Ordinance regulating the moving of housss and buildings, providing for permits and licenses therefor, and for the raising or removal of wires, etc. Be it ordained by the President and Board of Tru~ tees of the Village of Mount Prospect;- Sectien I - No person sha.ll engll.g'p in or carry en the business of moving houses or building~~in the Village of Mount Prospect, or remove or at.tempt to remove any house or building from one place to another in the said Village unless he b~ licensed to do so in accordance with the pr~ visions of tbis ordinance. ( \ Section 2_- Any person may procure a license as a house mover in 9.:l.id village authorizing him to engage in or carryon the business of moving houses or build- ings from place to place in the said Village of Mount Prospect from the Vill~ge Clerk of said Village upon the payment by him of the license fee of one Dollar (~l.OO) . . and upon the execution and filling with the Clerk of a bond in the penal sum of Two Hundred Dollars (~200.), with sureties to be approved by the president of t.he Village of Mount Prospect conditioned for the faithful observance and perforMance of the ordinances of the said Village concerning the moving of houses or buildings from place to place within theVillage, and conditioned futher to pay all damages whi~h may occur to any pave- ment, street, sidewalk or any pole, wire, cable, electric- al appliances, and to pay all damages which may occur to the property of any person in t.he said Village caused by or arising out of any act or thing done by such house mover in and about the Toving of any house or tuilding in the said Village, or which shall be done by the Baid house mover under or by virt.ue of the authority given in this ordinance. t Section) - No house ~over shall remove any house or building from one p1a8e to another v.'i thin tt.e said Village without a permit issued for that purpose .c b-y the Vill-&.F:e Cler~o. 2resident upon due applicat.ion made by the said house mover design~ting in such appli- cation the discript.ion of the house or building, its location, the place to which it is desired to remove the same, and the route over which it is intended to.take such building , together with the consent in writing of the owners of the property located within a distance of 150 feet from the place to which it is desired to re- move said building. Provided,-however , that. if it is sought to re- move a house or building from one part of a lot to another part of the same lot , or from one lot to another lot where both lots are owned by the same person without crossing or going upon or along any street or-public way or across or along the property of any person other than the owner of the lot from which said house or building should be moved , then in that case no permit as provided for in Section? shall be necessary. . l:il.,.., 'L . ___J ~ --- Continued---- ,"'"" ,,'" ......... .# Section. - When it shall appear to the said Vill age Clerk that the removal so applied for as hereinbefore de- signated will necessitate the interfering with, disturbing or coming into contact with any telephone, telegraph or other electrical wire, cable or conductor, no permit shall be issued by said Village Clerk and President until the applicant therefor shall have made a deposit with the Village Clerk of a sufficient Bum to cover the cost of cutting, raising or making such other disposition of said wires , cables or electrical conductors as may be necessary to enable 'such building to pass along its route and also cover the cost and expence of replacing and re- pairing any such wire, cable or conductor so necessary to cut, raise or otherwise disturb. In the event that the deposit so made be more t~an sufficient to pay the expence necessary therefor, any amount remaining unexpended shall be forthwith returned to the person who has made such deposit. . r-'. ~, Section 5 - In any 'case v/here the issuance of such permit shall make necessary the interfering with, " disturbing or coming into contact with any te1ephcne,'tele- graph o~ any other elentrica1 wire, cable, or conductor the saId Village Clerk shall thereupon notify any private company maintaing or operating any wires or apparatus along or over any street so necessary to be interfered with or disturbed or touched, to raise or remove any said wire or conductors or apparatus so as to allow or permit build- ings to be moved a.long or acroee any street or highway, which said notice shall be in writing and mailed to said private company, and in the event that the said removal or raising is not done by the said private company with- in ten days after the mailing of said notice then the said Village Clerk shall authorize the same to be done and at the expence of the said company so refusing to comply with the said request. No licensed house mover shall cut, remove or other- wise interfere with any wire, cable or other electrical conductor strung upon, across or along any street or public way. .. Section 6 - Any person violating any of the pro- visions of this ordinance shall be fined not less than Twenty Five Dollars (t25.00) nor more than One Hundred Dollars(t100.00) ror each of~ence.
