BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COUNTY OF COOK AND STATE OF ILLINOIS: SECTION 1. DEFINITIONS. Whenever in this ordinance the I following terms are used, they shall have the meanings respec- i I " " I! II II II II II ,/ I' I I tively ascribed to them in this section. AUTHORIZED IDlERGENCY VEHICLE. Any vehicle of the Fire Department, Fire Patrol, Police Department, and any ambulance and any other emergency vehicle of a governmental agency. BUSINESS STREET. The length of any street between street intersections, when 50 percent or more of the entire frontage of II d II II I I i I' II ,I 'I I, 'I II Ii I! II r said street is occupied by buildings in use for retai:L,or whole- sale business, by hotels, banks, or office buildings, by railway stations, or by public buildings excepting schools. CROSSWPXK. That portion of a roadway ordinarily included within the prolongation or connection of sidewalk lines at intersections, or any other portion of a roadway clearly indi- cated for pedestrian crossing by markings on the surface. INTERSECTION. The ar~a embraced within the prolongation or connection of the property lines of two or more streets which join at an angle, whether or not one such street crosses the other. LOADING ZONE. The space adjacent to a curb reserved for the exclusive use of vehicles during the loading or unloading of passengers or materials. I MOTOR VEHICLE. Every vehicle, as herein defined, which III is self-propelled. I I OFFICIAL TRAFFIC SIGNALS. All signals, not inconsistent with this ordinance, placed or erected by authority of the Commissioner of pUblic Works or a public body or official having Ii jurisdiction, for the purpose of directing, warning or regulating II 'I traffi c. All signs, markings and devices, II other than signals, not inconsistent wi th this ordinance, placed I I or erected by authori ty of the Commissioner of Publicw~orks or of I a public body or official having jurisdiction, for the purpose of I guiding, directing, warning or regulating traffic. I OPERATOR. AnY person who is in actual physical control of a vehicle or street car. PARKING. The standing of a vehicle, whether occupied or I I I not, upon a roadway, otherwise than temporarily for the purpose I of and while actually engaged in loading or unloading, or in I I obedience to traffic regulations or traffic signs and signals. i PEDESTRIAN. AnY person afoot. II I or any officer authorized to direct or regulate traffic or to I I POLICE OFFICER. Every officer of the Police Department make arrests for violation of traffic regulations. PRIVATE ROAD OR DRIVEWAY. Every road or driveway not I I of I I I open to the use of the public as a matter of right for purpose I I i i I I I I I I I II I , I I I I any street and the lots abutting thereon. I PUBLIC BUILDING. A building used by the Village of I Mount Prospect, Cook County, and legally constituted Park District. the State of Illinois, or the United States Government. I I I I I I I ! PROPERTY LINE. The line marking the boundary between travel. -2- I ! RIGHT OF WAY. The privilege of the immediate use of the street or highway. ROADWAY. That portion of a street or highway between the regularly established curb lines or that part improved and in- tended to be used for vehicular travel. SAFETY ZONE. The area or space officially set~part with- in a roadway for the exclusive use of pedestrians and which is I I protected or is so marked or indicated by adequate signs as to be I , I plainly visible at all times while set apart as a safety zone. I SID~vALK. That portion of a street between the curb lines and the adjacent property lines. STREET OR HIGHWAY. Every way or place of Whatever nature open to the use of the pUblic,as a matter of right, for purposes of travel, excepting bridle paths or foot paths. or crossing such street. I I I I I II I I. TRAFFIC. Ped'strians, ridden or herded animals,vehicles, street cars and other conveyances either signly or together while I I I VEHICLE. Every device or animal by which any person or II property is or may be transported or drawn upon a street, except-, ing devices moved by human power or used exclusively upon rails. I I I I i ! I I I I I , I I j I i i I I I i I using any street fQT purposes of travel. For the purpose of this ordinance a bicycle shall be deemed a vehicle. PARKWAY. That portion of the public way lying between the regularly established curb line and the adjacent sidewalk line on the roadway side. -3- SECTION 2. AUTHORITY OF POLICE. COMPLY WITH DIRECTIONS. Operators of all vehicles must at all times comply with any direction, by sign or otherwise, of any police officer, as to placing, stopping, starting, approaching or departing from any place; the manner of taking up or setting down passengers, and loading goods in any place. Any operator