BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY~ ILLINOIS. Section 1. - CREATION OF OFFICE. The office of Village I< Manager is hereby created. Section 2. _ APPOINTMENT AND REMOVAL OF VILLAGE MANAGER. The Village Manager shall be appointed by the President and Board of Trustees for an indefinite term. He shall be chosen on the basis of his executive and administrative qualifications with special reference to his actual experience in or his knowledge of accepted practice in respect to the duties of his office hereinafter set forth. At the time of his appointment he need not be a resident of the Village or the State, but during his tenure of office he shall reside within the Village. Neither the Village President nor any of the Village Trustees shall receive such appointment during the term:br which he will have been elected or within one year after the expiration of his term. The Village Manager may be removed by the Village Board by a majority vote of the entire Board at any time. The manager may demand written charges or a written statement of the reasons for removal which the Village Board shall furnish to the manager within twenty (20) days after the filing of such request. During this period the manager may be suspended from office with pay. The action of the Village Board in removing the manager shall be final. .", Any vacancy in the office of Village Manager shall be filled within ninety (90) days after the effective date of such vacancy. Section 3. - POWERS AND DUTIES OF VILLAGE MANAGER. The Village Manager shall be the executive officer and head of the administrative branch of the Village. He shall be responsible to the Village Board for the proper admini stration of all affairs of the Village. He shall have the power and be required to: A. _ Recommend to the Village Board the appointment of officers of the Village who are required by law to be appointed by the Village Board, members of the Police Department and the Treasurer- Collector and he shall recommend to the President the appointment of the administrative officers who are required by law to be appeinted by the President. He shall further recommend the removal or suspension of any such officers when such removal or suspension will be consistent with the best interests of the Village. All such recommendations for appointment or removal shall be based upon merit and upon the quali- fications or dis-qualifications of such officer without regard to any political belief or affiliation. B. _ Prepare the annual budget and submit it to the Village Board and be responsible for its administration after adoption. C. _ Prepare and submit to the Village Board as of the end of the fiscal year a complete report on the finances and the administrative activities of the Village for the preceding year. D. - Keep the Village Board advised of the financial condition and future needs of the Village and make such recommendations as he may deem desirable. -2- -. E. _ Recommend to the governing body the salaries to be paid each appointive officer and subordinate employee of the Village. F. _ Recommend to the governing body, in writing, from time to time, for adoption, such measures as he may deem necessary and expedient. G. _ Consolidate or combine offices, positions, departments or units under his jurisdictions, with the approval of the President and the Village Board. The Village Manager may be the head of one or more departments, the Police Department and the Treasurer-Collector's Department. H. _ Attend all meetings of the Village Board unless excused therefrom by the Board, except when his removal is under consideration, The Manager shall have the privilege of taking a part in the discus sion of all matters corning before the Board but shall have no vote therein, . He shall be entitled to notice of all meetings, regular and special, of the Board. 1. _ Purchase of all materials, supplies and equipment, for which funds are provided in the budget, but he may not purchase any item which exceeds any budget appropriation until the Village Board has increased the appropriation; provided that for purchases of more than $500.00 he shall be requiJ!ed to receive sealed bids and shall present such bids to the Village Board for approval or rejection. The Manager shall advise the Village Board as to whether or not any contract offered is desirable, or which of several contracts offered is most desirable for the Village. He may issue such rules and regulations governing requisitions and the transaction of the business of purchasing between himself as purchasing agent and the heads of the departments _3_ ... officer s and employees of the Village as the Village Board may approve. In case of accidents or other circumstances creating an emergency, the Village Manager may, with the consent of the Village Board, award contract and make purchases for the purposes of repairing damages caused by the said accident or meeting said public emergency; but he shall file promptly with the Village Board a certificate showing such emergency and the necessity of such action, together with an itemized account of all expenditures. J. _ See that all laws and ordinances are duly enforced. K. _ Make investigations into the affairs of the Village or any department or division thereof. Investigate all complaints in relation to all matters concerning the administration of the government of the Village and in regard to service maintained by the public utilities in the Village, and see that all franchises, permits and privileges granted by the Village are faithfully observed. L. _ Devote his entire time to the discharge of his official duties. M. _ ~rform such other duties as may be required of him by the Village Board or the President, not inconsistent with the Village Ordinances or the law. N. _ Make monthly reports to the Board of Trustees of activities of all departments under his jurisdiction. Section 4. - BOND AND COMPENSATION. The Village Manager shall furnish a surety bond to be approved by the Village Board, said bond to be conditioned on the faithful performance of his duties. The premium of the bond shall be paid by the Village. -4- .... The Village Manager shall receive such compensation as the Village Board shall fix from time to time by Ordinance or resolution. Section 5. - SAVING CLAUSE. If any section, subsection or sentence clause or phrase of this Article is for any reason held invalid, such decision or decisions shall not affect the validity of the remaining portions of this Article. All ordinances of the Village prescribing the duties of heads of departments shall remain in full force and effect except insofar as they conflict with the provisions of this Article in which case the provisions of this Article shall govern. Section 6. - That this Ordinance shall be in full force and effect forthwith upon its passage, approval and publication according to 1a w. PASSED: this 18th day of October, 1955.
