HomeMy WebLinkAboutRes 03-92 02/04/1992CAF/ 1/29/92 RESOLUTION NO. 3-92 A RESOLUTION PERTAINING TO COMPLIANCE WITH THE AMERICANS WITH DISABILITIES ACT WHEREAS, the Congress of the United States has recognized the rights of people with disabilities, and stated that it shall be a policy of the United States to have full participation in society by people with disabilities; and WHEREAS, the Congress of the United States has adopted the Americans With Disabilities Act of ~990 (Public Law 101-336) for the purpose of eliminating discrimination against peoples with disabilities; and WHEREAS, the Americans With Disabilities Act prohibits discrimination on the basis of disability by all units of state and local government, including municipalities and instrumentalities thereof, as of January 26, 1992; and WHEREAS, the rule implementing the Act was published July 26, 1991 (28 CFR Part 35) by the Department of Justice; and WHEREAS, the rule requires that the VILLAGE OF MOUNT PROSPECT shall make information concerning the Act and its application to the services, programs, and activities available to applicants, participants, beneficiaries and other interested persons. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: That the Village of Mount Prospect intends to comply with the Americans With Disabilities Act in the delivery of its services, programs, and activities, by making reasonable accommodations for people with disabilities, such as the removal of architectural, transportation, and communication barriers; the changing of rules, policies, and practices; and, the providing of auxiliary aids or services for the enhancement of communication with people with hearing or sight impairments, when such accommodations will enable people with disabilities to meet essential eligibility requirements for services, programs and activities provided by the Village of Mount Prospect. SECTION TWO: That all contracts entered into by the Village of Mount Prospect which shall result in the delivery of services, programs, and activities shall include a requirement that such services, programs and activities be delivered without discrimination on the basis of disability, in a manner consistent with the Act and the rule. SECTION THREE: That the Village of Mount Prospect shall evaluate its current services, policies, and practices, including its facilities, to identify barriers in the environment and in service provision which may result in the exclusion of people with disabilities or in the provision of a less effective service for people with disabilities, such evaluation to be completed not later than January 26, 1993. SECTION FOUR: That the Village of Mount Prospect designates the Village Manager as the person responsible for the coordination of compliance with the Act, and to investigate any complaint against the Village of Mount Prospect alleging non-compliance with the Act, and that the Village Manager can be reached at 708/392-6000 or by writing to the Village Manager, 100 South Emerson Street, Mount Prospect, Illinois 60056. SECTION FIVE: That a procedure for the 9romgt resolution of complaints against the Village of Mount Prospect, alleging non- compliance with the Act, shall be adopted by the Village of Mount WDA Page 2 of 2 Prospect not later than January 26, 1992, and that a description of the procedure shall be available not later January 26, 1992 for the information of the general public. SECTION SIX: That the Village of Mount Prospect shall adopt a plan for the removal of barriers in existing facilities, and that all work which is structural in nature and necessary for compliance with the Act shall occur by January 26, 1995. SECTION SEVEN: That this Resolution shall be in full force and effect from and after its passage and approval in the manner provided by law.