violating any of the provisions of this section shall be fined in asum not exceeding $200.00. SECTION 3. CHAIRMAN OF THE POLICE COWUTTEE AUTHORIZED TO ADOPT REQULATIONS. The Chairman of the Police Co~~ittee is hereby empowered to make and enforce temporary regulations to cover emergencies or special conditions. SECTION 4. POBLIC EMPLOYEES TO OBEY TRAFFIC REGULATIONS. The provisions of this ordinance shall apply to the operator of any vehicle owned by or used in the service of any governmental agency, and it shall be unlawful for any said operator to violate any of the provisions of this ordinance, except as otherwise :: il permi tted in this ordinance. Ii !I I I !I iI Ii I I I I I' II SECTION 5. EXEMPTION TO AUTHORIZED EMERGENCY VEHICLES. The provisions of this ordinance regulating the movement, parking a.nd standing of vehicles shall not apply to authorized emergency vehicles as defined in this ordinance while the operator of such vehicle is operating the same in an emergency in the necessary performance of public duties. This exemption shall not, however, protect the operator of any such vehicle from the consequences of reckless disregard for the safety of others. SECTION 6. STOPPING AND TURNING. No operator of a vehicle shall suddenly stop, slow down or attempt to turn without first signalling his intention so to do with outstretched arm I II or otherwise to those following closely in the rear. Anyone II I I -4- violating any of the provisions of this section shall, on con- viction, be fined in a sum not exceeding $100.00. SECTION 7. COMPLY WITH SIGNS. Any operator of a vehicle, or other conveyance, who shall fail or neglect to comply with any sign, light, signal, signal device or reflector for the regula- , ; tion and direction of traffic in the Village of .aunt Prospect, shall be fined not less than $1.00 and not more than $200.00 for each offense. SECTION 8. SIGNS AND SIGNALS. The Chairman of the Police Committee, by and with the consent of the Board of Trustees, shall determine and designate the character of all official signs and signals and to make regulations necessary to make effective the provisions of this ordinance. It shall be his duty, by and :i with the consent of the Board of Trustees, to place and maintain, ii II or cause to be placed and maintained, all official signs and 'I II il signals herein required. 1 I I particular purpose shall be uniform. OBEDIENCE TO TRAFFIC SIGNS AND SIGNALS. TRAFFIC SIGNAL LEGEND. (b) Any op.erator intending to turn to the right or at an intersection where traffic is controlled by an official I either such turn with proper care to avoid accident and only uponl I otherwi se I traffic signal or by a police officer, shall proceed to make the Green or "Go" signal, when turning left, unless directed by a police officer or by official traffic signs or -6- special signals, ~. SECTION 11. DISPLAY OR UNAUTHORIZED SIGNS PROHIBITED. It shall be unlawful for any person to place or maintain or to display any device upon or in view of any street, if such device purports to be, or is an imitation of, or resembles, an official traffic sign or signal, or directs or purports to direct the movement of traffic, or which hides from view or interferes with the effectiveness of any official traffic sign or signal, except- ing such signs for which permits have been obtained from the Chairman of the Police Committee. The Chairman of the Police Committee is hereby authorized to issue such permits and to prescribe the conditions thereof. Any such prohibited device is hereby declared to be a public nuisance and the Chairman of the Police Committee may remove it or cause it to be removed,without , notice. SECTION 12. INTEfitERENCE WITH OFFICIAL TRAFFIC SIGNS AND SIGNALS PROHIBITED. It shall be unlawful for any person wilfully to deface, injure, move or interfere with any official sign or signal. SECTION 13. CROSSWALKS AUTHORIZED. The Chairman of the Police eommittee is hereby authorized to establish and maintain , by appropriate devices or marks, crosswalks at all intersections Ii ii il where in his opinion there is particular danger to pedestrians II I, ,I !! I I I crossing the roadway. SECTION 14. SAFETY ZONES AUTHORIZED. The Chairman of the Police COmIni ttee by and wi th the consent of the Board of Trustees, 1s hereby authorized to establish and maintain signs, paint marks or other material, safety zones at such street car stops and other places as may in his discretion require such safety zones. -7- , il oil I' :1 I. i SECTION 15. TRAFFIC LANES AUTHORIZED. The Chairman of the police Committee, by and with the consent of the Board of Trustees, is hereby authorized to mark traffic lanes upon the roadway where a regular alignment of traffic is necessary. Vfuere such lanes have been marked and signs have been