Warren Fischer, who is RETIRE retiring from the Police Department. MICHAEL George Gattas, Secretary of the Fire and Police SALATINO Commission administered the oath to Michael Salatino SGT. upon being promoted to Sergeant. Representative of the Police Explorers presented Sgt. Saiatino with a plaque of appreciation for the years of service to that group of young people. HAYOR'S REPORT AMEND An Ordinance was presented for .second reading that CH. 13 amends Chapter 13 to prohibit the sale of individual CHILLED containers of chilled alcoholic beverages with the ONE CAN contents less than 750 ml. (25.36 oz.). CONTAINER The owners of Gold Eagle Liquors and Arlington Beverage spoke in opposition to this regulation. ORD. NO. OLD BUSINESS ZBA 13-SU-88 ZBA 13-SU-88, 1020 East Rand Road 1020 E.RAND An Ordinance was presented for second reading that would grant a special use, amending Ordinance No. 3364, to permit an existing portico to be enclosed. The enclosure will add an additional 258 sq. ft. The Zoning Board of Appeals recommended granting this request. ZBA 23-V-88 ZBA 23-V-88, 1420 sauk Lane 1420 SAUK LN An Ordinance was presented for second reading that would grant a variation to permit a 1.5 foot separation between a shed and the house. The Zoning Board of Appeals recommended denying the request due to possible safety problems. Page 2 - June 21, 1988 111 Trustee Arthur, seconded by Trustee Murauskis, moved for ORD.NO. 3949 passage of Ordinance No. 3949 AN ORDINANCE GRANTING VARIATIONS FOR PROPERTY COMMONLY KNOWN AS 1402 SAUK LANE Upon roll call: Ayes: Arthur, Floros, Murauskis, Van Geem, Wattenberg Nays: Farley Motion carried. An Ordinance was presented for second reading that SS #6 would authorize the issuance of $350,000 unlimited tax BONDS to finance the installation of curbs, gutters and roadway improvements f6r a portion of south Albert and south George Streets, which project is known as Special Service Area No. 6. It was noted that the bids were invited with the results being the most favorable having been received from the Ist National Bank of Mount Prospect. Trustee Farley, seconded by Trustee Wattenberg, moved ORD.NO.3950 for passage of Ordinance No. 3950 AN ORDINANCE AUTHORIZING THE ISSUANCE OF $350,000 SPECIAL SERVICE AREA NO. 6 UNLIMITED TAX BONDS OF THE VILLAGE OF MOUNT PROSPECT Upon roll call: Ayes: Arthur, Farley, Floros, Murauskis, Van Geem, Wattenberg Nays: None Motion carried. An Ordinance was presented for second reading that O.G.BONDS would authorize the issuance of general obligation PROSPECT bonds, Series 1988, in the amount of $500,000 for MEADOWS special Service Area No. 6 (portions of south George SEWERS and Albert Streets improvement). Trustee Arthur, seconded by Trustee wattenberg, moved ORD.NO.3951 for passage of Ordinance No. 3951 AN ORDINANCE AUTHORIZING THE ISSUANCE OF $500,000 GENERAL OBLIGATION BONDS, SERIES 1988, OF THE VILLAGE OF MOUNT PROSPECT Upon roll call: Ayes: Arthur, Farley, Floros, Murauskis, Van Geem, Wattenberg Nays: None Motion carried. ZBA 25-V-88, 903 Kennicott Place ZBA 25-V-88 An Ordinance was presented for first reading that would 903 KENNICOTT author!ze a driveway 41 feet wide at the garage, and a 3 car garage 730 sq. ft. in size. The Zoning Board of Appeals recommended granting these requests. NEW BUSINESS ZBA 28-V-88 ZBA 28-V-88, 601 North Wille Street 601 N. WILLE The Petitioner is requesting a variation to allow a zero foot setback from th~ interior side lot line in order to construct a shed. This request was amended at the Zoning Board of Appeals to provide for a 30" setback. The Zoning Board of Appeals