Village Manager John Dixon presented the plaque to Herb Weeks, Director of Public Works. COLONY APTS. Dan Schalafue, representing the Management of the FIELD Colony Apartments, Oakton and Elmhurst, requested a CHANGE field change for the Planned Unit Development to allow an existing 30' x 40' open space area to be fenced and have playground equipment installed for the young children in the complex. It was noted that no parking spaces would be affected by this change. Trustee Floros, seconded by Trustee Wattenberg, moved to grant the requested field change for this property. Upon roll 'call: Ayes: F!oros, Murauskis, Van Geem, Wattenberg Nays: None Motion carried. MAYOR'S REPORT MARVIN A Resolution was presented acknowledging the many WEISS contributions of Marvin S. Weiss, Director of the River Trails Park District since its establishment, who passed away June 29th. Trustee Floros, seconded by Trustee Murauskis, moved for passage of Resolution No. 27-88 A RESOLUTION ACKNOWLEDGING THE CONTRIBUTIONS OF MARVIN S. WEISS Upon roll call: Ayes: Floros, Murauskis, Van Geem, Wattenberg, Krause Nays: None Motion carried. OLD BUSINESS ZBA 28-V-88 ZBA 28-V-88, 601 North Wille Street 601 N.WILLE An Ordinance was presensed for first reading that would grant a variation to allow a setback of 30" from the interior side lot line in order to construct a shed. The Zoning Board of Appeals recommended granting this request by a vote of 7-0. Upon the request of the Petitioner, Trustee wattenberg, seconded by Trustee F!oros, moved to waive the rule requiring two readings of an Ordinance. WILLE STREET Upon roll call: Ayes: Floros, Murauskis, Van Geem, Wattenberg Nays: None Motion carried. ZBA 29-V-88, 605 South Edward street ZBA 29-V-88 An Ordinance was presented for first reading that 605 Edward would grant a variation to allow a 2 foot setback from the side property line in order ~o construct a detached garage. The Zoning Board of Appeals recommended granting the variation by a vote of 7-0. At the request of the Petitioner, Trustee Murauskis, seconded by Trustee Wattenberg, moved to waive the rule requiring two readings of an Ordinance. Upon roll call: Ayes: Fioros, Murauskis, Van Geem, Wattenberg Nays: None Motion carried. Trustee Murauskis, seconded by Trustee Floros, moved ORD.NO.3960 for passage of Ordinance No. 3960 A~ ORDINANCE GRANTING A VARIATION FOR PROPERTY COMMONLY KNOWN AS 605 SOUTH EDWARD STREET Upon roll call: Ayes: Floros, Murauskis, Van Geem, Wattenberg Nays: None Motion carried. An Ordinance was presented for first reading that AMEND would amend Sections 18.501.1 and 18.501.2 of CH.18 Chapter 18 which would establish a fine for indigent DUI: IMPLIED persons convicted of driving under the influence CONSENT {implied consent). This Ordinance will be presented for second reading on July 19th. NEW BUSINESS ZBA 30-V-88, 902 - 918 Whitegate Drive ZBA 30-V-88 It was noted that this case deals with a request for 902 - 918 a replacement fence for all but one home of this WHITEGATE DR block. The existing fence is 6 feet high, which height is permitted due to the fact that the rear yards of these properties abut an arterial roadway- Central Rcad. Page 3 - July 5, 1938 122 The request was to permit an 8 foot hiqh fence, due to the fact that the grade at the fence line on some of the properties is lower and at those points the fencing would result in an 8' height. This case was heard by the Zoning Board of Appeals, which Board was final in its decision to grant the request, however 3 residents on the north side of Central Road filed an objection to the decision of the zoning Board of Appeals. Mrs. Judy Kermin, objector, stated that some of the property owners requesting the variation do not maintain the green area between the curb and fence and stated that she and the other 2 objectors feel the request should be denied. Mr. Judd Strickland spoke on behalf of the Petitioners stating that the area will be maintained and that a couple of the Petitioners have stated that they will have gates installed for easier access to the area behind the fence. The Zonlng Board of Appeals recommended a comprise be reached whereby the height at the top of the fence would be uniform for those participating, allowing the height to exceed 6 feet in those areas where the ground elevation is lower. It was noted that while the objectors are following the established