erected instruct- ing operators to keep in line, it shall be unlawful for any operator to fail or refuse to keep his vehicle within the desig- nated boundaries. SECTION 16. PEDESTRIANSt RIGHT OF WAY. (a) The operator of any vehicle shall yield the right of way to a pedestrian crossing the roadway within any marked crosswalk or within any unmarked crosswalk at the end of a block, except at intersections where the movement of traffic is being regulated by police officers or traffic control signals, or at any point where a pedestrian tunnel or overhead crossing has been provided. (b) Whenever any vehicle has stopped at any crosswalk to permit a pedestrian to cross the roadway, it shall be unlaw- ful for the operator of any other vehicle approaching from the rear to overtake and pass such stopped vehicle. (c) Any pedestrian crossing a roadway at any point other thanwlthin a crosswalk shall yield the right of way to vehicles upon the roadway. (d) The provision of this section shall not relieve an I operator of a vehicle or a pedestrian from the duty ~o exercise due care. SECTION 17. PEDESTRIANSt RIGHTS AND DUTIES AT CONTROLL D INTERSECTIONS. At intersections where traffic is controlled by official traffic signals or by police officers, operators of vehicles shall yield the right of way to pedestrians crossing or those who have started to crosS the roadway on a green or "Go" -8- ii Ii signal, and in all other cases pedestrians shall yield the right 1I Ii II of way to vehicles lawfully proceeding directly ahead on a green Ii Ii II or "Go" signal. Ii :1 'I I It shall be unlawful for any person to stand in a roadway for i I the purpose of so11ci ting a ride or employment from the operator :1 II of any pri va te vehicle. I SECTION 19. APPROACHING PERSON OR ANIMAL. Opon approach- I I ing a person waIting upon or along a street, or a horse or horses, I I or other draft or domestic animal or animals being ridden, led I lor driven thereon, the operator of a vehicle shall give reason- I I Ii able warning of his approach and use every reasonable precaution II to avoid injuring such person, or frightening or injuring such J horse, horses, or other draft or domestic animal, or animals, and, I SECTION 18. PEDESTRIANS SOLICITING RIDES OR EMPLOYMENT. if necessary, stop his said vehicle until he can safely proceed, and in case of any injury to a person or property on the street due to the presence or op;eration of a vehicle, the operator of such vehicle shall stop and, upon the request of a person 1n- I jured or any person present, give his name and address, and, if Ii ! not the owner of such vehicle together with his own name, the I name and address of such owner. Ii II II SECTION 20:" STOPPING, STANDING AND PARKING. STANDING II FOR LOADING OR UNLOADING ONLY IN CERTAIN PLACES. (a) The 'I II Chairman of the Police Committee shall have authority to deter- Ii, il'l mine the location of loading zones and shall determine the hours II ':[ When the provisions of (b) and (c) shall be applicable, all :il :1 subject to the approval of the Board of Trustees. 'I ii il to stop, stand or park said vehicle in any place marked as a II I I I (b) It shall be unlawful for the operator of a vehicle passenger zone other than for the expeditious loading or unload- -9- I ---- ing of passengers and in no case for a period longer than three minutes. (c) It shall be unlawful for the operator of a vehicle to stoPt stand or park said vehicle in any place marked as a loading zone other than for the expeditious loading or unloading . of passengers, or for the unloading and delivery or pick-Up and I I i loading of materials and in no case shall the stop for loading I I and for unloading of materials exceed thirty (30) minutes. I I I The Chairman of the police Committee shall designate loading zones and passenger zones by placing and maintaining suitable signs or markings. SECTION 21. STOPPING PROHIBITED IN SPECIFIED PLACES. It park such vehicle in any of the following places, except when shall be unlawful for the operator of a vehicle to stop, stand or ! I I I I I I necessary to avoid conflict with other traffic or in compliance I with the directions of a police officer or official traffic sign or signal: II ~l~ In any intersection; 2 In a crosswalk; 3 Opon any bridge, or viaduct, or in any subway and th approach thereto; (4) within twenty-five (25) feet of an official traffic signal or a through street sign on the approaching side; (5) Within twenty-five feet from the intersection of curb line, or, if none, then within fifteen feet of the inter- section of ~roperty lines at an intersection, except at alleys; (6 At any curb within fif'teen feet of a fire hydrant; (7 At any place within twenty (20) feet of the entrance to any fire station, and on the side of any street opposite the entrance