HomeMy WebLinkAboutRes 35-65 11/23/1965 Resolution No.~~i~ RESOLUTION OPPOSING PROPOSED REZONING IN COOK COUNTY ZONING BOARD OF APPEALS DOCKET NO. 960 WHEREAS, there is presently pending before the Zoning Board of Appeals of Cook County, Illinois, an application for reclassification of certain property known as the Magnus Farm from the R-4 District to the R-5 District; and WHEREAS, said proposal has been docketed and heard as Docket No. 960 before the Zoning Board of Appeals of Cook County, Illinois; and WHEREAS, the Village of Mount Prospect has appeared at said public hearing on November 15, 1965, and then and there stated its opposition to said proposed amendment unless a restrictive covenant running with the land for a term of twenty-five (25) years is imposed upon the subject property pursuant to which covenant said property would be limited for use solely as a nursing and convalescent home, and as a retire- ment home for persons of the age of fifty-five years, or more; and WHEREAS, the President and Board of Trustees of the Village of Mount Prospect have considered said application for rezoning and have determined that the rezoning of said property from the R-4 District to the R-5 District under the Zoning Ordinance of the County of Cook would be highly detrimental to the Village of Mount Prospect and the citizens of Cook County, unless said restrictive covenant as described above were recorded to run with the land; and WHEREAS, the corporate limits of the Village of Mount Prospect abut upon the property which is the subject of the application made in said Docket No. 960, and the said Village -2- of Mount Prospect is a municipality lying within 1-1/2 miles of the said subject property; and WHEREAS, the President and Board of Trustees of the Village of Mount Prospect desire to exercise the authority to file a formal objection conferred upon them by Section 3158 of Chapter 34 of the Illinois Revised Statutes. NOW, THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, ILLINOIS: SECTION ONE: That the Village of Mount Prospect does hereby oppose the granting of the application for rezoning from the R-4 District to the R-5 District by Matilda Magnus and Alexander B. Magnus, Jr. of certain property located in Elk Grove Township and docketed as Docket No. 960 before the Zoning Board of Appeals of Cook County, unless there is imposed upon the subject property of said application a covenant running with the land for a term of twenty-five (25) years whereby the use of said land is restricted and limited solely to a nursing home, a convalescent home, and retirement home providing dwell- ing units or buildings for persons of the age of fifty-five years or more. SECTION TWO: That prior to any action on said zoning, the Village of Mount Prospect hereby requests that there be transmitted to the attorneys for said Village, such restrictive covenant for approval in accordance with the intent of Section One. SECTION THREE: That immediately upon the publication and approval of this Resolution, the Village Clerk of the Village of Mount Prospect be, and he is hereby, authorized and directed to transmit certified copies of this Resolution to the County Clerk of Cook County, to the Secretary of the Zoning -3- Board of Appeals of Cook County, and the President of the Board of Commissioners of Cook County" SECTION FOUR: This Resolution shall be in full force and effect from and after its passage and approval in the manner provided by law.
