HomeMy WebLinkAboutOrd 193 03/02/1937 At;;. jq?; AN ORDINANCE RELATING TO THE OWNERSHIP, CONTROL AND LIOENSING OF DOGS. BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPEOT, IN THE COUNTY OF OOOK AND STATE OF ILLINOIS: SECTION 1. Fierce Dogs At Large. If any owner or possessor of a fierce or dangerous dog shall permit the same to run or be at large at any time, within the limits of the Village of Mount Prospect, to the danger or annoyance of any of the inhabitants, such owner or possessor shall be fined not less than five dollars for each offense; and upon a second conviction of such owner or possessor, for such offense, the said dog shall be killed and buried. SECTION 2. Other Dogs At Large. If any owner or possessor of any dog shall permit the same to enter and trespass upon any grounds, yards, gardens, lawns or other premises not belonging to or under the control of such owner, within the limits of the Village of Mount Prospect, such owner or possessor shall be subject to a fine of not less than Two Dollars nor more then Five Dollars for each offense. SECTION 3. Owner Defined. Any person who shall harbor or suffer or permit any dog to be or remain at or about his house, stable, store or other premises in this Village, shall be held to be the owner of the same, and subject to the penal ties conta,ined in this ordin3nce. SECTION 4. Disposition of Dangerous Dogs. It shall be the duty of the Chief of Police to kill all dogs a,s provided in this ordinance and to superintend the removal and burial of the same, and to enforce the provisions of this ordinance. SECTION 5. Muzzling. Whenever it shall be made to appear to the President of this Village that there are good reasons for believing that all dogs should be muzzled, within the corporate limi te of thi s Village, it she,ll be the duty of said President to issue a proclamation requiring that all dogs shall, for a period to be stated in the procla.mation, wear a good substantia.l wire gauze or leather muzzle, securely put on so as to prevent them from biting, and any dog going or being at large, during the period defined in such proclamation, without such muzzle, sha.ll be killed a.nd buried. SECTION 6. Definition of Dog. For the purpose of this ordinance, the word "dog" shall be construed to include animals, both male and females, of every kind, age and description of the canine species whatever. SECTION 7. Tax - License. Every person who owns or keeps a dog within this Village shall report to the Villa.ge Clerk annuRlly, within thirty days after the 1st dey of May in each year, his name and address, and ShEtll give the name, breed, color and sex of each and every dog owned or kept by such person, and shall pay to the Village Clerk the sum of Two Dollars for each dog so owned and kept, and shall cause such dog or dogs to be registered and licensed in the Office of the Village Clerk.. SECTION 8. Female Dogs. Any person, agent or other person at whose house or premises, building, store or dwelling place any female dog is found or permi tted to rema,in, or any person having or exercising agency or ownership in or over any female dog, who shall suffer such dog to run at large 'lVhile in I heat, in any street or public place, whether the same be licensed I or muzzled as required by this ordinance or not, shall be fined ! not less than Two Dollars nor more than One Hundred DOllars,and each such female dog found running at large in violation hereof, is hereby deemed a nuisance and said dog shall be taken up and impounded, and if not called for within twenty-four hours from -2- such impounding by the owner or owners thereof, or if such dog cannot be safely taken up and impounded, such dog may be slain by any policeman. Upon reclaiming an impounded dog the owner thereof sh~ll pay to the Village Clerk a fee of $1. 00 and present the receipt therefor to the police officer. SECTION 9. License Tags. The said Village Clerk shall provide, each and every year, such number of metal tags as may be necessary, of such size and shape as he shall deem expedient (the shape to be changed each year) having stamped thereon numbers indicating the year for which the tax is paid and the letters M.P.D.T., and it shall be the duty of the said Clerk to deliver one of such metallic pieces to the nerson so paying a tax upon any such dog. Every dog so licensed shall have a collar around its neck, with the metal tag aforesaid securely fastened to it. SECTION 10. Penalties. Any person or persons who shall violate or fail, neglect or refuse to comply with any of the foregoing nrovisions of this ordinance, where no other penalty is prescribed, shall, on conviction, be fined in a sum not less than Three Dollars nor more than One Hundred Dollars for each and every offense. 4ny dog for which the license fee has not been paid, or which does not carry a tag, may be impounded by the police of this Village 8.nd kept in a safe place for a period of forty-eight hours, and if not called for by the owner thereof within such period, the same may be slain by any policeman. SECTION 11. This ordinance shall become in full force and effect on the 1st day of May, A.D.1937,upon publication thereof, as required by law, and shall be known as Ordinance NO.~_.
