HomeMy WebLinkAboutOrd 302 03/01/1949 F,MOjfAG.a: 1&5c 2/25/49 38:L AN ORDINANCE REGULATING PUBLIC IMPROVEMENTS BY PRIVATE CON- TRACT, PROVIDING FOR PAYMENT THEREOF AND ESTABLISHING PEmlIT FEES. ****** BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: I SECTION 1. That no street, sidewalk, water main, sewer, I I, lighting system, or any other public improvement on public pro- t perty by private contract, shall hereafter be constructed in I: the Village of Mount Prospect until a permit therefor shall have I' I!I been obtained. 1',1 p'EC1ION 2. That at the time application is made for . such permit, the applicant shall deposit a sum of money equal to the cost of constructing the improvement covered by said per- ! mit, plus 10% ~er engineering and inspection fees and for unfor- II II seen items of construction, the amount of which shall be r determined by the Engineers for the Village of MOunt Prospect. I The said sum shall be deposited: i !! Ii b I' (1) In Escrow in a bank designated by the President and Board of Trustees of the . Village of Mount Prospect; or (2) With the Village Treasurer, to be placed in a special fund of the Village of Mount Prospect at the direction of the Village Board. SECT4QJf 3. That when the funds shall be deposited in escrow as hereinbefore mentioned, the said Escrow Agreement shall provide that~1n the event the said applicant fails to com- plete said construction in accordance with the requirements of all pertinent Village Ordinances within the time fix~d in said Escrow, the Village of Mount Prospect shall be authorized to use all or such portions of said Escrow money as may be required l! I I . 1 .. -2- to enable the Village of Mount Prospect to complete the eon- struction of the improvements involved. SECTION ~. That all monies so deposited in Escrow or otherwise, shall be disbursed upon the order of the Village Board and the person making such deposit, after certification by the Village Engineers that payment is due :for that portion of the work completed. SECTION 5. That no improvements shall be constructed which do not conform with the requirements set forth in the Village Plan of the Village of Kount Prospect as adopted; and all such plans and specifications shall be prepared by or under the direction of the Village Engineers and all such work shall be done under the supervision of said Village Engineers. ~CTI.QN 6. That the permit fee as required by this Or- dinance shall be ~ of the estimated cost of construc- tion. SECTION 7. Any person, firm or corporation obtaining a permit shall also give bond conditioned that he or they will suitably guard and protect any excavation or obstruction and defend, save, keep harmless and indemnify the Village of Mount Prospect of and from any and all action, suits, costs, damages and expenses whatsoever, including Attorneys' fees, which shall or may at any time happen to come to it for or on account of any injuries or damages received or sustained by any part or parties by or from acts or omissions ,of the applicant of his or their services in doing such work; and that he or they will re- store such streets, sidewalks or public property to its former comdition and to complete such work as quickly as possible and I when completed to notify the Village Engineers of such fact; and I I I I II , .. . .. -a- guaranteeing that such work so made in the public streets, sidewalks and public prmperties, is made and constructed in a good and workmanlike manner and of good and proper material and ctr' that the same shall not deteri~te, cave in or require repair or reconstruction for a period of at least two years from the time of the approval of such work as herein mentioned. SECTION 8. That any person, firm or corporation vio- lating any of the provisions of this Ordinance shall upon conviction thereof, be fined not more than Two Hundred Dollars ($200.00) for each and every Offense. SECTION 9. That this ordinance shall be in full force and effect from and after its passage, approval and publication, according to law.
