S Ai[D P~2L£.[ONS - CITIZENS TO BE HEARD PRESENTATION: Kim ~[atson, rcpuesun~ing Northwest Community Hospital NORTHWEST presented the Village with a large panoramic photo COMMUNITY of the downtown area ~;hich was taken as a part of the HOSPITAL hospital's 25th Anniversary celebration last year. MAYOR'S REPORT OATH OF OFFICE: Mayor Krause introduced Henry Friedrichs, Chairman of the LT. CLARK & Fire and Police Commission. Mr. Friedrichs administered LT. DUMOVICH the Oath of Office to Lt. Robert Clark and Lt. Steve Dumovich, recently promoted to the position of Lieutenant. OLD BUSINESS ZBA 3-Z-86 & ZBA 3-Z-86, ZBA 4-V-86 South Busse Road (Rosenow ZBA 4-V-86 Property) ROSENOW-SOUTH At the request of the petitioner an Ordinance amending BUSSE ROAD the Comprehensive Plan, granting I-1 zoning and granting parking variations for the subject property were continued to the June 3rd meeting of the V'illage Board. ZBA 16-SU-86 ZBA 16-SU-86, Frediani Developers (Picadill~.C%rcle) COLONY COUNTRY An Ordinance was presented for first reading that would grant a special use to permit 38 townhouses on the circular parcel located within the Old Orchard Colony Country. This parcel is presently governed by a Consent Decree. The Zoning Board of Appeals recommended granting this special use, wi~h ronditions, by a vote of 7-0. Mr. Eugene Schlickman introduced himself as President of the Colony Country Community Association and asked the Village Board to require the developer to post performance bonds so that in the event the private roadways within this development are damaged by construction vehicles that he would be required no hake necessary repairs. Mr.Schlickm~ also asked that a vehicular route be established during t construction ~n order to prevent property damage. ~r. Emmett Stains, also spoke on behalf of homeowners within the Colony Country, stating that he would like to review the documents to be considered by the Village Board prior to action on the Ordinance. Mayor Krause explained that all bonds required by the Village Code would have to be posted by the developer, however any private matters would have to be agreed to and resolved between the developer and the Association. The Village Manager will forward the proposed documents to Mr. Stains as soon as they are drafted. This Ordinance will be presented for second reading at the June 3rd meeting of the Village Board. ZBA 13-V-86 313 BOBBY LANE ZBA 13-V-86, 313 Bobby Lane An Ordinance was presented for first reading that would grant variations to permit a 3-car garage, 690 sq. ft. in size, a 30 foot wide driveway and a circular driveway on this 80 foot wide lot. The Zoning Board of Appeals recommended approving all requests except the circular driveway by a vote of 6-0. The vote was 2 in favor and 4 against the circular driveway. This Ordinance will be presented June 3rd for second reading. Page 2 May 20, 1986 BA 14-V-86, 308 ZBA 14-V-~86 An Ordinance was presented for first reading ~hat would 308 BOBBY LA~ grant variations to permit a 3-car garage, 690 sq. ft. in size, 30' foot wide driveway and a circular driveway. The subject property is 95 feet wide and the Zoning Board of Appeals recommended granting all the variations requested. This Ordinance will be presented June 3rd for second reading. ZBA 17-V-86, 303 Catino Court ZBA 17-V-86 This Ordinance, granting variations to permit an addition 303 CATINO C~ to an existing 2-flat and a variation to permit a floor area ratio (FAR) of .512 rather than the permitted .35, was presented for first reading. The Zoning Board of Appeals recommended 4-2 to grant these variations. This Ordinance will also be presented June 3rd for second reading. ZBA 10-SU-86, .Rouse/Randhurst ZBA 10-SU-8 A Planned Unit Development is requested for the-signs RANDHURST located within the Randhurst Shopping Center. There are presently 7 freestanding signs: 3 message/identification. signs for Randhurst; 2 message signs for the cinema; 1 for Bell Federal Savings; and 1 for Ward Auto Center. At the last meeting, Mr. Poblocki, Manager for Randhurst, stated that in n~.s opinion the Sign Ordinance for the Village does not a~dress a regional shopping center like Randhurst, which has unique signage needs. The Village Board requested Mr. Poblocki to revise his plans and present the revisions at this meeting. Mr. Poblocki stated that he and staff had revised the plans as follows: The existing signs for the cinema would