to any fire station within seventy-five (75) feet of said entrance; (8) At any place where the standing of any vehicle will block the use of any driveway; 19) On any sidewalk; {lO) Alongside or opposite any street excavation or ob- structions when such stopping, standing or parking would obstruct traffic; (11) On the roadway side of any vehicle stopped or parke at the ed~e or curb of a street; t12) At any place where official traffic signs have been erected prohibiting stopping, standing and parking; -10- driveway (13) Within fifty (50) feet of the nearest rail of a interurban railway crossing; (14) On any pa.rkway; or to use said parkway, or any thereon, for turning purposes or as an aid thereto. SECTION 22. OTHER VEHICLES PROHIBITED FROM PARKING IN BOS OR TAXICAB STANDS. It shall be unlawful for the operator of any steam or vehicle other than a bus to stand or park in a bus stand estab- lished in accordance with the terms of this ordinance, or for any vehicle other than a taxicab to stand or park in a taxicab stand established in accordance with the terms of this ordinance, """-:" except that the operator of any passenger vehicle may te~porarily stop in any such stand for the purpose of and while actually engaged in the loading or unloading of passengers. SECTION 23. BOSES AND TAXICABS PROHIBITED FROM PARKING EXCEPT IN DESIGNATED STANDS. It shall be unlawful for the operator of any bus or taxicab to stand or park upon any street in any business district at any place other than at a bus stand or taxicab stand, except that this provision shall not prevent the operator of any such vehicle from temporarily stopping in accordance with other stopping or parking regulations at any place for the p~rpose of and while actually engaged in loading or unloading passengers. SECTION 24. PARKING PROHIBITED IN CERTAIN PLACES. It ",... shall be unlawful for the operator to stop, stand or park any vehicle upon a street other than an alley, in such a manner or under such conditions as to leave available less than ten (10) feet of the width of the roadway for free movement of vehicular traffic, eXcept upon anyone-way street and further, except that an operator may stop temporarily during the actual loading or I unloading of passengers or when necessary in obedience to traffic -11- regul8tions or official traffic signs or signals or a police officer. (a) manner of parking is indicated by official signs or pavement markings, the operator of a vehicle shall not stand or park such vehicle in a road~1 other than parallel with the edge of the roadway, headed in the direction of traffic, and with the curb- side wheels of the vehicle within six inches of the edge of the roadway, except as provided in the following paragraphs: (b) In places where, and at hours when, standing for th loading or unloading of merchandise or materials is permitted, vechiles used for the transportation of merchandise or materials may back into the curb to take on or discharge loads, when the owner of such vehicle holds a permit granting him such special privilege, and provided further that such permit shall be either in the possession of the operator or on the vehicle at the time such vehicle is ba~~ed against the curb to take on or discharge a load, and it shall be unlawful for any owner or operator to violate any of the special terms or conditions of any such special permit. ---' \(c) The Cbairman of the Police Committee is hereby authorized to issue, to any owner of a vehicle used to transport merchandise or materials, a special permit, renewable annually, and to state therein the terms and conditions thereof, allowing the operator of such vehicle the privilege of loading and un- loading while the vehicle is backed against the curb, if in the opinion of the Chairman of the Police Committee such privilege is reasonably necessary in the conduct of the owners' business and will not seriously interfere with traffic. -12- i: :1 'I Ii I II " II lawful for any person to park or cause to be parked any vehicle I! upon any street or parkway for the purpose of displaying it for Ii I! No person, firm or corporation, controlling, driving or operating any vehicle, shall cause or permit any such vehicle to stand or park longer than necessary to load or unload passengers who are Ii ready to depart therefrom wi t~~ space of fifty feet immediately ,I Ii ,I II !I II II II I: :, 'I II 'I II II d in front of the entrance of any hotel, nor within a space of fifty feet immediately in front of the entrance of any theatre during hours when such theatre is open for business, unless otherwise specified by official signs. -13- SECTION 30. DRIVING ALONG PARKWAY OR SIDEWALKS PRO- HIBITED. It shall be unlawful to drive any vehicle or bicycle over or along any parkway, curb or sidewalk in this city. SECTION 