recommended granting this request by a vote of 7-0. Trustee Arthur, seconded by Trustee wattenberg, moved to concur with the recommendation of the Zoning Board -- of Appeals and grant the variation, as amended. ZBA 29-V-85 ZBA 29-V-88, 605 South Edward Street 605 S.EDWARD The Petitioner Is requesting a variation to permit a 2 foot setback from the side property line In order to construct a detached garage. The Zoning Board of Appeals recommended granting this request by a vote of 7-0. Trustee Farley noted that the Zoning Board of Appeals had placed a condition on the property owner that required him to park his recreational vehicle in the garage. It was stated that this regulation is not enforced throughout the Village and this restriction should not be placed on this property owner. It was the consensus of the Village Board that this restriction should not be placed on the Petitioner. ~ - Page 4 - June 21, 1988 113 Trustee Wattenberg, seconded by Trustee Farley, moved to concur with the recommendation of the Zoning Board of Appeals with the exception of. the requirement to park the recreational vehicle in the garage. A Resolution was presented that would authorize execution PRAIRIE of an agreement between the Village and the Prairie Girl GIRL Scouts for the Boxwood Advocacy Program. SCOUTS Trustee Arthur, seconded by Trustee Farley, moved RES.NO.22-88 for passage of Resolution No. 22-88 A RESOLUTION AUTHORIZING THE EXECUTION OF AN AGREEMENT BETWEEN THE VILLAGE OF MOUNT PROSPECT AND THE ILLINOIS PRAIRIE GIRL SCOUT COUNCIL, INC. BOXWOOD ADVOCACY PROGRAM Upon roll call: Ayes: Arthur, Farley, Floros, Murauskis, Van Geem, wattenberg Nays: None Motion carried. A Resolution was also presented that would authorize PRAIRIE execution of an agreement.between the Village and the GIRL Illinois Prairie Girl Scout Council, Inc. Boxwood SCOUT Summer Program. Trustee Farley, seconded by Trustee Wattenberg, moved RES.NO.23-88 for passage of Resolution No. 23-88 A RESOLUTION AUTHORIZING THE EXECUTION OF AN AGREEMENT BETWEEN THE VILLAGE OF MOUNT PROSPECT AND THE ILLINOIS PRAIRIE GIRL SCOUT COUNCIL, INC. BOXWOOD SUMMER PROGRAN Upon roll call: Ayes: Arthur, Farley, Floros, Murauskis, Van Geem, Wattenberg Nays: None Motion carried. In order to accommodate residents in the audience, an AMEND CH.23 Ordinance presented for first reading that would prohibit TRAIN the blowing of train whistles other than in an WHISTLES emergency situation was moved forward on the agenda. It was noted that since the SOO line had been acquired by wisconsin Central, the train engineers have been blowing the train whistle at every crossing throughout the day and night, which is very disturbing to the residents in that area. ORD.NO.3953 Trustee Farley, seconded by Trustee Murauskis, moved for passage of Ordinance No. 3953 AN ORDINANCE AMENDING ARTICLE I OF CHAPTER 23 OF THE VILLAGE CODE Upon roll call: Ayes: Arthur, Farley, Floros, Murauskis, Van Geem Nays: Wattenberg Motion carried. PREVAILING An Ordinance was presented for first reading that would WAGE adopt the prevailing wage, as established by the State of Illinois, for public works projects. Trustee Farley, seconded by Trustee Arthur, moved to waive the rule requiring two readings of an ordinance. ORD.NO.3954 Trustee Farley, seconded by Trustee Wattenberg, moved fo~ passage of Ordinance No. 3954 AN ORDINANCE PERTAINING TO A DETERMINATION OF THE PREVAILING WAGE RATES OF THE VILLAGE OF MOUNT PROSPECT Upon roll call: Ayes: Arthur, Farley, Floros, Murauskis, Van Geem, Wattenberg Nays: None Motion carried. SIGNAL A Resolution was presented that would