WHEREAS, the Zoning Commis sion of the Village of Mount Prospect at a public hearing duly called and held according to law considered the request for a variation to permit the construction and operation of a medical center office building in the R-3 Residence District, on the real estate hereinafter described; and WHEREAS, the President and Board of Trustees having con- sidered the recommendation of the said Zoning Commis sion to grant a variation and the Petition of the adjoining owners approving said varia- tion, find and believe that the public interest will be served by such variation; NOW, THEREFORE BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: Section 1. That a variation of the provisions of an ordinance entitled "An Ordinance classifying, regulating and restricting the location of trades and industries and the location of buildings designed .... for specified uses; regulating and limiting the height and bulk of buildings " hereafter erected or altered, regulating and limiting the intensity of the ~ use of lot areas and regulating and determining the area of yards,'- courts and other open spaces within and surrounding such buildingsj establishing the boundaries of districts for the said purposes and prescribing penalties for the violation of its provisions", passed and approved December 4, 1923, known as Ordinance No. 52, as amended, be granted in the R-3 '\ , District on the following real estate: Lot 30 in H. Ray Berry Co. Colonial Manor, being a subdivision of part of the Northeast quarter (NE 1/4) in Section 11 and part of the Northwest quarter (NW 1/4) in Section 12, in Township 41 North, Range 11 East of the Third Principal Meridian for use as a medical center office building and for no other purpose. Section 2. That said real e state shall be subject to all limitations and conditions placed upon properties designated as non-conforming uses as defined in said ordinance heretofore mentioned. Section 3. Any person, firm or corporation who violates, disobeys, omits, neglects or refuses to comply with or who resists the enforcement of any of the provisions of this Ordinance shall be fined not less than Ten Dollars ($10.00) nor more than One Hundred Dollars ($100.00) for each offense, each day that a violation is permitted to exist shall constitute a separate offense. Section 4. That this ordinance shall be in full force and effect from and after its passage, approval and publication according to law.
