COMMUNICATIONS AND PETITIONS - CITIZENS TO BE HEARD Two Ordinances authorizing certain referenda questions on LIBRARY: behalf of the Mount Prospect Public Library were postponed REFEREND to later in the meeting in order to wait for a QUESTION representative of the Library to arrive. Richard Hendricks, 1537 Emmerson Lane, questioned if and M.P.PLAZ when the Mount Prospect Plaza would be required to replace SIDEWALK the sidewalks around that shopping center, considering school will be open within the next few weeks and children do use the sidewalks in order to get to St. Emily's School. ENTRANCE MARKER Mr. Hendricks also asked when the entrance marker at REPLACEMENT: Emmerson and Wolf Road is scheduled to be replaced. EMMERSON & WOLF This marker was damaged by an automobile a couple of months ago. Village Manager Dixon stated that the original construction plan for the Mount Prospect Plaza did not anticipate removing the sidewalks however representatives of the Plaza have assured the Village staff that the sidewalks will be in place prior to school opening. It was also stated by Mr. Dixon that the Village has recently received the funds from the party involved with the damaged entrance marker and a bricklayer has been retained to replace the marker, which work should be accomplished within the next 10 days. MAYOR'S REPORT ROMANCE REST. A request was presented from the new owners of the 1223 N.RIVER RD. Romance Restaurant, 1223 North River Road, to be permitted to continue doing business under the existing CLASS "R" Class "R" liquor license. The petitioner was interviewed by the Village Manager and all requirements of the Village Code have been met. It was noted that the petitioner will provide an American/Italian food menu. Trustee Arthur, seconded by Trustee Wattenberg, moved to authorize the new owners of the Romance Restaurant to continue doing business under the existing Class "R" liquor license. OLD BUSINESS ZBA 46-V-87 ZBA 46-V-87, 403 Manawa Trail 403 MANAWA TR An Ordinance was presented for second reading that would grant a variation to permit a deck. The Zoning Board of Appeals voted to approve the request by a vote of 5-0. At the request of the Petitioner, Trustee Wattenberg, seconded by Trustee Arthur, moved to waive the rule requiring two readings on an Ordinance. ORD.NO. 3808 Trustee Farley, seconded by Trustee Wattenberg, moved for passage of Ordinance No. 3808 AN ORDINANCE GRANTING A VARIATION FOR CERTAIN PROPERTY COMMONLY KNOWN AS 403 MANAWA TRAIL Upon roll call: Ayes: Arthur, Farley, Floros, Murauskis, Van Geem, Wattenberg Nays: None Motion carried. Due to certain items on the agenda involving a large portion of the audience, various items on the agenda were hear~ in an order different from the printed agenda. Page 2 - August 4, 1987 189 2013 - 2019 East Euclid Avenue 2013-2019 EU( An Ordinance was presented for first reading that would MODIFICATION permit the Petitioner to delay the installation of FROM DEVELOP~ sidewalks along Euclid Avenue in front of the subject CODE property and authorizing execution of a Restrictive Covenant stating that at a future dated to be determined by the Village the required sidewalks would be installed. The Plan Commission recommended granting the ~equest by a vote of 8-0. Trustee Van Geem, seconded by Trustee Wattenberg, moved to waive the rule requiring two readings of an Ordinance. Trustee Farley, seconded by Trustee Wattenberg, moved for ORD.NO.3809 passage of Ordinance No. 3809 AN ORDINANCE GRANTING MODIFICATIONS FROM THE DEVELOPMENT CODE FOR PROPERTY COMMONLY AS 2013 - 2019 EAST EUCLID AVENUE Upon roll call: Ayes: Arthur, Farley, Floros, Murauskis, Van Geem, Wattenberg Nays: None Motion carried. ZBA 30-Z-87 & ZBA 31-SU-87, Fairway Properties (Hill Street ZBA 30-Z-87 and Rand Road) ZBA 31-SU-8' This case was continued from the July 7th meeting of the RAND/HILL Village Board in order to give sufficient time to explore DEVELOPMEN~ the possibility of the Mount Prospect Park District (FAIRWAY obtaining the subject property for a park site. It has PROPERTIES been determined that the ~ark District is not interested in this site due to location and the lack of funds. The Petitioner is requesting the property to be rezoned from R-1 to B-4 and special use in the nature of a Planned Unit Development in order to construct a shopping center and an 'out lot' to house a restaurant. The Zoning Board of Appeals forwarded a 3-3 recommendation, which is a denial. It was noted by the Petitioner that the original plan before the Zoning Board of Appeals included two 'out lots' and at the suggestion of that Board the proposal to have a fast food restaurant located at the western portion of the property was eliminated. There were also other modifications made to the plan as a result of the concerns expressed by the residents and members of the Zoning Board of Appeals. Due to the elimination of the proposed fast food restaurant, it is the request