authorize execution IMPROVEMENT of an Agreement between the Village of Mount Prospect and ELMHURST & the Illinois Department of Transportation relative to the OAKTON traffic signal improvement of the intersection of Oakton street and Elmhurst Road. It was noted that this is a joint project between the Village, Des Plaines and the Stat e Highway Department and the only cost to the Village is for the installation of Opticom. Trustee Van Geem left the meeting for a short period. RES.NO.24-88 Trustee Floros, seconded by Trustee Murauskis, moved for passage of Resolution No. 24-88 A RESOLUTION AUTHORIZING EXECUTION OF A JOINT PARTICIPATION AGREEMENT WITH THE ILLINOIS DEPARTMENT OF TRANSPORTATION FOR THE SIGNAL IMPROVEMENT OF OAKTON STREET AND ELMHURST ROAD Upon roll call: Ayes: Arthur, Farley, Floros, Murauskis, Wattenberg Nays: None Motion carried. Page 6 - June 21, 1988 115 A Resolution was presented that would appropriate MFT FUNDS $2,875.00 from Motor Fuel Tax Funds for Opticom at the Elmhurst Road and Oakton Street intersection. Trustee Floros, seconded by Trustee MurauSkis, moved RES.NO.25-88 for passage of Resolution No. 25-88 A RESOLUTION APPROPRIATING FUNDS FOR THE IMPROVEMENT OF THE TRAFFIC SIGNAL AT ELMHURST ROAD AND OAKTON STREET Upon roll call: Ayes: Arthur, Farley, Floros, Murauskis, Wattenberg Nays: None Motion carried. An Ordinance was presented that would prohibit parking on Oakton Street, which is a requirement of the State in conjunction with the improvement of the traffic signal at Elmhurst Road and Oakton Street Trustee Murauskis, seconded by Trustee Arthur, moved to waive the rule requiring two readings of an Ordinance. Trustee Murauskis, seconded by Trustee Floros, moved for ORD.NO.3955 passage of Ordinance No. 3955 AN ORDINANCE AMENDING CHAPTER 18 TO PROHIBIT PARKING ON OAKTON STREET Upon roll call: Ayes: Arthur, Farley, Floros, Murauskis, Wattenberg Nays: None Motion carried. An Ordinance was presented for first reading that also pertains to the proposed traffic signal improvement of Elmhurst Road and Oakton Street, which Ordinance will prohibit the discharge of sanitary sewerage onto Elmhurst Road or Oakton Street. Trustee Murauskis, seconded by Trustee Farley, moved to waive the rule requiring two readings of an Ordinance. Upon roll call: Ayes: Arthur, Farley, Floros, Murauskis, Wattenberg Nays: None Motion carried. Trustee Van Geem returned to the meeting at this point. Also in conjunction with the traffic signal improvement of Elmhur~t Road and Oakton Street, an Ordinance was presented for first reading that would prohibit encroachments onto Elmhurst Road or Oakton Street. ORD.NO.3957 Trustee Arthur, seconded by Trustee Mu~auskis, moved for passage of Ordinance No. 3957 AN ORDINANCE PROHIBITING ENCROACHMENTS ON ELMHURST ROAD OR OAKTON STREET IN THE VILLAGE OF MOUNT PROSPECT Upon roll call: Ayes: Arthur, Farley, Floros, Murauskis, Van Geem, Wattenberg Nays: None Motion carried. IMRF A Resolution was presented that would amend and clarify CENTRAL the Agreement with Northwest Central Dispatch System DISPATCH and authorize the employees of the agency to be members of the Illinois Municipal Retirement Fund (IMRF) through their employer. The employees have participated in IMRF through one of the member municipalities to this point. Trustee Murauskis left the meeting at this point. RES.NO.26-88 Trustee Arthur, seconded by Trustee Wattenberg, moved for passage of Resolution No. 26-88. A RESOLUTION AMENDING THE VENTURE AGREEMENT WHICH ESTABLISHED THE NORTHWEST CENTRAL DISPATCH SYSTEM Upon roll call: Ayes: Arthur, Farley, Floros, Van Geem, Wattenberg Nays: None Motion carried. VILLAGE MANAGER'S REPORT PUBLIC WORKS Village Manager John Fulton Dixon presented a request FACILITY for a change order for the ?ublic Works facility presently under construction. 