conform to Village Code requirements no later than 12/31/87; The three Randhurst identification signs would conform no later than 12/31/92, as would the Bell Federal Savings sign; The Montgomery Wards sign would be removed no later than July, 1989, as previously stated in an Ordinance granting the variation to alter that sign. It was also stated that t~o additional signs would be permitted in conjunction with the n~w office complex presently Under construction and another sign for the free standing restaurant proposed for future development. The Village Board complimented Mr. Poblocki on working out a compromise plan for the signs within this regional shopping center. Trustee Arthur, seconded by Trustee Wattenberg, moved to grant the planned unit development for signs, as revised, and as presented on the site plan. Page 3 - May 20, 1986 RECAPTURE An Ordina~ce ~as preset]bed for second reading that AGREEMENT: would authorize a Recapture Agree~nent for property LILJEQUIST SUB.. commonly kno~s as Lilj~quis~ Subdivision, generally located ~t the southeast corner of Lonnquist Boulevard and Elmhurst Road. Mr. & Mrs. Uher developed one of the 4 lots, including the installation of a sewer main. When the other 3 lots in this subdivision are developed the owners will reimburse Mr. & Mrs. Uher a portion of that cost. Trustee Farley, seconded by Trustee Wattenberg, ORD.NO.3650 moved for passage of Ordinance No. 3650 AN ORDINANCE AUTHORIZING THE EXECUTION OF A RECAPTURE AGREEMENT BETWEEN RICHARD AND BARBARA UHER AND THE VILLAGE OF MOUNT PROSPECT Upon roll call: Ayes: Arthur, Farley, Floros, ~]rauskis, Van Geem, Wattenberg Nays: None .. As recommended by the Safety Commission, an AMEND CH.18 Ordinance was presented for first reading that would amend Chapter 18 and authorize the installation of YIELD signs at Lama Lane and Tano Lane a~%d the elimination of the 2 hour parking restriction on Lincoln Street between George and Albert Streets. Trustee Arthur, seconded by Trustee Wattenberg, moved to waive the rule requiring two readings of and Ordinance in order to take action on the subject Ordinance. Trustee Arthur, seconded by Trustee Farley, moved ORD.NO.3651 for passage of Ordinance No. 3651 AN ORDINANCE A~ENDING SCHEDULE VIB OF SECTION XX OF CHAPTER 18 (TRAFFIC CODE) Upon roll call: Ayes: Arthur, Farley, Floros, Murauskis, Van Geem, Wattenberg Nays: None Motion carried. AMEND CH.~t: An Ordinance was presented for second reading that TAXICAB FARES would amend Chapter 11, increasing the taxicab fares. Trustee Wattenberg, seconded by Trustee Arthur, moved for passage of Ordinance No. 3652, with the understanding that the overall operation of taxicabs would be reviewed in 3 months. AN ORDINANCE AMENDING ~RTICLE XI ENTITLED "TAXICAB AND TAXICAB DRIVER'S LICENSES" Upon roll call: Ayes: Arthur, Farley, Floros, Murauskis, Van Geem, Wattenberg An Ordinance was prez~:nt~d~ .'!~,~g that ~ould authorize the Village to i~:~3 issuing a SORROW MONEY note for the purpose of providing f~nds to establish a reserve for the Village's self-in~uued liability insurance fund. This Ordinance would also provide for the levy and collection of a direct annual tax for the payment of the principal and interest on said note. Trustees Arthur and Murauskis stated they would not support this Ordinance when presented for second reading June 3rd due to the fact that they would rather use monies presently held by the Village due to the sale of certain property. Mr. Jepson, Director of Finance, stated that it is very possible that if the Village were to borrow this money, the Village would receive more interest on its investment than charged to borrow the funds. This Ordinance will be presented June 3rd for second reading. NEW BUSINESS ZBA 18-V-86, 506 S. Emerson Street ZBA 18-V-86 The petitioner in this case is requesting a variation to .. 