommendation of the Zoning Board of Appeals in Case No. ZBA 22-SU-85, which was to deny the special use requested. Page 2 Trustee Arthur, seconded by Trustee Murauskis, moved ZBA 5-V-85 to concur with the recommendation of the Zoning Board KINDER CARE of Appeals in Case No. ZBA 5-V-85 relative to a variation to permit parking in the side yard & to permit a fence to extend beyond the building line, which recommendation was deny the requests. The existing ILLEGAL contract called for inspections not to exceed a total of CONNECTIONS $34,500, however due to weather related problems the work was not begun during the 1984-85 fiscal year. The 1985-86 budget provides for inspections not to exceed $40,000, therefore it is proposed that the contract executed in 1984 be amended to include the additional inspections in 1985 at a total expenditure not to exceed $80,000. Trustee Arthur, seconded by Trustee Farley, moved to authorize execution of a contract between the Village and Donohue Engineering for the inspection of illegal connections at a cost not to exceed $80,000. ZBA 9-V-85 ZBA 9-V-85, 709 Noah Terrace 709 NOAH ~C An Ordinance was presented for first reading that would grant a variation to permit a driveway to a single family home to be 24% feet wide, rather than the permitted 18 foot width. At the request of the petitioner, Trustee Van Geem, seconded by Trustee Murauskis, moved to waive the rule requiring two Page 3 May 7, 1985 readings of an Ordinance. This Ordinance will be presented May 21st for second reading. ZBA 15-V-85 ZBA 15-V-85, 315 Marcella Lane An Ordinance granting a variation to permit a floor area 315 MARC~A ratio of .41 instead of the permitted .35 was presented LANE for first reading. ZBA 16-Z-85 ZBA 16-Z-85, Gettysburg Subdivision, West Lincoln Street GETTYSBUtqG SUB. An Ordinance was presented for first reading that would (W. LINCOLN ST.) re-zone this 7½ acre parcel from R-X to R-1. The petitioner proposed building 19 single family homes on this site. There still remains the final decision on the design of a retention area for the parcel. This Ordinance will be presented May 21st for second reading. NEW BUSINESS ZBA 10-V-85, 2013 East Euclid Avenue ZEA 10-V-85 This case deals with a request for variations to allow 2013 E.EUCLID parking in 18 of the required 30 foot front yard and to permit a driveway 2 feet into the required 10 foot side yard. The Zoning Board of Appeals recommended by a vote of 4-2 to grant the front yard variation however recommended denial of the driveway variation request by a unanimous vote. "Mr. Ray Naegle, petitioner and Mr. James Ray, archetect, presented their case, stating the property is zoned B-3 and the petitioner would like to build one building with 4 stores to be located in the building. It is proposed that the parking be in the front yard and that the building setback be the same as the small shopping area immediately east of the subject property. The petitioner stated that possible uses for these stores could be a gift store, real estate office, etc. The following residents voice their concern and opposition to the proposal: Paul Donavan, 2016 Ivy Lane Resident, 2009 E. Euclid Dan Dubrei, 2011 E. Euclid. John Hindman, 2012 Ivy Lane Management Agent, 1720 W. Algonquin Road, Mount Prospect The concerns expressed by the neighbors were as follows: Security of the surrounding property from people crossing their property and climbing fences; Impact of traffic on Euclid; Additional curb cuts on Euclid with cars entering and exiting the subject property; Privacy Screening between the commercial and residential (hedges, berming, fences) Since there seemed to quite a few areas of concern; the petitioner was requested to work with staff and possibly Page 5 May 7, 1985 design the proposal or address some of the concerns expressed by the residents. This case is continued to the May 21st meeting of the Village Board at which time the petitioner could proceed with his original request or present an amended proposal. ZP~A14-SU-85 - ZBA i4-SU-85, 1509 Mura Lane 1509 MURALN The case deals with a request for a Special Use t~ allow a satellite dish in a single family district. The Zoning Board of Appeals recommended approval of this request by a vote of 5-0. It was noted that the subject satellite dish was erected without permit and that the contractor was taken to court on an Ordinance violation complain~ and the court assessed an $1,800 fine. The staff has stated that the dish is not located in the appropriate place and that the petitioner has to provide some type of landscape screening. The Petitioner stated that he would comply with all the requirements, of the Village. Trustee Farley, seconded by Trustee Wattenberg, moved to concur with'the recommendation of the Zoning Board of Appeals subject to the petitioner complying with Village requirements relative to placement of dish and landscaping. ZBA 19-Z-85 ZBA 19-Z-85, 600 East Rand Road 600 E.RAND RD. The petitioner is requesting the subject property be re-zoned from R-1 to B-3 in order to operate a florist/ nursery. It was noted that the subject property is located jUst weSt of Business Center Drive on Rand Road and is an abandoned building. The petitioner stated that it is unlikely anyone would build a single family home in the present zoning and that he would like to open this type of business. Trustee Arthur, seconded by Trustee Farley, moved to concur with the recommendation of the Zoning Board of Appeals and grant the requested B-3 zoning. ZBA 20-A-85 & ZBA 20-A-85 and ZBA 21-SU'85, Colony Apartments ZBA 21-SU-85 These requests are for a text amendment to permit 2 satellite dishes on one lot of record in an R-4 District as a Special Use and a request for a Special Use in order COLONY APTS. to locate 2 Satellite dishes within the Colony Apartments, Oakton Street and Elmhurst Road. The Zoning Board of Appeals recommended denial of the requests. It was stated by the Petitioner that the proposed dishes would occupy 4 parking places, which are presently housing 2 large dumpsters. Mr. Ron Koch, representing the management of the Colony Apartments, stated that the area in which the dishes are proposed to be located has no parking problem and that losing the 4 spaces would not ~May 7~ 1985 Page 6 create a hardship for the ~enants. It was noted that there are 1,174 parking spaces With 783 units. It was suggested that upon reviewing the existing parking situation at this complex, the Village Manager could possibly grant a field change, which would be presented to the Village Board for ratification. This matter was continued to the next meeting, May 21st, when a determination will be made. ZBA 18-V-85, 1007 Cardinal Lane ZBA 18-V-85 The petitioner in this case has requested a variation to 1007 CARDINAL ~ permit a floor area ratio of .41 instead of the permitted .35. The petitioner would like to have an addition built which would increase the floor area ratio to .41. The Zoning Board of Appeals recommended to approve this variation by a vote of 6-0. Trustee Arthur, seconded by Trustee Wattenberg, moved to concur with the recommendation of the Zoning Board of Appeals in Case ZBA 18-V-85, and g~rant the requested variation. A Resolution was presented that would renew the annual N.W.COMMUNIT% agreement with the Northwest Community Services, Inc. to SERVICES,INC provide transportation for the elderly and disabled low and moderate income residents. The subject property is located at Sha Bonee and Hi Lusi. The Plan Commission recommended approval of the subdivision. This property, located at Burning Bush and Euclid Avenue, is presently 2 large single family lots and it is proposed to subdivide into 4 smaller lots. Two single family homes exist on the property. The petitioner has requested relief from requirements of the Development Code that require sidewalks, parkway trees and a street light. The petitioner stated that he and his family plan to develop this property and the expense of installing a street light as well as bringing water and sewer service to the 2 vacant lots that would be created by the subdivision would be too expensive. The Plan Commission recommended denial of the request for relief on installing parkway trees; recommended approval of the request for relief from installing sidewalks; and recommended denial of the request for relief from installing a street light. The opinion of the Village Board was to concur with the Plan Commission, and as such, the petitioner withdrew his request for the subdiviSion.