31. OPERATION OF VEHICLES. TURNING AT INTER- SECTIONS. The operator of a vehicle intending to turn at an intersection shall do so as follows: (a) i Approach for a right turn shall be made in the lanei ! for traffic nearest to the right hand side of the road way and the right turn shall be made as closely as practicable to the , right hand curb of the roadway. (b) Approach for a left turn shall be made in the lane for traifi c to the right 'of and nearest to the center line of the i I roadway, and the left turn shall be made by passing to the right of such center line where it enters the intersection, and upon leaving the intersection by passing to the right of the center line of the roadway then entered, unless otherwise directed by i , SECTION 32. No operator of a vehicle shall suddenly leave a parking space, slow down, stop or I I attempt to turn without first giving a signal with outstretched a~ ! or otherwise in such a manner as to apprise others, who might be i ! affected by his action, of his intention so to do. I SECTION 34. DRIVING FROM ALLEYS, DRIVEWAYS OR GARAGES. I The operator of a vehicle emerging from an alley, driveway or garage shall stop such vehicle immediately prior to driving on tol I I a sidewalk, or across a sidewalk line projected across such alley -14- sound the horn of said vehicle, and shall exercise unusual care in driving upon said sidewalk or across such line. SECTION 35. THROUGH STREETS. The following streets and parts of streets are hereby declared to constitute through streets for the purpose of this section: MAIN STREET, also known as ELMHURST ROAD, and NORTHWEST HIGHWAY. Every operator of a vehicle or other conveyance, travel- ing upon any street where stop signs have been erected at or near the intersection of any other street, shall stop such vehicle or other conveyance at the place where such street meets the prolong- ation of the nearest property line of such intersecting street before entering upon or crossing such intersecting street, subject, however, to the direction of any traffic control sign or signal or any police officer at such intersection. SECTION 36. (a) ESTABLISHING STOP SIGNS AND THROOGH STREET DEVICES. The Chairman of the Police Committee, by and with the consent of the Board of Trustees, is hereby authorized and required to place and maintain or cause to be placed and maintained at each and every street intersection of through and stop streets and at or near the property line of each through and stop street, appropriate signs upon the street (and in addition thereto may place and maintain any proper devices or marks in the I I: II Ii i' Ii I' ii Ii I I II II I, II II il I' II II roadway) such signs, devices or marks to bear the word "Stop" and to be located in such a position and to be provided with letters o~ a size to be clearly legible along the street inter- secting the through or stop street. All such signs shall be -15- k illuminated at night or so placed as to be illuminated by the headlights of an approaching vehicle or by street lights. (b) The Chairman of the Police Committee, by and with the consent of the Board of ~~stees, is hereby authorized to place and maintain or cause to be placed and maintained, stop signs conforming with the specifications of sub-section (a) of this section, at the approaches to such intersections as it may deem sufficiently dangerous to warrant requiring all vehicles from this direction to stop before entering such intersections and it shall be unlawful for the operator of any vehicle to fail to comply with such stop requirements. SECTION 37. VEHICLES NOT TO BE DRIVE~ ON SIDEWALKS OR PARKWAYS. No operator of a vehicle shall drive within any side- walk area or parl{way except at a permanent or temporary driveway. SECTION 38. RIGHT OF WAY. (1) In making a left turn at intersections of highways, motor vehicles shall give the right I of way to motor vehicles approaching from the opposite direction. i (2) Except as hereinafter provided, motor vehicles i I traveling upon streets of this village shall give the right of way I to vehicles approaching along intersecting streets from the right I I and shall have the right of way over those approaching from the I I left . I (3) Vehicles entering a through highway. The operator of I any vehicle who has stopped as required by law at the entrance to ia through highway shall yield to other vehicles within the inter- I section or approaching so closely on the through highway as to I I constitute an immediate nazard, but said operator having so yielde I may proceed and other vehicles approaching the intersection on the \ through highway shall yield to the vehicle so proceeding into or jacross through highway. ! -16- (4) In all cases, police v€hicles, fire department !i vehicles, vehicles transporting United States