of the Petitioner to amend the request for re-zoning from B-4 to B-3. It was noted that there is presently extensive shrubbery on the subject property and it is the intention of the Petitioner to maintain the trees along the Hill Street (west edge) of the property in order to provide an attract screening for the residents in that area. Existing trees will also be relocated to make that area even more dense. A detention area is proposed fo~ the northwestern corner of the property which could be used as an open space area when not holding water. It was stated by the Petitioner that this shopping center would provide a service orientated area for residents, which he felt is not available in the larger shopping centers in the area. Louis Michael Naughtilly Joan Williams Steve Pollit, 601Wilshire Mr. Verde, 506 Eastman Court Some of the objections expressed were: No need for another shopping center Increased traffic There is a need for open space/park in the area The Smell that would accompany a restaurant use Effect property values Difficulty for the residents of Hill Street and Eastman Court in having access to and from their subdivision It was the unanimous opinion of the Village Board that both the residents and the Petitioner had made good presentations and the residents were particularly organized and prepared. The following residents spoke in favor of the proposal project: Edward Kowalski, 513 Eastman Court Steve Mueller, 514 Rand Road There was discussion by members of the Board, noting that Rand Road has been a very busy roadway for years and that this type of use would not effect that fact. It was also suggested that the Petitioner eliminate the proposed restaurant use from the plan. The Petitioner stated that he could amend the plan to have some other type of use occupy that 'out lot'. Steve Park, Director of Planning and Zoning, stated that the Petitioner has various items yet to be addressed before the staff could recommend granting the requests. Trustee Farley, seconded by Trustee Wattenberg, moved to grant conceptual approval to the project, prior to final approval so that the concerns of the staff could be resolved after which time the revised plan would be brought back to the Village Board for final consideration. Upon roll call: Ayes: Arthur, Farley, Wattenberg Nays: Floros, Murauskis, Van Geem Motion failed. The Petitioner stated that if the members of the Board felt they could approve the proposal if the restaurant was excluded, then he would commit to eliminating any food use whatsoever. Based on the Petitioners statement, Trustee Murauskis, seconded by Trustee Farley, moved to Page 4 - August 4, 1987 reconsider the proposal being th~"sU'bjeCt of the preceeding motion. Trustee Van Geem stated that he felt the Petitioner should not be permitted to amend his request at this level of the proceedings from B-4 to B-3, and that the Petitioner should present the amended request to the Zoning Board. Based on the fact that Trustee Van Geem felt the Zoning Board of Appeals should review and make a recommendation on the amended plan, Mayor Krause suggested ZBA Cases 30-Z-87 and 31-SU-87 be remanded back to the Zoning Board of Appeals for a Special Meeting on August 20th. Due to the fact that this action took place at a Village Board meeting, the requirement to send notice would not apply. Trustee Murauskis, seconded by Trustee Farley, moved to remand ZBA Case Nos. 30-Z-87 and 31-SU-87 back to the Zoning Board of Appeals for a special hearing on August 20th. The recommendation of the Zoning Board of Appeals will be presented to the Village Board for possible consideration on September 1st. Mayor Krause called a brief recess at this point, RECESS 11:15 P.M. The meeting was reconvened at 11:25 P.M. RECONVENE Present upon roll call: Mayor Krause Trustee Arthur Trustee Farley Trustee Fl~ros Trustee Murauskis Trustee Van Geem Trustee Wattenberg Mayor Krause brought two Ordinances to the attention of LIBRARY the Board that had been deferred earlier in the meeting REFERENDU relative to two referendum questions requested by the QUESTIONS Mount Prospect Library Board to appear on the November 3rd election ballot. The first Ordinance posed the question of whether the Village shall provide bonds not to exceed $6,500,000 for the payment of improvements and an addition to the --- existing library building, and the second Ordinance asked whether the Village shall increase the library tax for maintenance and operation from 0.23% of full fair cash value to 0.30% of full fair cash value. There was discussion by the Village Board as to the proposal of the Library Board, with several members of the Board suggesting that the Library Board should pass the necessary Resolution to become a Library District. It was also noted that as the governmental structure stands at this time, if the referendum questions receive a favorable vote from the voters, the increase would actually appear as the