COMMUNICATIONS AND PETITIONS CITIZENS TO BE HEARD Jack Keefer expressed the appreciation of the VFW for M~ the Village's support and announced that the annual p~ Memorial Day Parade, sponsored by the Mount Prospect VFW, would take place on May 27 at 9:30 A.M. Mr. Keefer also stated that the VFW members would be conducting their PO~ annual Poppy Day fund raising drive on May 17th. HISTORICAL Mary ~ager, President of the Mount Prospect Historical SOCIETY Society expressed the appreciation of the Society for the support the Village has giveD zn the proposed budget. MAYOR'S REPORT "CY" THOMAS Mayor Krause presented a Resolution extending the condolences of the Village Board to the family of Cy Thomas. Cy Thomas, who recently passed away, was a great supporter of the Village, particularly projects ~ involving senior citizens. The Resolution presented reads as follows: WHEREAS~ Alton J. "Cy" Thomas served his fellow citizens as a community leader for many years in the Village of Mount Prospect; and WHEREAS, "Cy" Thomas was active in the senior citizen programs of Mount Prospect and was instrumental in having a building dedicated for the use of senior citizens in the Village of Mount Prospect; and WHEREAS, the Driver's Refresher Program was initiated by "Cy" Thomas over 10 years ago in order to assist his fellow ~itizens prepare to obtain or renew their drivers licenses; and WHEREAS, "Cy" Thomas was one of the founders of. the Mount Prospect Men's Club, was a supporter of local civic organIzations including the Mount ProspeCt Jaycees Sandbox Day activities; and W~.EREAS, "Cy" Thomas was always willing to assist -anyone who was in need, such as delivering meals, providing transportation, delivery and pickup of hospital equipment for homebound residents; and WHEREAS, the family, friends, and the community as a whole is saddened by the sudden passing of "Cy" Thomas. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: That the sympathy of the Village of Mount Prospect be and the same is hereby expressed to the family of Alton J. "Cy" Thomas. SECTION TWO: That this Resolution be spread across the minutes of the Hoard of Trustees of the Village of Mount Prospect and that a copy be forwarded to Mrs. Alton Thomas. SECTION THREE: That this Resolution shall be in full force and effect from and after its passage and approval in the manner provided by law. NATIONAL~ An Ordinance was presented for 2nd reading that would change the classification of liquor license for Pizza AMEND CH. Hut on Algonquin Road from a Class "B" to a Class "R" PIZZA HUT and also creates one additional Class "S" liquor license BO J~ES fo~ a new restaurant to be opened within Randhurst to be known as Bo James. Trustee Arthur, seconded by Trustee Floros, moved for passage of.Ordinance No. 3509 ORD. CLASS "S" A request was presented to transfer the Class "S'~ liquor TRANSFER: license presently held by Le Bistroquet, Rand Road, to From Le Bis~ the-new owners of the restaurant at the same location to to The Sea be known as The Sea Gull Grill. Grill Trustee Floros, seconded by Trustee Arthur, moved to transfer the exalting Class "S" liquor l$cense from Le Bistroquet to The Sea Gull Grill. OLD'BUSINESS ZBA 13-V-8 ZBA 13-V-85, Prospect Avenue & Edward Street 701 E.PRO An Ordinance was presented that would rescind the applicable AVEN variations granted in Ordinance No. 3065 for property located at 701 E. Prospect Avenue. Although the subject AMEND ORD. property had received several variations in Ordinance No. 3065, NO. the Zoning Ordinance has slnce been amended which would now eliminate the necessity to acquire variations for the size of a parking space and two uses in a building. The proposed ordinance terminates the variation reducing the number of required parking spaces and the elimination of the required truck loading docks. Mr. Andy Bitta, 8~1~ E.~o~~e, requested that the board restrict large vehicles from parking in the area along with south side of the building at 701 E. Prospect, since the cars extend 1 foot into the alley. Trustee Arthur, seconded by Trustee Farley, moved to waive the rule requiring two readings of an.ordinance in order to take action on the subject ordinance. ADMINISTER Village Clerk Carol A. Fields administered the Oaths OATHS of Office to the successful candidates in the April 2, 1985 General Election: Carolyn Krause, Villag 'President; Leo Floros, Trustee; Norma Murauskis, Villa 'Trustee; and Ralph Arthur, Village Trustee. These elected officials will assume their duties for the 4 year term, 1985 1989, on May 7th. ZBA 9-V-85 ZBA 9--V-85, 709 Noah Terrace This case deals with a request for a variation to 709 NOAH TL~RACE permit an existing driveway 24% feet wide rather than the 19 foot width permitted. This driveway was installed without benefit of a permit~by a local contractor at the request of th~ homeowner. The Zoning Board cf Appeals recommended by a vote of 4-2 to grant the request. Trustee Arthur, seconded by Trustee Murauskis, moved ~A~ril 16, 19S5 Page 4 to concur with the recommendation of the Zoning Board of Appeals and grant the variation requested in ZBA 9-V-85. ZBA 11-V-85, 903 Ardyce Lane ZBA 11 The petitioner in-this case has requested a variation to 903ARD~ permit his 8,000 lb. landscaping truck to be parked in the garage of his single family home. The Zoning Board of Appeals recommended granting this request by a vo~e of 6-0. Trustee Van Geem, seconded by Trustee Arthur, moved to concur with the recommendation of the Zoning Board of Appeals and grant the requested variation zn ZBA 11-V-85, provided that the subject truck will ~e required to be housed within the garage and not on the driveway. ZBA 17-V-85, 2000 South Elmhurst Road ZBA 17- This case deals with a request to extend the variations 2000 S.