mail, and ambulances 'I I, I! shall have the right of way over all other vehicles. Anyone violating any of the provisions of this section shall be fined in a sum not exceeding $100.00. i! LIMITATIONS ON BACKING. The operator of a in safety and at a speed not in excess of five miles per hour. SECTION 40. FOLLOWING FIRE APPARATUS PROHIBITED. It shall be unlawful for the operator of any vehicle, other than one on official business, to follow closer than five hundred feet any fire apparatus traveling in response to a fire alarm, or to drive into or stop any vehicle within the block where fire apparatus has stopped in answer to a fire alarm. SECTION 41. CROSSING FIRE HOSE. No vehicle shall be driven over an unprotected hose of the Fire Department when laid down on any street, private driveway, to be used at any fire or alarm of fire, wi thout consent of the .Fire Department official in command. SECTION 42. OPERATING OF VEHICLES ON APPROACH OF Opon the approach of any author- ized emergency vehicle or vehicles giving audible signal, the operator of every other veh!cleSbal1 immediately drive the same il! to a position as near as possible and parallel to the right-hand 11 !II I'i edge or curb of the street, clear of any intersection, and shall stop and remain in such position until the authorized emergency vehicle or vehicles shall have passed, unless otherwise directed by a police officer. This section shall not apply to emergency vehicles ;i II il as defined in the 0 rdinace. !i " 'I !: (b) All motor vehicles forming a funeral cortege, when :1 Ii proceeding to any place of burial, shall carry on the right-hand II side of the windsb1"eM thereof a card which shall be white in Ii color and upon which shall be printed, stamped or stained, a I purple cross or star the extremities of which shall extend to the II edge of such card, and it shall be the duty of the undertaker II having charge of a funeral procession to supply each motor vehicle 'I III forming the funeral cortege wi th a card as above described. I SECTION 44. OBSTRUCTION TO OPERATOR'S VIEW OR DRIVING II MECHANISM. (a) It shall be unlawful for the operator of any II vehicle to drive the same when such vehicle is so loaded, or when I there are in the front seat of such vehicle such number of persons so as to obstruct the view of the operator to the front or sides, or to interfere with the operator's control over the driving I II I d I I II ,I Ii 'I II I, II II ,I Ii mechanism of the vehicle. (b) It shall be unlawful for any passenger in a vehicle to ride in such a position as to interfere with the operator's view ahead, or to the sides, or to interfere with the operator's control over the dn ving mechanism of the vehicle. SECTION 45:. CLINGING TO VEHICLES. It shall be unlawful for any person traveling upon any bicycle, motorcycle, or any I, toy vehicle, to cling to or attach himself or his vehicle to any !I: ,I: II I" " , other moving vehicle upon any roadway. SECTION 46. RIDING ON HANDLE BARS PROHIBITED. It shall ,I! be unlawful for the opera tor of any bicycle or motorcycle, when " ! 'j upon the street, to carry any other person upon the handle bar, frame or tank of any such vehicle, or for any person to so ride such vehicle. i upon any ii ,I I, II -18- SECTION 47. OSE OF COASTERS, SLEDS .AND SIMILAR DEVICES. It shall be unlawful for any person, upon skates, or riding in or by means of a coaster, sled, or toy vehicle, to go upon any roadway other than at a crosswalk. SECTION 48. MOTOR VEHICLES ONATTENDED. No vehicle shall be left unattended while the motor of said vehicle is running, and when standing upon a perceptible grade without turning the wheels of such vehicle to the curb or the side of the street or highway. SECTION 49. POSITION OF SLOW VEHICLES. Slow moving vehicles and all vehicles designed and used for the pulling or hauling of freight and all vehicles designed and used for the carrying of more than seven passengers, and all bicycles, must be . operated as close to the right-hand side of the roadway as con- ditions of traffic permit. SECTION 50. OVERTAKING A VEHICLE. Except as otherwise provided in this ordinance, the following rules shall govem the I I. !I I I I I I I overtaking and passing of vehicles: (a) The operator of a vehicle overtaking another vehicle proceeding in the same direction, shall pass to the left thereof at a safe distance and shall not again drive to the right side of the roadway until safely clear of such overtaken vehicle. (b) The operator of an overtaken vehicle shall give way to the right in favor of the overtaking vehicle on sui table and II audible signal and sball not increase the speed of his vehiele I until completely passed by the overtaking vehicle. All exhaust pipes carrying exhaust gas from the !I I, Ii engine shall be directed parallel