HomeMy WebLinkAboutRes 05-92 02/18/1992 af/DC 2/12/92 RESOLUTION NO. 5-92 A RESOLUTION AUTHORIZING EXECUTION OF AN AGREEMENT BETWEEN THE VILLAGE OF MOUNT PROSPECT AND THE HOME INVESTMENT PARTNERSHIP CONSORTIUM WHEREAS, the corporate authorities of the Village of Mount Prospect have determined that it would be in the best interest of the Village to cooperate with the County of Cook in the HOME Investment Partnerhsip Consortium in an effort to provide an opportunity for affordable housing for residents of said Village. NOW, THEREFORE, IT BE RESOLVED BY THE MAYOR AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: That the Mayor and Village Clerk of Village of Mount Prospect are hereby authorized and directed to execute the HOME Investment Parnership Consortium Agreement between the County of Cook and the Village of Mount Prospect for Federal Fiscal Year 1992, a copy of said Agreement is attached hereto and hereby made a part hereof as Exhibit "A". SECTION TWO: That this Resolution shall be in full force and effect from and after its passage and approval in the manner provided by law. Fields Village Clerk Consoz~iu~ AgreeMent THIS AGREEMENT entered into this 18th day of February by and between County of Cook, a body politicand corporate of the State of Illinois (the "County") and the Villa~e of Mt. Prospect , an Illinois municipal corporation (the "Municipality"). WITNESSETH: WHEREAS, the United States Congress has enacted the Cranston-Gonzalez National Affordable Housing Act ("the Act") providing federal financial assistance for the support of affordable housing as identified inTitle II--Investment in Affordable Housing of HOME Investment Partnerships Act: and WHEREAS, the Act makes possible the allocation of funds to the County for the purpose of undertaking affordable housing activities identified in the Act; and WHEREAS, the County and the Municipality have determined that joint action is the most effective way to accomplish the purposes of said Act; and WHEREAS, units of local government have had conferred upon them the following powers by Article VII, Section lO(a) of the Z970 Constitution of the State of Illinois: WHEREAS, the Intergovernmental cooperation Act, (Illinois Revised Statues, Chapter 127, Section 741 et seq.) enacted by the State of Illinois provides in part as follows: by a public agency of thi~ State may be exercised and enjoyed jointly with ~y other public agency of this State and jolntJy with any WHEREAS, the parties to this Agreement have had conferred upon them the exercise of powers authorized in Chapters 24 and 34 of the Illinois Revised Statues (known as the "Illinois Municipal Code" and the "Counties Code" respectively); NOW, THEREFORE, upon the consideration of the mutual promises contained herein and upon the further consideration of the recitals hereinabove set forth, it is hereby sgreed between the County and the Municipality hereto, as follows= A. That the recitals hereinabove set forth are incorporsted herein by reference as if fully set forth herein. B. That the Cook County HOME Investment Partnerships Consortium (the "Consortium") is defined to include as members of the Consortium the County; the Village of Arlington Heights, Berwyn, Mount Prospect, Oak Park, $chaumburg, and Skokie; the Cities of Chicago Heights, Des Plaines and Evanston; and the Town of Cicero, and any other municipalities which in the future take the appropriate action under the Act and the regulations promulgated thereunder to join the Consortium. C. That the Municipality and the County hereby agree to cooperate to undertake and/or to assist in undertaking housing assistance activities in order to alleviate housing problems through the HOME Investment Partnerships Program (hereafter referred to as the HOME Program) in cooperation with the Consortium; and D. That the" Municipality hereby authorizes the County to act in a representative capacity as the lead entity for the members of the Consortium for purposes of the HOME Program; and E. That the Municipality agrees that the County will assume overall responsibility as the lead entity to ensure that the Consortium's HOME Program is carried out in compliancewith the requirements of the Program, including requirements concerning a Comprehensive Housing Affordability Strategy (CHAS). It is mutually understood, however, that the County is responsible for implementation of the HOME Program and that the Municipality remains fully responsible for implementation of any other funding from federal, state, or local programs which may be identifiedin the CHASas it pertains to the Municipality's identified needs and prorities. F. That the Municipality agrees to evidence its consent to participation in the Consortium byproviding the County with two certified copies of a Resolution from the governing body of the Municipality that the Chief Executive Officer of the Municipality is authorized to sign this Consortium Agreement; and G. That the signature of said Chief Executive Officer