BE IT ORDAINED, by the President and Board of Trustees of the Village of Mount Prospect, County of Cook and State of Illinois: SECTION 1. That Section 3, Paragraph 10, Section 6, Section 8 and Section 9 of an Ordinance entitled "An Ordinance to Regulate the Sale of Alcoholic Liquors in the Village of Mount Prospect, County of Cook and state of Illinoisll, passed April .3, 1934, approved April 7, 1934, and published April 13, 1934, be amended to read as follows: SECTION 3. APPLICATIONS. (10) A statement that the applicant will not violate any of the laws of the State of Illinois or of the United States, or any ordinance of the village in the conduct of his place of business. Before any Class A license. as hereinafter defined, shall be issued on such application the applicant shall furnish to said Village a good and sufficient bond with ei ther t't<TO sureties who shall be residents of the Village of Mount Prospect, and who shall be able to schedule real estate owned by them in said Village of a market value of twice the penal ty of such bond o'\rel' and above any encumbrances, taxes, and assessments, or a corporate surety to be approved by the President and Local Liquor Control Commissioner of said Village. Such bond shall provid~ against any violation by the principal, his agents or employees, of any of the terms of th~s ordinance or an;y ordinances, rules and regulations now in I -1- ..-.. force or which may hereafter be in force in said Village affeoting the operation of such business. The penalty of suoh bond shall be $1,000.00. SECTION 6. CLASSIFICATION -- FEES. Suoh lioenses shall be and are hereby divided into two (2) classes, to-wit: (1) . Class A lioenses, which shall authorize the retail sale on the premises speoified of al- coholic liquor for oonsumption on the premises as well as other retail sales of such liquor. The annual fee for suoh lioense shall be $300.00. (2) Class B which shall authorize the retail sale of alooholic liquor by olubs, as defined by said Aot entitled: "An Aot Relating to Alooholic Liquors," approved January 31, 1934, and in foroe February 1, 1934, on the premises of suoh olub to its members and guests for oonsumption on suoh prem- ises. The annual lioense fee shall be based upon the membership of such club and be at the rate of $1 for eaoh regular membership outstanding during suoh year, or any portion of suoh year, up to seventy-five, making a maximum annual fee of $75.00. The president of the village may also grant a daily permit to any local organization or group, suoh as a fire department, veteran's organization, lodge, ohurch and similar organizations, authorizing the sale of beer at any pionic, carnival or similar function given by said organization; provided that not more than five suoh daily permits shall be issued to anyone suoh organization during the period of one year. The fee for such daily permit shall be $5.00. -2- .'. .,. 1'"...._ SECTION 8. . CONSUMPTION ON PREMISES. It shall be unlawful for anyone not having a Class A or a Class B license to sell or offer for sale any alco- holic liquor for consumption on the premises where sold, or to permit the same to be consumed on the premises where sold, except that holders of a daily permit for the sale of beer issued under the provi~ sions of Section 6 of this ordinance may sell beer for consumption on the premises where sold, as pro- vided by such permit. SECTION 9. NUMBER OF LICENSES. There shall be issued in the village no more than tOur (4) Class A licenses to be in effect at any time. SECTION 2. This Ordinance shall take effect and be in full foroe from and after its passage, approval and publioation as provided by law.