procedure, the ?etitioners could obtain a permit for a 6 foot high fence without having to go through the hearing process. Trustee Floros, seconded by Trustee Murauskis, moved 5o concur with the decision of the Zoning Board of Appeals to permit a uniform fence height of 6 feet for the subject properties which would result in a height of eight feet in some areas. Upon roll call: Ayes: Ftoros, Murauskis, Van Geem, Krause Nays: Wattenberg Motion carried. An Ordinance will be presented for first reading on July 19th. ZBA 35-V-S8 ZBA 35-V-88, 401 Man A Wa 4~! MAN A WA The Petitioner is requesting a variation to permit a 15 foot rear yard rather than the required 25 fee~ in order to construct a 2 car attached garage and convert the existing 1 car garage into a family room on this corner lot. The Zoning Board of Appeals recommended granting this request. Trustee Floros, seconded by Trustee Murauskis, moved to concur with the recommendation of the Zoning Board of Appea!~ and grant the request for a 15 foot rear yard. Upon roll call: Ayes: Floros, Murauskis, Van Geem, Wattenberg Nays: None Motion carried. An Ordinance will be presented July !9th for first reading. Page 4 - July 5, 1988 123 ZBA 36-V-88, 1450 River Road (R.J.'s Ranch) ZBA 36-V-88 The Petitioner is requesting a variation to permit 1450 RIVER RD a 4-1/2 foot front yard instead of the required 25 feet for this small restaurant. The Zoning Board of Appeals recommended granting this request by a vote of 7-0. Trustee Van Geem, seconded by Trustee Wattenberg, moved to concur with the recommendation of the Zoning Board of Appeals and grant the requested variation. Upon roll call: Ayes: Fioros, Murauskis, Van Geem, Wattenberg Nays: None Motion carried. An Ordinance will be presented for first reading on July !gth. a~ons from Development Code. 1450 River Road, Modific ~ A request was presented to the Plan Commission for modifications from the Development~Code to permit two 36 foot drivewaysf rather than a two-way driveway 24 feet wide; and~ tc install the required street lights at a later date. There was also discussion as to the landscaping required, however at the time the Petitioner had not submitted a landscape plan acceptable to staff. The Plan Commission uecommended granting the mc~difications. Trustee F!oros, seconded by Trustee Wa~tenberg, moved to concur with the recommendation of the Plan Commission and authorize the modifications from The Development Code, pr.3vided the staff and Petitioner work out an acceptable landscape plan. It was noted that the Petitioner has been granted a ~emporary Occupancy Certificate and at the request of the Petitioner an extension of 60 days was granted in order to allow sufficient time to comply with the Village requirements. An Oudinance will be presented for first reading at the July 19th meeting of the Village Board. ZBA 37-V-88~ 1001 Robert Drive ZBA 37-V-88 The Petitioner is req%~esting a variation from the 1001 ROBERT DR side yard requirements to permit replacement of an existing patio 18" from the side lot line. The Zoning Board of Appeals recommended granting the variation requested by a vote of 7-0. Trustee Murauskis, seconded by Trustee Floros, moved to --- concur with the recommendation of the Zoning Board of Appea~o and grant the variation requested. Page 5 - July 5, 1988 ZBA 40-V-88 ZBA 40-V-88, 1618 Dogwood Lane 1618 DOGWOOD The Petitioner is requesting a variation from the setback requirement to permit a swimming pool 4-1/2 feet from the side lot line instead of the required 7-1/2 feet and to reduce the required 10 foot separation between structures to 6 feet. The Zoning Board of Appeals recommended granting these requests by a vote of 7-0. Trustee Wattenberg, seconded by Trustee Van Geem, moved to concur with the recommendation of the Zoning Board of Appeals and grant the variations requested. ZBA 41-V-SS, 315 Bobby Lane 315 BOBBY LN The Petitioner is requesting a variation to reduce the side yard requirement of 8' to 4' in order to permit a wooden deck. The Zoning Board of Appeals recommended granting this request by a vote of 7-0. Trustee Wattenberg, seconded by Trustee Floros, moved to concur with the recommendation of the Zoning Board of Appeals and grant the variation requested. Upon roll call: Ayes: Ftoros, Murauskis, Van Geem, Wattenberg Nays: None Motion carried. An Ordinance will be presented July !9th for first