~ granted in Ordinance No. 3401 passed March 6, 1984, for ] a period of one year. The petitioner stated that it has taken a year to clear up all the title and delinquent taxes on the subject property and sznce the Ordinance passed in 1984 was only effective for one year an extension is requested. The Zoning Board of Appeals recommended to grant the request by a vote of 4-0. Trustee Arthur, seconded by Trustee Wattenberg, moved to concur with the recommendation of the Zoning Board of Appeals and grant the requested extension to Ordinance No. 3401. ZBA 12-V-85, Northeast corner of Nordic and Carboy Roads ZBA 12-V The petitioner stated that it is his desire to construct NORDIC & ( a light industrial building on this vacant lot, however, ~ the I-l~District requires a 4 acre site. The petitioner is requesting a variation to permit a one acre site in the I-1 District, and to reduce the number of parking s~aces from the requires 71 to 32. It was'stated that the proposed us~ of this site is for the specialty fabrication of metal products, employing 12 with the projection of a total of 16 employees if this larger facility is permitted. The Zoning Board of Appeals recommended to grant these requests by a vote of 4-0. ZBA 14-SU-85 ZBA 14-SU-85, 1509 Mura Lane 1509 5~/RALANE This case was continued at the Zoning Board of Appeals level for their next meeting, at the request of the petitioner. ZBA 15-V-85 ZBA 15-V-85, 315 Marcella Lane 3t5 MARC~ALN. This case deals with a request for a variation from the permitted .35 ~loor area ratio to allow .41. The petitioner stated that he would like to have a 2 story single family home constructed on this vacant lot, ! however, since the petitioner originally negotiated the purchase, the Village Code was amended to include the garage in the total floor area ratio. This amendment made this variation request necessary. Trustee Wattenberg, seconded by Trustee Farley, moved to concur with the recommendation of the Zoning Board of Appeals and grant the variation requested in ZBA Case No. 15-V-85. £ Upon roll call: Ayes: Arthur, Farley, Floros, Murauskis, Van Geem, Wattenberg ~ Nays: None Motion carried. An Ordinance will be presented for 1st reading at the next meeting of the Village Board on May 7th. ZBA 16-Z-85 ZBA 16-Z-85, Gettysberg Subdivision (Lincoln Street, G~fSRURG SUB. south side, at Weller Creek) Robert Moore, attorney for Larry McKone petitioner, presented his request stating that when this 7% acre parcel was annexed some 7 years ago it automatically became zoned R-X, pursuant to law. It is the petitioner's desire to build a 19 home development which requires R-1 zoning. The original plan was for 21 lots, however at the recommendation of the Plan Commission the petitioner designed the subdivision, eliminating 2 lots. Detention is being provided, as required by Code. It was noted that the MSD has a large line under this development, however the previous owner negotiated and was granted a hold harmless agreement statin~ that any damage caused to buildings on this land would be the responsibility of the MSD. Such wording will be placed on the plat of subdivision. 'Trustee Floros suggested the developer work ~ith staff ~ith the possibility of have the detention area remain a wooded area, rather than the grassed basin usually associated with detention area. This suggestion and the donation required by Code will be discussed by staff and the petitioner for the next meetin~ of the Village Board. Trustee Arthur, seconded by Trustee Wattenberg~ moved to concur with the recommendation of the Zoning Board April 16, 1985 Page 6 of Appeals and grant the re-zoning of property being the subject of ZBA Case No. 16-Z-85 from R-X to R-t. PUBLIC HEARINGS PUBLIC HEARING 1985-86 ~UD~wI' Mayor Krause called the Public Hearing to order for the purpose of considering the proposed annual budget for fiscal year 1985/86, at 9:40 P.M. Village Manager Burghard noted that the total budget for fiscal year 1984-85 including the Mount Prospect Public Library was $23,835,275. The proposed-budget for fiscal year 1985-86 including the Library is $25,250,675. Four public hearings were held on the proposed budget broadcast over Cable Television. Copies of the proposed budget have been on file and display in the Office of the Village Clerk and at the Mount Prospect Public Library. The proposed budget provides for no increase in real estate taxes. Mr. Burghard also nqted that the number of employees in the 1985-86 budget is the same as in 1977. There being no questions from the audience, Mayor Krause adjourned the public hearing at 9:48 P.M. Trustee Van Geem, seconded by Trustee Farley, moved to concur with the recommendation of the Plan Commission and authorize the Mayor to sign and Clerk to attest her signature on the Mobil Oil Plat of Subdivision. AMEND CH.16 An Ordinance was presented for 1st ~eading that would amend Chapter 16, Development Code, of the Village Code. The proposed amendments to Chapter 16 have been under consideration by staff, the Plan Commission and Village Board for the past year. Due to the many revisions, the proposed Ordinance will amend Chapter 16 in its entirety. Trustee Van Geem, seconded by Trustee Wattenberg, moved to waive the rule requiring two readings of an Ordinance in order to take action on the proposed amendment to.
