ROLL CALL ROLL CALL Present upon roll call: Mayor Carolyn Krause Trustee Ralph Arthur Trustee Gerald Farley (arrived late) Trustee Leo Floros Trustee Norma Murauskis Trustee George Van Geem Trustee Theodore Wattenberg INVOCATION I~0CATION The invocation~ was given by Trustee Norma Murauskis. COMMUNICATIONS AND PETITIONS - CITIZENS TO BE HEARD None. MAYOR'S REPORT None. OLD BUSINESS A Resolution was presented that would authorize the Village to participate with other municipalities as well as the State of Illinois in joint purchases. Trustee Arthur, seconded by Trustee Wattenberg, moved for RES.NO. 20-86 passage of Resolution No. 20-86 A RESOLUTION OF AUTHORIZATION FOR PARTICIPATION IN JOINT PURCHASING AGREEMENTS Upon roll call: Ayes: Arthur, Farley, Floros, Murauskis, Van Geem, Wattenberg Nays: None Motion carried. Village Manager Burghard presented a Resolution that would authorize the execution of a contract with Baxter & Woodman for a study relative to the design work on George and Albert Streets for roadway improvements. This subject has been previously discussed by the Village Board as well as with the residents of the area. The proposed study would set forth the various aspects involved with the project, should it go forward. Trustee Wattenberg, seconded by Trustee Arthur, moved for RES.NO. 21-86 passage of Resolution No. 21-86 Upon roll call: Ayes: Arthur, Farley, Floros, Murauskis, Van Geem, Wattenberg Nays: None Motion carried. Mr. Burghard ~oi~d that if ~his project is to proceed, this study is necessary due to legal requiremeots and public hearing publications in order to create a Special Service Area for this proposed project. ZBA 60-SU-86 ZBA 60-SU-85, Sporty Nine - Old Orchard Colony Cou.n~{y SPORTY NINE This case deals with a special use for property presently under a Consent Decree for the entire Colony Country complex. The petitioner is requesting a multi-family development on this 38 acre parcel. The proposal presented to the Zoning Board of Appeals was denied by a vote of 1-5, however, since that time the petitioner has revised his request. The request now stands to permit 772 units, 110 of which would be townhouses. The 3 main buildings would have 4 story buildings graduating up to a maximum of 7 stories. Mayor Krause noted that the Board has had the opportunity to review the minutes of the Zoning Board of Appeals, staff's written recommendations, as well as some Trustees have listened to the tapes of the Zoning Board meetings. Discussion took place on the various changes, made by the petitioner to the original plan. Howard Borde and Robert Babbin presented the various changes to the original proposal, stating that the number of units requested have been reduced; t~e parking ratio has been increased; and fire safety features would be installed in all units. Donald Kreger, Attorney for the City of Prospect Heights, stated that on behalf of his client, he would oppose this project and requested the Village Board to deny the requested special use. There was discussion as to whether the existing Consent Decree is valid. There are areas of the Consent Decree that are being challenged in court, however, one of the areas that parties would like to retain is the 50 year convenant on the ~8 hole golf course. The Village of Mount Prospect contends that the Consent Decree is valid and if this project is approved, then documents would be filed in court to amend the Consent Decree. Edward Collins, 414 Camp McDonald Road, stated that he opposed to the project due to the possible effect it could have on his property. The majority of the Board commended the petitioner for the many compromise mad~ from the original plan, and while they stated they would like to see more, they did state that the proposal is acceptable. It was noted that the petitioner would be installing fire safety features such as sprinkling 100% of the units and the units would have an R2 rating, however, it was noted that the Village would study a proposal to establish Fire Station #4, which would possibly house para-medics only. Further discussion and studies will be made on this subject. The petitioner did explain that with the reduced height from the original 8 stories to 7, the duplex units would have to be eliminated. An exhibit was presented showing the architectural design of the 7 story buildings and that of the 8 story building, noting that a better design could be accomplished with the 8 story building. Trustee Floros, seconded by Trustee Wattenberg, moved to accept the plan for the 3 main buildings indicating the maximum height of 8 stories. Upon roll call: Ayes: Arthur, Parley, Floros, Murauskis, Wattenberg Nays: Van Geem Motion carried. An Ordinance will be presented at the next meeting of the Village Board reflecting the special uses approved. NEW BUSINESS None ~. VILLAGE ~NAGER'S REPORT None. ANY OTHER BUSINESS None.