will be affixed to this Agreement evidencing the willingness of the Municipality to participate in the Consortium, and to cooperate in the implementation of the Cook County Consortium for HOME. H. That the County agrees to evidence its consent to participation in the Consortium by providing the Village with two certified copies of a Resolution from the governing body of the County that the Chief Executive Officer of the County is authorized to sign this Consortium agreement; and I. That the signature of said Chief Executive Officer will be affixed to this Agreement evidencing the willingness of the County to participate in the Consortium. . Further, that a copy of this Consortium Agreement signed by the Chief Executive Officer of the County will be provided to the Village. K. That the Hunicipality and County agree to affirmatively further fair housing! and L. That the term of this Agreement is for s period of not less than the period necessary to carry out all activities that will be funded from funds awarded for the Federal Fiscal Year FZ93 (commencing October 1, 1992 ending September, 1993) and that the signatories to this Agreement are reguired to remain in the Consortium through the period ending September 30, 1993. IN WITNESS ~HEREOF t have hereunto set my hand and affixed the Seal of said County at my office in the City of Chicago in said County, this 20th ~)0NT¥ ~MMt~§I0~I~ County C1 erk RESOLUTION OF THE COOK COUNTY BOARD OF COMMISSIONERS AUTHORIZING EXECUTION OF THE HOME INVESTMENT PARTNERSHIPS CONSORTIUM AGREEMENTS WHEREAS, Title II of the Cranston-Gonzalez National Affordable Housing Act created the HOME Investment Partnerships Act (the "Act") to provide federal financial assistance for the support of affordable housing which Act makes possible the allocation of funds to the County of Cook (the "County") for the purpose of undertaking activities to create affordable housing; and WHEREAS, the County and the Villages of Arlington Heights, Berwyn, Mount Prospect, Oak Park, Schaumburg, and Skokie; the Cities of Chicago Heights, Des Plaines and Evanston; and the Town of Cicero (the "Municipalities") have determined that joint action through a Consortium is the most effective way to accomplish the purpose of the Act; and WHEREAS, the County and all the Municipalities are home rule units under Articles VII, Section 6 of the 1970 Constitution of the State of Illinois, and WHEREAS, the County and the Municipalities have the power to enter into intergovernmental agreements pursuant to Article VII, Section 10(a) of the 1970 Constitution of the State of Illinois and Illinois Revised Statutes, Chapter 127, Section 741 et seq. NOW THEREFOR BE IT RESOLVED by the Cook County Board of Commissioners as follows: 1. That the hereinabove set forth recitals are incorporated herein by reference as if fully set forth in this Resolution. 2. That President of the Cook County Board of Commissioners and the County Clerk be and are hereby authorized and directed to execute the HOME Investment Partnerships Consortium Agreements with the Municipalities for Federal Fiscal Year 1993, a copy of which Agreements are attached hereto and made a part hereof. IN WITNESS ~I]gREOF I have hereunto set my hand and affixed the Seal of said County. at my office in the City of Chicago in ~VE~ ~¥ ~C~[~ said County,' this ~O*-b day o f March A.D. 1 9 92 County Clerk RESOLUTION OF THE COOK COUNTY BOARD OF COMMISSIONERS AUTHORIZING EXECUTION OF THE HOME INVESTMENT PARTNERSHIPS MEMOP~NDA OF UNDERSTANDING WHEREAS, the County of Cook, the Villages of Arlington Heights, Berwyn, Mount Prospect, Oak Park, Schaumburg and Skokie; the Cities of Chicago Neights, Des Plaines and Evanston; and the Town of Cicero (the "Parties") have determined that joint action under Title II of The Cranston-Gonzalez National Affordable Housing Act which Title II is known as the HOME Investment Partnerships Act (the "Act") is the most effective way of undertaking activities under the Act, and WHEREAS, the Parties wish to set out understandings reached by the Parties in addition to the terms of the HOME Investment Partnerships Consortium Agreements entered into by them; and WHEREAS, the Parties are ali Home rule units pursuant to Article VII, Section 6 of the 1970 Constitution of the State of Illinois, and WHEREAS, the Parties have the power to enter into intergovern- mental agreements pursuant to Article VII, Section 10(a) of the 1970 Constitution of the State of Illinois and Illinois Revised Statutes, Chapter 127, Section 741 et seq.. NOW THEREFORE, by it resolved by the Cook County Board of Commissioners as follows: 1. That the hereinabove set forth recitals are incorporated herein by reference as if fully set forth in this Resolution· 2. That the President of the Cook County Board of Commissioners and the County Clerk be and are hereby authorized and directed to execute the HOME Investment Partnerships Memoranda of Understanding a copy of which are attached hereto and made a part hereof.