to the ground or slightly Ii upward. ,I II SECTION 56. UNNECESSARY NOISE. It shall be unlawful to I, Ii operate a vehicle which makes unusually loud or unnecessary noise. Ii SECTION 57. REGULATIONS RESPECTING OPERATORS AND THE II EQUIPMENT AND CONDITION OF VEHICLES. DRIVER AGE LIMIT. No I' I: person shall operate or drive a motor vehicle who is under fifteen !I years of age, unless such person is accompa.nied by a duly licensed Ii chauffeur or the owner of the motor vehicle being operated. " Ii SECTION 58. INTOXICATED OPERATORS - PENALTIES. Any Ii Ii II person who shall drive or operate a vehicle upon any of the I i I streets of this village while drunk or intoxicated, shall, upon I oonviction thereof, for eaoh offense be punished by a fine of I ' \ not less than Fifty Dollars ($50.00) nor more than Two Hundred :1 Dollars ($200.00) for each offense. Ii I SECTION 59. SPEED RESTRICTIONS. For the purpose of this ordinance motor vehicles shall be divided into two divisions namely: First: Tpose vehicles which are designed and used for the carrying of not more than seven passengers; -21- Second: Those vehicles which are designed and used for pulling or carrying freight, and also those vehicles or motor ,cars which are designed and used for the carrying of more than seven persons: (a) No person shall drive a vehicle of the first division as herein defined upon any public street or highway in this village at a speed greater than is reasonable and proper having '[ :1 regard to the traffi c and the use of the way, or so as to endanger !i II the life or limb or injure the property of any person. Any person who drives any vehicle upon a street carelessly and heedlessly in wilful or wanton disregard of the rights or safety of others, or without due II caution and circumspection, and at a speed or in a manner so as to II endanger or be likely to endanger any person or property, shall I! be guilty of reckless driving. I II I unlawful for the operator of a vehicle which has collided with I any vehicle or person in such a manner as to cause an injury or I i damage to any person or property, to fail or refu se to stop II II i~~ediately to ascertain the extent of such injury or damage, to I I render such assistance as may be needed, to give his true name I and residence to the injured person or any other persons request- Every person who is convicted of reckless driving shall be SECTION 61. Such red light shall be in addition to any other light required to be carried by vehicles under the law of the state or any ordinance of the village. SECTION 64. TOWING OF VEHICLES - SPEED. It shall be unlawful to tow any vehicle at a rate of speed in excess of fifteen miles per hour. SECTION 65. MUFFLER REQUIRED. No motor vehicle shall be operated upon any street unless the same is provided with a muffler in efficient and actual working condition and the use of a cutout is forbidden. SECTION 66. BRA..T{ES. It shall be unlawful to operate any motor vehicle upon any street unless said vehicle is equipped with good and sufficient brakes in efficient working condition, or to operate any vehicle which is so loaded that the operator does not have ready access to the mechanism operating the brakes of said vehicle. SECTION 67. LIGHTS. When upon any street in this village during the period of from one hour after sunset to sunrise,every If L " bicycle, or motor bicycle shall carry one lighted lamp, and shall 'i I also be equipped with a rear reflector, ana every motor vehicle II ' shall carry 'I /two lighted lamps showing white lights, or lights of a yellow or II amber tint, visible at least two hundred (200) feet in the direction toward which each motor bicycle or motor vehicle is faced or proceeding, and each motor vehicle or trailer shall also exhibit at least one lighted lamp, which shall be so situa- ted as to throw a red light visible in the reverse direction. No motor vehicle or motor bicycle, except those used for fire -24- apparatus, police patrols or ambulances, shall have any lamps which show a red or green light in the direction in which such motor vehicle or motor bicycle is proceeding. On approaching another vehicle proceeding in an opposite direction, and when within not less than two hundred fifty (250) feet of same, any person in charge of a motor bicycle or motor vehicle equipped I I I I I I I i q I Ii alleys of the city which shall be equipped with any anti-skid or I ii i II I Ii i I' :1 I I with electric headlight or headlights shall dim, drop or extin- guish such headlights or headlight. No freight- carrying motor vehicle shall be operated upon the streets or non-slip device so constructed that any rigid or nonflexible portion of same comes in contact with the pavement. SECTION 69. The fee for suchl special permit shall be ten dollars ($lO.OO) to be