117 The changes proposed pertain to 26 different areas and involve an additional cost of $34,277. Trustee Arthur, seconded by Trustee Wattenberg, moved to authorize the change order for the new Public Works facility at an additional cost of $34,277. Upon roll call: Ayes: Arthur, Farley, Floros, Van Geem, Wattenberg Nays: None Motion carried. Trustee MUrauskis returned to the meeting. Bid results were presented for the improvement of COM.ED. the Commonwealth Edison right-of-way project located R.O.W. south of Algonquin Road and west of Busse Road, around IMPROVE. the Higgins Creek. The improvement includes a pedestrian bridge, landscaping, and specified areas. A complete tabulation of the bids received for each category is attached to these minutes. The low bid for each'category is as follows: Asphalt Pathway Dekaf Paving, Inc. $30,888.37 Landscaping: Shrubs Klehm Nursery $ 9,395.85 Landscaping: Trees Klehm Nursery $11,295.00 Purchase of Bridge Continental Bridge $ 5,853.00 Installation of Bridge 3-D Construction Inc. $ 3,020.00 Caisson Construction 3-D Construction Inc. $ 3,300.00 Trustee Wattenberg, seconded Trustee Farley, moved to accept all the low bids as listed above for the Commonwealth Edison right-of-way. upon roll call: Ayes: Farley, Floros, Murauskis, Van Geem, Wattenberg Nays: Arthur Motion carried. A request for a field change was presented by the EVERGREEN Village Manager. The devsloper of Evergreen Woods WOODS Townhomes, located on Golf Road at Meier Road, has FIELD requested permission to offer patios 10' x 20' on 15 CHANGE of the 55 townhomes to be built on this site. The Planned Unit Development provides for patios 8' x 10' It was explained that this would be offered as an option and while there is a possibility that no one will take advantage of the offer the developer would like to make the offer. Page 9 - June 21, 1988 Trustee Farley, ~econded by Trustee Watterkberg, moved to grant the field change for the Evergreen Woods subdivision Planned Unit Development and authorize 15 patio or decks 10' x 20' as options to the purchasers. ALTER GROUP An Agreement between the Alter Group and the Village AGREEMENT relative to the time period required for the installation of street lights for the development north of Algonquin Road and west of Elmhurst Road (Lake Center Plaza) was deferred until such time as a formal document is presented for consideration by the Village. TIF An Ordinance was presented that would authorize an AMEND amendment to the development agreement between the AGREEMENT Village and Home by Hemphiil pertaining to the development of the Tax Increment Financing District No. I (Northwest Highway and School Street area). Trustee Wattenberg, seconded by Trustee Arthur, moved to waive the rule requiring two readings of an Ordinance. ORD.NO.3958 Trustee Wattenberg, seconded by Trustee Arthur, moved for passage of Ordinance No. 3958 AN ORDINANCE AMENDING ORDINANCE NO. 3896 AMENDING THE AGREEMENT BETWEEN THE VILLAGE OF MOUNT PROSPECT AND HOME BY HEMPHILL Upon roll call: Ayes: Arthur, Farley~ Floros, Murauskis, Van Geem, Wattenberg Nays: None Motion carried. Mr. Dixon noted that the railroad crossing improvement at Central Road was underway and should be completed by the 1st of July. Due to the fact that various items are still being completed by staff, the Committee of the Whole meeting for Tuesday, June 28 was cancelled.