Village's debt. There was no representative from the Mount Prospect Public Library present at this meeting to answer any questions. Page 5 - August 4, 1987 192 Mayor Krause stated that there is a time element involved in getting Ordinances to the County Clerk in order to be placed on the ballot. ANNEXATION: An Ordinance was presented for 2nd reading that 55 ACRES would annex territory approximately 55 acres in size on the southwesterly border of the Village. The general area is located east of Busse Road, west of Higgins Creek, south of Algonquin Road and north of the Tollway. A Public Hearing was held on August 4th, following proper legal notice being published. ORD.NO.3812 Trustee Floros, seconded by Trustee Van Geem, moved for passage of Ordinance No. 3812 AN ORDINANCE ANNEXING TO THE VILLAGE OF MOUNT PROSPECT LAND LYING IN SECTION 23, TOWNSHIP 41 NORTH, RANGE 11, EAST OF THE THIRD PRINCIPAL MERIDIAN Upon roll call: Ayes: Arthur, Farley, Floros, Murauskis, Van Geem, Wattenberg Nays: None Motion carried. At the request of the Petitioner, Trustee Arthur, seconded by Trustee Wattenberg, moved to waive the rule requiring two readings of an Ordinance. ZBA 49-V-87, 706 East Sha Bonee Trail ZBA 49-V- The Petitioner in this case is requesting a variation in 706 E.S~ order to construct a parking pad for two vehicles. The Zoning Board of Appeals recommended granting this request by a vote of 5-0. Page 7 - August 4, 1987 194 The Petitioner stated that the subject property is a townhouse complex, with each owner owning certain land abutting their unit. There is a garage for each unit which accommodates one vehicle, and there continues to be a parking shortage in the area. Access to the parking pad would be the same as to the garages and that is via the alley. Trustee Farley, seconded by Trustee Arthur, moved to concur with the recommendation of the Zoning -- Board of Appeals and grant the requested variation. An Ordinance will be presented for first reading at the August 18th meeting of the Village Board. Trustee Van Geem left the meeting temporarily at this point. ZBA 51-V-87 ZBA 51-V-87, 1300 North Santee Lane 1300 SANTEE LN. The Petitioner in this case is requesting a variation to allow a 6 foot high fence with a scalloped top edge and to permit the fence to extend beyond the rear building line. The Zoning Board of Appeals recommended granting this request by a vote of 5-0. The Petitioner noted that he would like to replace an existing fence that is in disrepair with a fence of the same height and design and due to the fact that the side of the property abuts Euclid Avenue and would like to screen the yard from this busy road. Trustee Farley, seconded by Trustee Murauskis, moved to concur with the recommendation of the Zoning Board of Appeals and grant the variations requested. ZBA 53-V-87 ZBA 53-V-87, 507 Marina 507 MARINA The Petitioner is requesting a variation to permit a rear yard of 11.5 instead of the normally required 25 feet in order to have a patio. The Zoning Board of Appeals recommended granting this request by a vote of 5-0. The Petitioner stated that the subject property is located on a pie shaped lot and the side yard is extremely large. The total area covered on this lot would be within the permitted percentage. Peace Reform Church, 955 Meier Road PEACE REFO~ The Petitioner in this case is requesting a modification CHURCH from the Development Code (Chapter 16) to waive the 955 MEIER requirement to install curbs around the perimeter of the MODIFICATI church parking lot. The Plan Commission recommended FROM DEVEL granting this request by a vote of 5-0. CODE Trustee Wattenberg, seconded by Trustee Farley, moved to concur with the recommendation of the Plan Commission and grant the requested modification from the Development Code. ZBA 42-V-87, 43-SU-87, 44-Z-87, 45-A-87, The Alter Group ZBA 42-V-87 The property being the subject of these cases is generally ZBA 43-SU-~ located west of Elmhurst Road south of Dempster Street and ZBA 44-Z-8~ north of Algonquin Road. The Petitioner is requesting an ZBA 45-A-8~ amendment to the Comprehensive Plan; a text amendment; ALTER GROU! re-zoning from B-3 to a combination of I-1 and O-R; variations from the Zoning Ordinance; a Special Use; and, modifications from the Development Code. This case was continued from the July 21st meeting of the Village Board in order to give more time to study the various requests. The Petitioner stated that it is their intention to construct a mixed use industrial park, with a portion of the property having a 6 story building. The Comprehensive Plan presently indicates the use for this site as general commercial and office use. The Petitioner would like a combination of I-1 and O-R zoning, based on the fact that the Petitioner does not know the exact uses that will be located within the park, the different zoning would give the options. The special use in the nature of a Planned Unit Development is being