paid to the I Village Collector before same is issued. I ;1 Whenever a freight-carrying vehicle passing over any street I I or alley of the village is found to be operating in violation of I I the provisions of this section, such vehicle shall not be per- i I mi tted to proceed further until the excess load is reduced or I permit secured to comply with the provisions of this section. SECTION 71. WIDTH OF VEHICLE AND LOAD. The maximum width of any vehicle and its load shall not exceed eight feet. SECTION 72. PROJECTING LOADS. No vehicle shall have any part of its load projecting beyond the front end of said vehicle nor projecting more than thirteen feet beyond the center line of the rear axle of sa! d. vehicle, and no load shall proj ect beyond the rear end of the bed or body of any vehicle, exclusive of the tail gate when lowered, a greater distance than three-fifths of the total length of such bed or body. SECTION 73. WARNING ON PROJECTING LOADS. Any vehicle having a load projecting more than four (4) feet beyond the rear of the body of said vehicle, between the hour of sunrise and the hour of sunset, must have firmly attached to the extreme rear -27- I :1 ,I il II end. of the projecting load, in such a way as to be seen by Ii II II II II I ! Such redlight shall be in addition to any other light required to be carried by vehicles under any law of the state or any ordinance of the village in regard to vehicles. SECTION 74. No vehicle driven and used for carrying freight, nor any vehicle or motor car designed and used for the carrying of more than seven (7) parsons, shall be operated upon mirror so attached that it will afford the driver a view of the street or highway behind him. SECTIO>> 75. TIRES. All freight~carrying motor vehicles I upon the public streets and alleys of the village shall have tire~ of rubber, or other material of equal resiliency; provided, that I I tires shall be considered defective and the use thereof shall not be permitted if the rubber or other material has been worn or I I otherwise reduced to a thickness of less than three-fourths of ani inch or if such t!~s have been so worn or otherwise damaged as to cause pounding on the pavement. SECTION 76. DRIVING THROOGH SAFETY ZONE PROHIBITED. It shall be unlawful for the operator of a vehicle at any time to drive the same over or through a safety zone as defined in this ordinance. SECTION 77. UNLAWFUL RIDING. It shall be unlawful for III any person to ride on any vehicle upon any portion thereof not I I designated or intended for the use of passengers when the vehicle is in motion. ~his provision shall not apply to an -28- ii II Ii II employee engaged in the necessary discharge of a duty, or within II truck bodies in space intended for merchandise. I, SECTION 78. ASHES, GARBAGE, ETC., NOT TO BE SCATTERED. I An operator of a vehicle loaded with ashes, garbage, cinders, , II coal, sand, mortar, snow, or any material shall not allow the II matter to be scattered along the street. T~ucks containing I! Ii paper, garbage or similar light material are to be suitably ii !! Ii covered so as to prevent such material from blowing out. Ii Ii :1 SECTION 79. PENALTIES. GENERAL PENALTY. Whoever violate s Ii ii any of the provi sions of this ordinance, except as otherwise Ii II !i herein provided for, specifically, shall be fined in a sum not " !I exceeding $100.00 for each offense. d SECTION 80. OWNER PRIMA FACIE RESPONSIBLE FOR ILLEGAL PAffi{ING. If any vehicle is found upon a street or highway in Ii, l' I: violation of any provision of this ordinance regulating the I i: stopping, s tanding or parking of vehicles and the iden ti ty of the I " I :1 :1 operator cannot be determined, the owner, or person in whose name i II I i,i such vehicle is registered, shall be held prima facie responsible I ~ I II for such violation. I II SECTION 81. The powers and duties given to and imposed i II upon the Chairman of the Police Committee of the Board of Trustee, II of this Village by the terms of this ordinance may be transferred! il and delegated to any other official, officer, appointee or employee of this village by resolution duly adopted by the President and Board of Trustees of this Village at any regular meeting of said President and Board of Trustees, and such official, officer, appointee or employee shall have the same powers and perform the same duties as though specifically named in this ordinance. SECTION 82. PARTIAL INVALIDITY. The invalidity of any portion or section of this Ordinance shall no~ affect the -29- validi ty of s.ny other portion or sectton thereof, which can be given effect without such invalid part. SECTION 83. REPEAL. All ordinances and parts of i ordinances which are in conflict with or contrary to the provision$ of this ordinance are hereby repealed. SECTION 84.