reading. STACHURA SUB. The Petitioner is proposing the resubdivision of 1220 CARDINAL this parcel into 2 lots of record. There is an existing home on one lot with the development of the other as a proposal. It was noted that the creation of lots of record is required due to the fact that the homeowner's well is running dry, requiring connection to the Village water and sanitary system. The Plan Commission has reviewed the plat of subdivision and recommends granting the request. Trustee Wattenberg, seconded by Trustee Murauskis, moved to authorize the Mayor to sign and Clerk to a~test her signature on the Stachura Plat of Resubdivisi. on. Page 6 - July 5, 1988 125 Mrs. Stachura questioned the bill she received from the Village for the various items connected with tapping-on to the Village system. Mayor Krause asked that a copy of the bill be brought to the Village Manager's office for review and determination. Cantella Resubdivision, 219 s. Hi Lusi CANTELLA The Petitioner is proposing the resubdivision of RESUB. this parcel into two lots of record. The Plan Commission has reviewed the proposal and recommends approval. Trustee F!oros~ seconded by Trustee Murauskis, moved to authorize the Mayor to sign and Clerk to attest her signature on the Cantella Plat of Resubdivision. '~ An Ordinance was presented for first reading that AMEND would amend Chapter I1 of the Village Code to provide CH. 11 for a revocation of business license procedure for contractors. This Ordinance will be presented July 19th for second reading. VILLAGE .MANAGER'S REPORT Village Manager 3ohn Fulton Dixon presented the following bid resulss: The following bids were received for a backhoe/loader BACKHOE/ tractor: LOADER Bidder Amount West Side Tractor $65,818.00 Trade in allowance $t0,000.00 Martin Equipment of Illinois $77,500.00 Trade in allowance $18,500.00 Trustee wattenberg, seconded by Trustee Floros, moved WEST SIDE to concur with the recommendation of the TRACTOR administration and accept the low bid submitted by West Side Tractor Sales Company for one backhoe/loader tractor at a cost not to exceed $55,~t8.00. Trustee Van Geem Stated that inasmuch as the purchase price of various pieces of equipment appear in the budge~ without the trade-in allowance that all monies received as a result of trade-in value be placed into the Capitol Improvement account. The Village Manager stated that such a policy would be instituted. GRAHAM OIL Trustee Floros, seconded by Trustee Wattenberg, moved to waive the requirement for pricing on OPIS and accept the low bid submitted by Graham Oil Co. at a delivered cost of .6056 for gasoline and .4544 for diesel fuel. upon roll call: Ayes: Floros, Murauskis, Van Geem, Wattenberg Nays: None ~ction carried. Upon roll call:' Ayes: Floros, Murauskis, Van Geem, wattenberg Nays: None Motion carried. 127 Mr. Dixon presented a report from Greeley &Hansen HIGH Consulting Engineers relative a review of the PUMPING: village's high pumping equipment recommended energy GREELEY efficient improvements and replacements of equipment. HANSEN Due to the fact that Greeley & Hanson are familiar with the Village's equipment, it is the recommendation of the administration that the bidding process be waived and authorization given for Greeley & Hanson to provide the engineering services for the design, bidding and associated inspection to replace one high service pump at Stations 5, 16 and 17 with new high efficiency pumping units, as well as preparing a performance type specification for the existing computer software. Trustee Wattenberg, seconded by Trustee Floros, moved to concur with the recommendation of the administration to waive the bidding procedure and authorize a contract not to exceed $14,000 with Greeley & Hanson to review the high service pump equipment and related matters. upon roll call: Ayes: Floros, Murauskis, Van Geem, Wattenberg Nays: None Motion carried. Village Manager Dixon noted that the jurisdictional transfer agreement will be presented on the next Committee of the Whole agenda for Schoenbeck Road. This transfer is necessary in order for the County to upgrade and improve this roadway. Mr. Dixon announced that the railroad crossing at Elmhurst ~oad will beg~n July 9th and should take about 3 weeks. It is anticipated that the Chicago Northwestern employees will go on strike August Ist however the improvement should be completed by then.