requested to permit buildings 40 feet in height or 2 story buildings (whichever is lesser) in the I-1 District and 80 feet or six stories (whichever is lesser) in the O-R District. The 6 story building would be required to have a setback of 150 feet from the right-of-way. The Petitioner is requesting several variations from the Zoning Ordinance (Chapter 14) including minimum yard requirements, setbacks for parking, number and size of loading spaces, size of industrial lots, and land-banking up to 30 percent of the required parking. The modifications from the Development Code (Chapter 16) include a 66 feet right-of-way and 35 foot back-to-back pavement width for dedicated roads, to allow horizontal curves to be a minimum of 150 feet radius and waive the Page 9 - August 4, 1987 196 required 100 foot minimum tangent between reverse curves; to permit sidewalks to be built on one side of the street, rather than both sides; to permit a building to be located up to 25 feet from a detention facility. The recommendation from the Zoning Board of Appeal~ on the various requests in these cases was favorable, with conditions attached. The Plan Commission voted to deny the requested modifications from the Development Code to permit seed instead of sod in the parkway and to permit building permits to be issued prior to the recordation of the final plat of subdivision. It was noted that the Petitioner and staff had resolved several areas of concern between the Commission meetings and presentation before the Village Board. Trustee Farley, seconded by Trustee Arthur, moved to concur with the recommendation of the Zoning Board of Appeals and grant the re-zoning being the subject of ZBA Case No. 44-Z-87. The Petitioner withdrew the requests to modify specified areas of the Development Code, concurring with the Plan Commission's recommendation. It was also requested by the Petitioner that the requirement to install sidewalks along Algonquin Road be deferred until such time as the Village requires the installation. A Covenant would be executed by the Petitioner stating that fact. Trustee Arthur, seconded by Trustee Murauskis, moved to grant specific modifications from the Development Code, which modifications will be included in the Ordinance to presented for first reading August 18th. BUSSE ROA£ The request for modification from the Development Code DEMPSTER relative to a 3:1 slope in the detention area instead ALGONQUIN of 6~1 has been continued until such time as the Petitioner is able to submit all the required documents to the Village. VILLAGE MANAGER'S REPORT Village Manager, John Fulton Dixon, stated that no bids were T.V.PLAYBA( received for the T. V. playback equipment and the staff will EQUIPMEN~ re-advertise. A Resolution was presented that would authorize a Public LEVY: Hearing to be held September 1, 1987 for the purpose of 1987/88 considering the Tax Levy for fiscal year May 1, 1987 through April 30, 1988. Trustee Wattenberg, seconded by Trustee Arthur, moved for RES.NO.23- passage of Resolution No. 23-87 A RESOLUTION TO DETERMINE THE AMOUNTS OF MONEY ESTIMATED TO BE NECESSARY TO BE RAISED BY TAXATION BY THE VILLAGE OF MOUNT PROSPECT UPON THE TAXABLE PROPERTY WITHIN THE VILLAGE FOR THE YEAR COMMENCING MAY 1, 1987 AND ENDING APRIL 30, 1988. Upon roll call: Ayes: Arthur, Farley, Floros, Murauskis, Van Geem, Wattenberg Nays: None Motion carried. Mr. Dixon brought up the subject of alternate revenue ALTERNAT~ sources discussed at the Committee of the Whole meeting REVENUE last week, namely a Hotel/Motel Tax of 3% and a Real Estate SOURCES Transfer Tax of 0.10%. The consensus of the Board was favorable to these items. There was also a Food and Beverage Tax and a proposed $150 fee for ambulance service for non-residents, which would no% apply when the ambulance responded to a dwelling unit. These two alternate revenue sources did not receive support -_- - 11 - Au ustC. 1987 98 from the majority of Board members present at the meeting and might be brought up at a future date when all Trustees are present. Trustee Arthur expressed his opinion that the 'short fall' of revenue should be obtained through a Village sales tax and/or property taxes. Representatives from the Mount Prospect Holiday Inn expressed their concern about the proposed Hotel/Motel Tax stating that they would not be competitive with neighboring communities if the Village's 3% was added to the existing 6% state tax. Mr. Jim Murphy also addressed the Board expressing the concern of local real estate agents to the imposition of a real estate transfer tax. It was noted that Ordinances will be presented for consideration on August 18th at which time the concerns of those involved will be heard in depth. ICC HEARING: CITIZENS UTILITIES As a reminder, Mr. Dixon noted that the Illinois Commerce Commission will be holding a meeting relative to the Citizens Utilities Water Company request on Thursday, August 6th at Hersey High School.