506 S.EMERSON allow a second garage and second driveway on one lot of record. The Zoning Board of Appeals reco~mnended granting these variations by a vote of 6-0. ~4r. Auwarter, petitioner, stated that he has lived in the home for over 20 years and the existing one car garage is actually a part of the design of the home and would ruin the appearance of the home if he was required to convert it into living space or remove it. It was also stated that this 2 story home is located on a double lot with a rear yard of approximately 100' x 100'. Concern had been expressed by staff as to possible drainage problems. Mr. Auwarter stated that he would make modifications in accordance with the recommendations of the Village Engineer. Trustee Arthur, seconded by Trustee Murauskis, moved to concur with the recommendation of the Zoning Board of Appeals and grant the variations requested in ZBA 18-V-86, provided no accessory buildings be permitted on this parcel. Upon roll call: Ayes: Arthur, Farley, Floros, Murauskis, Van Geem, Wattenberg Nays: None Motion carried. An Ordinance will be prepared for first reading on June 3rd. ZBA 19-Z-86 and ZBA 20-V-86, 1798 S. Elmhurst Road ZBA 19-Z-86 The subject property is an existing Shell Service Station ZBA 20-V-86 and the petitioner is requesting re-zoning from B-3 to B-4 1798 S.ELMHUR to allow for a car wash. Variations are also requested to permit stacking spaces of 15 rather than the required 38 for the car wash, and to permit a 10 foot rear yard setback instead of the request 20 feet. The Zoning Board of Appeals recommended granting these requests by votes of 6-0. It was noted that this station would be completely upgraded and modernized by the petitioner including landscaping and signage, as approved by staff. ZBA 21-V-86 ZBA 21-V-86, 1910 East Euclid Avenue 1910 E.EUCLID The petitioner in this case is requesting a variation to permit a second garage and second driveway on the subject properny. The Zoning Board of Appeals recommended granting these variations by a vote of 6-0. The petitioner stated that his lot faces Euclid Avenue and is 250 feet wide and approximately 83 feet deep. He would like to build an addition to the home, leaving the existing.garage intact. .~ Trustee Arthur, seconded by Trustee Wattenberg, moved to concur with the recommendation of the Zoning B6ard of Appeals and gr~nn the requested variation in ZBA 21-V-86, provided that no additional accessory buildings be permitted on this lot. ZBA 22-V-86 ZBA 22-V-86, ]206 Westgate 1206 WESTGATE This case deals with a request to permit the extension of a 5 foot high fence from the rear of his house, parallel to Euclid, up to the front building line. The Zoning Board of Appeals recommended approving this request by a vote of 6-0. Wattenberg, seconded by Trustee Flores, moved to concur with the recommendation of the Zoning Board of Appeals and grant the ~equested variation in ZBA 22-V-86. Upon roll call: Ayes: Arthur, Farley, Flores, Murauskis, Van Geem, Wattenberg Nays: None Motion carried. An Ordinance will be drafted for presentation at the June 3rd meeting of the Village Board. ZBA 23-V-86 ZBA 23-V-86, 10 North Emerson 10 N.EMERSON This case deals with a request to permit an accessory building 12' x 12' x 12', rather than the permitted 10' x 10' x ~2'. The proposed shed is approximately 144 sq. ft. in area, where the permitted area is 120 sq.ft. The Zoning Board of Appeals is final with regards to the height however, Village Board action is required on the area involved. In both cases the Zoning Board of Appeals recommended gcanting the request by a vote of 4-2. AMEND CH.18: An Ordinance was presented for first reading -that would UNPAVED R.O.W amend the Traffic Code (Chapter 18) to prohibit parking on unpaved Village rights-of-way. This restrlc_xon would prohibit parking on gravel shoulders where there are no curbs as well as on parkway area, between the curb and sidewalks. Trustee Van Geem, seconded by Trustee Wattenberg, moved to waive the rule requiring two readings of an Ordinance. WAIVE BIDS: The Village Manager presented a request from the Police MOTOROLA Chief to waive the bidding procedure in order to purchase TERMINALS five keyboard display terminals from Motorola at a cost not to exceed $22,500. This equipment, which must be compatible to existing equipment, will be installed in fi~e first line police vehicles. Trustee Flores, seconded by Trustee Farley, moved to concur with the recommendation of staff and waive the bidding procedures in order to purchase five keyboard terminals from Motorcla at a cost not to exceed $22,500 Upon roll call: Ayes: Arthur, Farley, Flores, Murauskis, Van ~eem, Wattenberg Nays: None Motion carried. ANY OTHER BUSINESS Trustee Farley requested the Police Chief to look into the HIGH RISE enforcement of violations that may exist on vehicles that VEHICLES have either extra large tires or raised very high. These vehicles should have bumpers at a required height and without, could be hazardous to other vehicles.
